- Betty replies to Fred| 1 replyUnfortunately, Georgia, our state, requires neither license nor bond to engage in the business of purchased debt collection. Therefore, any company from out-of-state, and even in-state, can pretty much do whatever they deem as "appropriate" to harass, threaten, abuse, and file cases against individuals - without any fear of easy legal reprisal.
It is not this way in all states, but the Georgia State Legislature, Governor, Secretary of State, and State Attorney General have all but declared open season on Georgia Residents for purchased debt - even if you are being called by mistake. There are documented cases in Georgia (see the recent Hanna & Associate legal problems) were collection agencies and the marginal law offices they bed-down with are falsifying documents, affidavits, and testimony in court documents. Georgia has failed to follow the minimum standards, set by most states, by regulating this industry.
Even O.C.G.A. (Official Code of Georgia Anointed) statues states (paraphrasing) "the court will provide every opportunity for a creditor/plaintiff to seek relief from the debtor/defendant". We have seen one example, forwarded to our office, of a junk debt buyer (Stenger & Stenger, PC / Capital Alliance Financial, LLC - one in the same, both owned by Phillip Shea Stenger in Grand Rapids MI) pushes through cases of purchased debt with no documented legal records, ignoring Defendant's discovery, late non-compliant court filings, and documented and certified out-and-out falsifications in Motions and Filing - still winning a Summary Judgments in Georgia. This is also a great example of an Attorney/Junk Debt Purchaser not having to file any business license or procure a bond from the State of Georgia to conduct business within our state or courts.
This is a real problem in Georgia. We have gotten calls since 09 for debts belonging to someone we knew of 20 yrs ago! they are still coming in and now being passed from company to company, Cease letter have even been sent... the whole collection thing is totally out of control.... do not call list do NOT work.... we have been on it since the beginning. The whole problem is the gov agency's do NOT do anything. EVERYTIme, they call, they get reported and each new company gets a letter, but they are still calling! makes me wonder, just how much money can this Kroger employee own, for this kind of harrasment
- T.C.Every day we get a call from SMS about someone named "Shandra Williams" we moved to this address 8 months ago and do not know this person. I have repeatedly called back to this number to report that this individual does not live here. I can never get a positive reply, the reason most likely is simple. These so called Gestapo apes probably never graduated from high school, are socially inferior, have the mind set of Adoph Hitler, probably never dated, overweight, buck toothed, pimples galore and a high IQ (on a good day of around 56!!)
These phone calls are harrassing, intimidating and infringing on my civil rights.

- Aggravated replies to FYIOne GREAT rule of thumb when dealing with anyone over the telephone....DO NOT EVER give out personal information such as a bank account number or Social Security number.
You can however ask for the individual's name (even if it is a desk name), the name and address of the company, and the nature of the debt. IT IS YOUR RIGHT!!
I always seem to get a hang up when I ask for the name of the individual calling, and have yet to successfully receive any information as to the name and address of the calling company.
What is that to lead you to believe????

- AnjGot a call and while i was running a search on the number i let the machine pickup, following is a "transcript" of the message :: this call is for mallory lake if this is not mallory lake please hang up or disconnect the call:: repeated until i picked up the phone and hit end (at least 10 times, i wanted to see how long it would run through the script)
