- I pay my bills too replies to I pay my bills| 3 repliesI pay my bills too and these calls are calling me for an AT&T acct and I have NEVER had AT&T. These guys are scammers. I pay my debts and watch my credit closely! These are people that have nothing else to do but, scam innocent people!
- Alfalfa replies to I pay my bills too| 2 repliesAsk the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay!
https://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - NightowlPTThese people call my house 5 - 7 times a day and leave a message that they need to speak to one of us (my husband or I) and leave an extension to call back but never say who they are or what they want. I won't blindly call someone back unless they tell me what it is in regards to. It's harassment and it is driving us crazy.. We have no outstanding debts so I have no idea what this call is about
- Caller: Prince Parker (Sometimes comes up as private)
- Affected replies to CRII have his home address. It's cross referenced to Prince Parker & Associates. I saw a number on the T.V. advertising a car warranty and decided to Google it and ended up here. Prince Parker & Associates is in all kinds of scams. The car warranty company I saw advertised on t.v. has a different name but the same kind of scam. They claim to warranty a car but when it comes time to seek them to repair your car they don't, using every kind of excuse. I have checked and they are a collection agency as well. Like I said above, I saw the number on T.V. advertising a car warranty " 1-800-276-2473" and it links to a collection agency as well as _____ - Agreed replies to Alfalfa| 1 replySome states require them to be licensed to collect a debt in that state. I'm not sure but they might be required to say in their collection, validation letter if they have to be or are licensed to collect a debt in your state. Some states require them to give you the change of ownership of the debt they are trying to collect ; as in _ the original creditor, the person or company they sold the debt to, ; every company, creditor, etc in the chain of ownership.
Also. always demand / request they give you a full accounting as to how they arrived at the amount they are trying to collect from you. The interest rate, the statute of limitations of the debt. States have a different statute limitations on when the time expires to collect a debt. They can still pursue someone for a debt when the debt is past the statute of limitations _ BUT _ the debt can NOT be legally collected in a court of law; they can only threat _ intimidate _ scare you. If the alleged debt you owe is past the statute limitations in your state and you are for sure it is and you are receive a subpoena ? served to go to court MAKE SURE YOU DO GO TO COURT _ tell the judge the debt they are trying to sue you for is past the statute limitations ; BECAUSE if you don't go to court ; the court will enter a DEFAULT JUDGEMENT which means they believe the creditor. So make sure you go to court if you receive a subpoena. if they can't find you to serve you with a subpoena then don't worry about it. I'm not 100% sure but the longest statute limitations to collect a debt is 10 years in some states ; best way is to call up an attorneys office, it might take trying several different attorney's before you get one that will take the time to tell you what the statute limitations in your state is.. ... I just checked and a few states have a 10 year statute limitations. - BigA replies to AgreedBefore giving advice it is always best to know what you are talking about.
"Some states require them to give you the change of ownership of the debt they are trying to collect ; as in _ " No, that is covered by Federal Law which requires them to go back to the original creditor for validation, provided that you ask for it in writing within 30 days of receiving the dunning letter. "Also. always demand / request they give you a full accounting as to how they arrived at the amount they are trying to collect from you." That would be included in the original contract. They are not allowed to collect anything other than what the original contract specifies. "BUT _ the debt can NOT be legally collected in a court of law; they can only threat _ intimidate _ scare you. " They must now tell you if the SOL has expired. If it has, then threats of a lawsuit are illegal. Subpoenas are not issued for lawsuits unless you want someone to testify. A complaint is filed and then properly served on the defendant who then has a certain amount of time to respond to it (usually 20 to 30 days). The court doesn't enter a default judgement because they believe the Plaintiff. They enter it because someone didn't show up to defend against the claims so the claims are considered valid. You can simply go online to find SOL by state or go to your State Attorney General's Website.
