NEVER GOT ANOTHER CALL - TaraJust got a call from these people. guy o the phone tells me that they spoke to the executor (my Mom's accountant a few moths ago, and was now calling to ask where we are at with the status of the estate? I ask him "Why are you calling my house, call the executor" The guy says aren't you handling the estate ma'am...well obviously not if you already know that her accountant is the executor..DUMBASS!

- TinyT replies to Curious and ConcernedDo not call them back unless they can provide you with specific details on who they are looking for, what it is in regards to, and provide documents to back up their claim. I received a call from this company and they gave me a 1800 number to call back (they left me a message because I was not avail when they called). The number they gave me to call was different from the number they called from, and when I called the number on my caller ID that they called from, it was not a valid number.
So, I called the 800 number and they were saying that I didn't pay back a $100 loan I took out 4 years ago (but could only provide an address of where I lived at the time, not a date that this loan was taken out). They told me I set up the loan to be paid by electronic debit from my checking account and then closed my account before even one payment could be paid back. It is true that I closed a bank account but I didn't and never would set up payments and cancel the account. Anyway, I kept asking them to give me any specific details on the loan and the only thing they kept saying was the name of the company and that I now owed $300 to pay the account in full. All I had to do was set up payments with them from my checking account and it would finalized everything and take care of it.
Since I am a very smart lady, I asked them, "Why would a company want to set up electronic payments from my checking account again, when that is what they are saying I did and closed before it could be paid?" Of course, these people had no answer but to say they were just the collectors and they I needed to set it up with them to keep from being taken to court for what I had done.
I asked them to produce the paperwork that was signed on the loan, because I keep all loan documents and I had no documents with this company anytime in my past. Oh, the intial rep I talked to passed the phone to their "manager" when I asked for documents and the manager said they were immediately emailing me the paperwork that they received from the company (I never received anything in my email). They again said that they were sent the information by the company and all they knew was I needed to pay them for thie delinquency or I would eventually be taken to court.
I told them it would be stupid of me to take their word for it without any official documents that showed this loan agreement (and the fact that I know I didn't take out a $100 loan, because I would have to need quite a bit more money than that to take out a loan). So, I told them if I received the paperwork that verified everything I would call them back. I never received the paperwork so I never called them back (this was around the first week in April). I received another call about a week later when they left a message threatening to call them back or I would be going to jail and that they would keep calling until they talked to me. I didn't call back and they haven't called me again.
I will tell everyone on this site, if you receive a call from a "collection agency", make them produce all the paperwork of the agreement and what you owe, and verify the information with your accounts and paperwork. Oh, and DON'T TELL them any extra information that they haven't given you. These people obviously have found some of our personal information from various websites, survey completions, etc. and are trying to use little bits of personal information to get money. With these personal credit card machines that can be used by individuals, these scams can used by the smallest entity and if we get scared by threats of being taken to court or going to jail, we could give them a real entry into our personal accounts and finances. Believe me, if a company is going to take you to court, they are going to have mounds of information to present to you because they'll need an air tight case for it to hold up in court.
I am just a Captain in the Marine Corps and in no way an expert, but this is the second time that I've received one of these calls. I don't want anyone to be taken by these people so remember, you make them prove you owe them something and then have them send it in writing with account information you can verify. If it can't be verified by some default account you find, disregard their calls, or if you have the resources and enough of their information, go after them! - Not the Weaver familyKeep getting calls - from local numbers - asking for the person that makes the financial ...of the estate of James Weaver. I did answer it and explained one day that I did not know this person, we have had this number for over a year, take my number off the list. - they still continue to call.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
