The deal is that Nor my husband nor I have any affiliation to Capital One. I called today and asked why they kept calling me, and that my husband and I were not even their customers. After the guy took my home number to check if there was a record with it, he said there is no record, I said ok, but before I was able to tell him to take us off the list he hung up. - driftwoodThis number/company is a scam...they've called 8 times in 2 days. When I start asking them questions they hang up. I phoned Capital One's fraud dept and reported it and they "assured" me that they would be following up on it. I've even tried calling them back and never get a human, they ask me to input my CC# which of course I did (5555-4444-3333-etc...) and the robot just switches languages. This is not Capitol One.

I have told them NUMEROUS times that I have filed bankruptcy, they have the attorney information, but continue to call.

- Bree replies to Sarah| 1 replySarah, If you truly filed for Bankruptcy & they have been listed as a Creditor. Then they received a cease & decist notice. They are violating the FDCPA - Fair Debt Collections Practices Act & you have a right to sue them for $$$$. First & foremost undo harassment, then violation of section #806 ? (don't hold me to that #, cause I could be wrong, you can look it up on line for yourself) of the FDCPA.
Bottomline, contact your attorney & advise him/her of the calls. DO NOT TELL THE COLLECTION CALLER, because they should no the law. At this point you want them to call you & you want to answer. Don't be deceitfull. Tell them of your situation & that they have been put on notice & date you sent them the paperwork. Then get yourself a note pad & document the date, time & person you spoke with, along with what conversation was about.
Also, if they call back the same day, even after you advised them of the situation, again violating FDCPA. Make sure you note the times they call. They cannot call before 9:00AM your time!, & no later then 9:00pm your time!! As I stated before do not tell them they are in violation of the FDCPA, as a Collection Agency the Agency, & there Representatives should be well versed on what they can & cannot do!!

So sorry for your profound loss. Obviously the Collector is/was not from the United States cause even the most callous, seasoned collector would have been courteous to you. I realize that I am answering your post several months later & you have already closed the account & are done with them. This may help another who views this web page in a similiar situation.
Once the Collector has made contact with the Creditor (you), they cannot call you for 7 days to demand payment. Only circumstance that could void the 7 day wait, is if you agreed to an early call back to settle or discuss the account in question. Bottom line any calls made before 7 days post personnal contact is a direct violation of the FDCPA - Fair Debt Collection Practices Act.
Not that this would be of any consulation, but you would be entitled to sue for monetary settlement.

My understanding is this number belongs to a Collection agency associated with Capitol one, but they may also be collecting for another Company. Most Agencies have numerous contracts with large & small Companies. At one time they usually specialized in just one type of debt either Consumer: Credit Cards, Car Loans, Home Loans, College Tuition, etc./ Medical: Hospital bills, Physcian bills, Dentist bills, etc. Sadly now they take any type of debt & handle each the same way. Sorry to rattle on.
But that's not the reason for my reply. I just wanted to enlighten you on your rights under the FDCPA - Fair Dept Collections Practices Act.
Under Section 805 Communicatin in connection with debt collection: A. Without prior consent from the Consumer or express permission of court of competent jurisdiction, a collector cannot make contact to you at any unusual time or what should be known to be inconvenient to consumer. Collector cannot make contact before 8am or after 9pm your time! Not there time.
Weekends are not considered inconvenient or unusual. But Government recognized Holidays are considered to be inconvenient & unusual as such a violation of your rights.
But, all this is considered harassment only if you & them make contact ie; speak with each other or if they persistently call in a single period, like every 5 minutes or every hour. In these cases document the calls, get a printout from your phone company. When you speak with them, document date, time of call, plus who you spoke with & the content of the conversation. Then contact an attorney. You may receive financial compensation for your inconvenience. - Jenn replies to BreeBree - They like to play stupid when you ask them if they know what the FDCPA is. I asked one caller from this # if he knew what it was. I actually got the reply of, "no ma'am, I am not aware, as I am not in the United States". I informed him that because he was working for a US based company that he should bone up on his legalities or face further angry educated consumers.
