- Learned My Lesson replies to the boss| 8 repliesThis is to help all of you that are dealing with "Total Recovery Solutions, LLC." I recently started getting phone calls from them. They did not harrass me but wanted me to pay the "balance" of a payday loan that I took with "My Next Day Cash." I had paid the principal amount of $100.00 + an additional amount of $92.00 in "fees." I found out that "My Next Day Cash" is not licensed to give loans in the state of California. I also did some research on "Total Recovery Solutions, LLC" and found that there is an existing Cease and Desist order against "Total Recovery Solutions" in the state of Idaho. There is also a Cease and Desist order against "My Next Day Cash" in the state of California. I filed complaints with the BBB, FTC and Department of Corporations against both companies. Today, I received an email from the BBB and "Total Recovery Solutions, LLC" and they have discussed the balance due with their "client" and they have agreed to waive the balance. I also sent "Total Recovery Solutions, LLC" a cease and desist letter. If you don't allow these people to harrass you, they won't. Send a cease and desist letter and make sure that you research payday loan compainies before taking a loan with them. Only do business with those that are licensed in your state.

I laughed at their attempts to scare me and Mrs. Watkins became beligirant with me, and when she finally stopped harassing me I explained. 1) you called me at work and in case you didn't notice I am a collection agent for a major finance company; 2) everything you said is untrue according to the Fair Credit Act; 3) if this is a fair and just debt I request you send me documentation of the original debt so I may have a finance attorney review it; 4) this is me asking you politely to cease contacting me at my place of business which is my right under the law; 5) please provide me with your address so that I may send you a letter informing you to cease contacting me and to revoke this imaginary assignment of wages that I signed while sleep web browsing for extra cash.
All that Mrs. Watkins could say was "no!" I am calling from a law office and you have to give me your account info so that we can withdraw what is owed or we will sue you. I said, "if you recall when I answered I said, all calls are recorded and monitored with or without prior permission. So please she me so that I can play your harassing phone call to a judge.
They have been still calling my home, but it's a different person, "who keeps trying to tell me that during the last call I promised to make arrangements." No I didn't but decided to play along, "I'm sorry I don't recall that I have Alzheimer's so you may have talked to me when I was experiencing a prior life time line. Oh wait are you recording this? You must stop I'm in the witness protection program and I can't risk someone having my voice on tape. We are tracking your signal please stay on the line and someone will be there shortly to rescue you." I just kept going and going until she finally hung up, thanks for the address of the company as I will be forwarding them a certified letter to cease their harassment.

If they don't, or even if they do use the address in Kansas City MO that others have provided and request they cease. You can find examples of letters online, but and it certified, return receipt.
- DeeThese people call me from their 855 number as well as their 702-800-8925. Before that it was 702-570-4085. All of these numbers are from "Total Recover Solutions". I have spoken to 2 people so far, maybe 3. They claim they are debt collectors for MyQuikFunds. Did I get a loan from them? Yes, 3-4 years ago! Why are they just now contacting me? Yet I found it weird they stated I got the loan in January of this year which can't be true because I filed taxes during that time and I get back quite a bit of money so knowing that why in the world would I put my self in more debt? I've gotten burned before thinking a company was legit so I'm not trying to go down that road again.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.
Contact a Consumer at Work
A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
Seek Unjustifiable Amounts
A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.
Contact a Consumer Represented by an Attorney
A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.
Communicate With a Consumer After Receiving a Validation Request
If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.
Communicate With Third Parties
A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

I own a printing company with 37 employees. We have had several such instances where an employee was being harassed by those scum hoping to embarrass them and put pressure on them in order to extort money. We handle the situations and allow no access to our employees nor do we accept their threats or even their calls. Their hope is to embarrass people, and we simply let them know that it isn't going to happen with us.

I am in a rough financial situation right now but I definitely don't owe any payday loans. They just left a message saying for myself, my wife, or my attorney to call them back and gave me a reference number. They called yesterday once and called 3 times in a row this morning. They said they were B A V Solutions. I use Youmail, so I ditched that number and also set it to where it says the number is disconnected.

I don't have any account with these people at all. I received a message from them stating that I was going to be served papers for a court hearing. The message only stated for me to call them. First of all if I was going to be served legally they would not be calling me and I would have received a letter of sort from the court here in California. This is total harassment, and I am going to file with the attorney generals office.

- porter replies to porterIt is The California Department of Business Oversight if you need to look at license status for payday lenders...Also look in the "alerts" and enforcement actions against companies; if you have used an unlicensed lender even ones that claim to be exempt due to the fact they are a " tribal lender" and "sovereign" due to that fact, arm yourself with info and challenge these companies.. stop ACH transactions through your bank, ask for refunds if you have paid the principal amount on your loan, file claims with your bank, formal complaints can be made on the California DEPARTMENT OF BUSINESS OVERSIGHT, and you may have to even close your current account and get a new one. These unlicensed companies are predators!!! Do not get trapped... Some simple facts for California: 300.00 is the max limit for payday loans.. about 17.00 per 100.00 borrowed..they do not " renew"....you pay the full amount on the given day...installment loans are legal but you pay more over longer time..they are expensive....
