Either send a letter to them telling them to stop, or...pay the bill! They are your two options are the calls will continue.
- Confused256| 3 repliesI had never heard of SRS until today. I was at work, and decided to check my home voicemail, when I got the information about "business I was conducting in Alabama". I had a PDL with PayDayMax.com, but because of a great deal of financial issues, I wasn't able to pay it off. I supposedly owe $719.97, however I didn't think that a PDL company was supposed to tack on additional fees and such to what is actually owed. Nonetheless, I received a call from this SRS, and they were extremely rude, much like a company based in Florida. I talked to a David Greico earlier, and told him that I was willing to make arrangements to pay off the loan, but after reading some things on here, I'm a bit hesitant to work with this company. I have their information, including my supposed case number, so if any of you have any advise, please help a sista out!

They use the words "firm" and "claim". They make it sound like they are making a friendly call to make you aware of a current lawsuit that has been placed in your state. They also try to bully by calling relatives and other people to harrass and embarass. This is blatant fraud and the more people that contacts the New Jersey Attorney General or the FTC the better.
They have a right to try and collect money, but they do not have the right to break the law. I wonder how many unsuspecting people that they have totally conned into beleiving that they have or are going to place a lawsuit in the very near future. I would bet the owners (kelli and David Gieco) are living quite nicely from the proceeds of these scare tactics. How do they keep all of their fake names and multiple phone numbers straight ? So if we all keep the pressure on them, maybe they will be punished for their illegal practices. If they have used any tactics that broke the law, as per the FDCPA, then sue them too.

Bottomline is that they want to make money and are highly motivated to collect old debts. They understand that they just can't ask politely, so they try to do things differently and use tactics that push the ticket. I'm sure it works half of the time, but the other half of the people are somewhat informed and understand that SRS has to abide by the FDCPA laws.
If you don't want to deal with them, simply send them a cease and desist letter and they, by law, must stop calling you. You will still have an issue of an old debt over your head, but you don't need collectors like this one that bully, intimidate, harrass, break third party disclosure rules.
Bills collectors from collection agencies cannot do any of the following:
Call you repeatedly or contact you at an unreasonable time (the law presumes that before 8 a.m. or after 9 p.m. is unreasonable).
Place telephone calls to you without identifying themselves as bill collectors.
Contact you at work if your employer prohibits it.
Use obscene or profane language.
Use or threaten to use violence.
Claim you owe more than you do.
Claim to be attorneys if they're not.
Claim that you'll be imprisoned or your property will be seized.
Send you a paper that resembles a legal document.
Add unauthorized interest, fees, or charges.
Contact third parties, other than your attorney, a credit reporting bureau, or the original creditor, except for the limited purpose of finding information about your whereabouts (collectors can also contact your spouse, your parents if you are a minor, and your co-debtors unless you have asked them in writing to stop contacting you).

I do not work for SRS, but I do work for a collection agency. (word has spread thru the industry about this website. The rules listed in this post are acurate and must be known and practiced by every collector working in the good old US of A. Some rules vary from state to state but the ones listed here are pretty basic in all states.
I suggest that instead of wasting time bashing this agency, you spend your time on the internet to see what rules your state offers. Most of you are clueless!An educated debter is everyones best friend. Even the collector. I hate having to 're-educate' a debter to the real rules so that they dont have a false sense of security. BTW, a cease and desist letter can bite you. They have no way to warn you that youe account has moved into final stages before court. At this point, no settlements, and youre blindsided. If someone sends a cease and desist letter and a you then get sued...won't you then be notified by the court that a lawsuit has been filed against you?

I did say I worked for a collection agency. No big detective work there. As for my choice of words, it is what it is.
