- RST| 1 replyI had a call from Calvary today saying she was Nancy Warsham and asking for a certain person who happens to be my daughter-in-law which I told her. She asked if she was home. I told her that she lives in another city up North. She asked if I had her number. I said I did, but would not give it to her as I didn't know what this was all about. I told her I could pass her info on to my daughter-in-law, and have her get in contact.
She said they were not allowed to leave messages, but her number probably showed up on my phone so I could pass it on if I wanted to. She asked if I wanted my number removed, and I told her that I did.

- BigA replies to RSTYou need to warn your DIL that she is the intended victim of a debt collection extortion scam. One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money. They often call people that have never even been associated with you because they get erroneous information off of the internet.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Your Daughter in Law needs to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), and you should send them a "not me" letter (think of it as the best $6.59 you ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. Cavalry Portfolio Services, LLC is one of the largest junk debt buyers in the nation. Cavalry buys up old charged-off debt from credit card companies, doctors’ offices, cell phone companies, retailers and even other debt buyers.
Cavalry won’t have the necessary documents to prove their case against you, and they are betting on the fact that most people allow junk debt buyers to get a default judgment against them.
Here are a few flaws that could potentially kill any lawsuit filed by Cavalry Portfolio:
Debt buyer can’t prove that you owe the debt.
- Statute of limitations has passed (the legal deadline to file a lawsuit against you – each state varies)
