This number calls every 3 days. When I answer they just ask for some guy who I assume is the previous owner of my number. They don't believe I don't know who they're looking for and threaten with police and jail time. I always say "go ahead. Call the cops. I'm home waiting for them. And while I wait, you give me YOUR information so I can call the cops on YOU for threatening me."
They always hang up on me at that point.

keep getting calls from this number,  reading other post I believe they too are looking for money following a death.  I called and the lady gave me the name of the company but would not give further information only wanted my number so she 'look it up to see why they called me"  I refused to give my number and again asked what this company did and she said she could not give this information until she looked up my number.  I told her I would report them.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

These people calling (harassing) me are heartless B A S T A R D S! My father died two years ago after a lengthy bout of extremely painful bone cancer. My father was financially broke from medical expenses and his last days were spent in a state funded hospital. There was no estate, no money left in his name after his death, and my brother and I are living on fixed incomes. I tried to explain all of this to a rep with Phillips and Cohen but apparently it went to deaf ears. As far as I'm concerned the debt is null and void. I'm not responsible for my father's debt and neither is my brother. Case closed!

    Some Tips:
    *Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time, date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.

I got a call on my cell phone from this number yesterday.  I was busy and didn't answer and they didn't leave a message.  My husband died 9 months ago, and I had talked to them shortly after that, and also corresponded by mail.  My husband had a credit card in only his name that they were following up on.  I mailed them a letter about a month ago telling them that there were not enough assets to even open an estate, and that there is nothing left to pay the bill.  I'm going to block their number on my cell phone so they don't bother me anymore.

Debt recovery agencies like Philips & Cohen are regarded as bottom feeders. Or in other words scumsuckers. My mother died two years ago with no assets and no probate and these insensitive people have been barraging me with calls five days a week, sometimes twice a day. My mother had some minor credit card debt. I sent Philips & Cohen a cease and desist demand letter via registered mail. If they continue to call me after 30 days I'll file suit against them. Also, no debt collector may call you on your cell number. It's in violation of the FCC. Philips & Cohen has been sued over 40 times just last year for their nefarious tactics.

Patti, no debt collector may call your cell phone number. It's in violation of the FCC. You need to compose a cease and desist letter to Philips&Cohen and make sure it's mailed via registered mail. If Philips &Cohen dosen't honor your demand then you have the right to sue them for harrassment. If you have a call log of their number calling you on your cell phone that will also be very helpful if you want to peruse legal action against them. Hope this helps.

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

If you sent them a C & D by certified mail, they must stop calling you the day they received it.  There is no 30 day anything.  If they call you even once after signing for it you have a case. "Also, no debt collector may call you on your cell number. It's in violation of the FCC."  There is no law that I am aware of that would forbid a DC from calling a cell phone.  the FCC has no jurisdiction over DC's anyway.

These people have been calling me for months following the death of my father 3 years ago. My father had a Citibank card that was $1K in debt prior to his death. I wrote to Philips & Cohen stating that I'm not responsible for my dad's debt as there was no estate, no money whatsoever and to please stop contacting me. That was three months ago and they keep calling me and sending me demanding/threatening letters to pay up. I sure wish I could afford an attorney to sue these crooked people.

You need to look for a pro bono attorney, and there are a lot of those listed online that handle these kind of law suits. See my post above for the steps and their information is in both Big A's and CWG40's post above. You still have no reason to tolerate these clowns and there are things you can do to them.

OK, first, did you send those letters certified, return receipt?  Second, you can hire a lawyer to sue them on a contingency basis (no money out of your pocket) as they must pay your attorney's fees when they lose..  Putting up with this for three months is unacceptable on your part.

You should have sent them an immediate debt validation letter from the get go.

You need to send them a certified, return receipt cease and desist calling.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.
