My home is paid for (has been paid in full since 1989) I have just sent a cease and desist letter) I also record phone calls from them. after telling them at the beginning of the call they are being recorded _ they protest but I tell them if they remain on the call _ they are agreeing to being recorded. They can't help them self _ they will keep calling and I will keep recording the calls. They want to play , I'll play with an attorney

- BigA| 2 repliesYou need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: http://www.consumerfinance.gov/

- Alex OhThis 800-276-2423 number is being called everyday, then followed by 704-841-2424 number. They keep calling to my wife's cell phone. They claim I owe some amount to ATT over discontinued account. I asked the person to send me related statement via e-mail. He said he would but he did not send. I contacted ATT and confirmed I owe nothing to ATT. Actually ATT issued me a check for credit. Their business should be banned.

When I tried to call back I get the message that the number is no longer in service. I’m thinking it was a scam call

- JuicedBill collector. Called about an ATT bill that is in dispute. Lady wouldn't shut up long enough for me to finish a sentence. Basically, a modem was sent back to them and it didn't show and ATT is investigating as UPS verified that the modem was in the box before it was shipped and it was received by ATT but the modem isn't showing up in the system as received. So, they're investigating and said it can take a few days to a week. Now, back to the phone call. After being interrupted every time I tried to say something, I hung up on her. Sorry, I can take only so many "I understands but..." before even my patience runs out. I called back and spoke with another individual and basically informed them that I hung up on one of their coworkers because they kept interrupting me. They actually said ok and listened while I told them what was going on, the individuals and supervisor who are investigating, and that if they kept irritating me that I can get very nasty.
