- USAGIRLI received a phone call 2 days in a row - left a message yesterday but not today. Got a call from a Mrs Walker stating she was in the legal Finalization Department and I had until the end of the day to return the call so this matter could be resolved. Interesting in the background all I could hear was talking talking of all the other "telemarketing bill collectors" on the phone leaving similar messages. My sister received the same call a few months back for a bill that was paid 5 years ago. This company is obviously bottom feeding and trying to collect old debts that are either outside the statute of limitations or have all ready been paid. Unless I see something in writing, I wouldn't deal with them. Definitely don't give your banking information over the phone because once they have that, they can take what they want. Ask for something in writing FIRST and let them know the only form of payment will be by money order or certified check and be sure to send it certified mail.

- azguyGot a call at work from someone who called herself Miss Walker and Margo. Says I owed from a payday loan I got over the internet. I don't do that type of business over the internet. Plus, payday loans are illegal in AZ. Told her to call me at home. Then she rattled off a number she says is my home number and she has left several messeges. But it isn't my number. I've had the same home number for over 10 years.
When I told her to send me something in writing she asked, "Why?" When I started to tell her why,the b*tch wouldn't shut-up. Told if she didn't shut-up, I'd hang-up. She wouldn't shut-up, so I hung-up.
If I REALLY owed them money, they would be able to send me something in writing. Clearly, they are just fishing for suckers to send the money. TOTAL SCAM- Caller: unknown

- Kristine| 3 repliesI received a voicemail message from this company stating there was a claim filed against me. I called back and spoke to a Mr. Yancy and a Ms. Bradford. Ms. Bradford was very crass and threatened to send over a document to my employers to deduct payments out of my wages. She also lied and said that because I filed a contract with the pay day loan company, I can't file bankruptcy. I found that odd because I was never served for a lawsuit. I was cooperative and said that the most I could pay was $50/month which she wouldn't accept. She also said that they don't have to sue or go through courts to take payments. She also gave me an ultimatum to pay a certain amount by 4pm (6pm CST in their time) or she will proceed to contact my employer's payroll department. I told her that I was going to contact an attorney for free consultation. After my consultation, I called back to relay the info given to me by the consumer attorney. Ms. Bradford continued to interrupt, not listen and be belligerent. She went on this rant about how she's 50 and can still manage to pay her debts by going to a plasma center. She continued implying that I was irresponsible and refusing to pay--which I wasn't. I was still being cooperative and simply wanted to review what she told me and what the attorney told me. She then said if you're not filing bankruptcy, then I don't care what you say. I requested copies of the contract, payment history, and document that she was sending to my employer. She finally said that she didn't have to give me anything, I just need to pay what I owed, and my employer will give me the document. She then said, "Have a good day." and disconnected the call.

Your story describes a ridiculous pile of violations of FDCPA and possibly your state laws. If you're not comfortable filing suit pro se, a good consumer lawyer will bury these insulting clowns for you on their dime. (Meaning that if the one advising you only wants to talk "settlement" payment to these thugs, get someone else ready to fight.)
Keep all messages and create written records of every encounter you've had. Record clean audio of live calls if you can. - Resident47 replies to Debt validationErrm, actually it's $1K per action. A rogue collector could (illegally) melt your phone line with fifty calls a day, call you hurtful names, threaten to come to your workplace with a wage garnishment order, and claim your children will be sold to slavery. The most you will get for statutory damages under FDCPA is still $1K. Suing for each violation probably won't happen, as the courts think alleged debtors are a nuisance with guilty faces to begin with.
Actual damages are unlimited but harder to prove, like mental distress and medical disorders tied to the collector's actions. With careful study you might also stack up FCRA and/or TCPA violations, which are "all you can eat" per action. Don't forget UCC and state laws could factor. - esummerallnumba1| 1 replyi have been recieving calls from this number for a pay day loan i did online. i never do these but was in need of money. i will never do it again!!! this company calls my job and says that i have to make a payment agreement and dummy me did! but i didnt have the money in the account... i have read up on this place and was really concerned now because all this negative things have been going on with them... the woman Ms. Walker called me today again and stated that the payment didnt go thru and i needed to pay it.. i told her that i wasnt going to pay it right now and i want to speak to the loan company to discuss payment arrangements. she wouldnt and said i needed to pay it and was very rude and acted like i dont know how to pay bills!!she then stated that she would contact my HR dept for them to take out 550 + other charges (which my loan was only 200), i said that an attorney or judge would be the only ppl that can do that legally, she said that its not really garnishing my wages its just taking out the full amount. i then told her that i am recording the call (which i wasnt) but she said that she doesnt give me permission to and then i heard my echo while i was talking... i kept telling her that i know i owe the loan and i do want to pay it but i cant pay it now. she put me on hold and i hung up... she then called my job not asking for me but HR department... we have caller id and i new the number when i asked regarding, she said she couldnt discuss it. i then said that she just called and spoke to me. she so your not giving me the number??? well dont think i can get it some other way! i then told her that i want the business name and her full name so i can report her to the BBB!!! she then was going on and on about how i cant pay my loan and i kept telling her i want her info and company name, she then said have a nice day and hung up on me!!!! - no bullOk I got more info from my cousin who used to work for this company. the name of the company is Total Recovery Solutions they are located at 3543 Broadway Kansas City Mo 64111 the owner is Sal Abbot he said he has a partner chuck, this is all the info he gave me i will try to get more and keep you posted.

Without a legal written notice and court proceedings your wages cannot be garnished.
DO NOT give them any banking information as it is consent by default to debit your account regardless of whether you owe a valid debt or not to them on behalf of a loan provider.
If you are sued then settle or seek advice of an Attorney.
I filed for Chapter 13 Bankruptcy protection/structuring and still receive these calls 3 months after providing all of the proper documentation to my Attorney and the Court and 3 months after making payments to the Bankruptcy trustee.
It is illegal under the Bankruptcy laws to be contacted after notice from the Court as all were legally notifed and given opportunity to present arguments to the Court under a very rigid structure and timeline.
Most likely overseas loans or outright scams (I have received those scam calls too with no supporting verbal information or documentation after requesting to mail me the documents or sue me through the Courts and send notification through the US mail both before and after the Bankruptcy filing).
None of the overseas companies will pursue in the US in Court.
Bottom line.......if it is legitimate they will find you and pursue through the proper legal channels.
You do and will have time to address the situation if it is legal and documented through the Courts.
Minimum of 60-90 days before any legal action and time to respond/prepare if legitimate.

- Walt| 1 replyGot a phone call this morning from some woman informing me that there was an important matter referred to her office and I had to get back to her today to resolve it. Although she did not identify what company she was calling from (call ID said "toll free call") I belived it had to be from a bill collector.
Since I had almost been a victim of a scam a few weeks back, I checked out the number and it came from Total Recovery Solutions, a debt collector looking to possibly scam money from me. I have always felt that a reputable debt collector would send you a letter first giving you details of the debt supposedly owed and who to contact. Most of these supposed debt collectors refuse to send you any documentation or claim they have when you know they haven't send you a thing.
Fearing a scam, I respond only when I get a letter from a legal office and even then have it checked out before entering into an agreement with them, as I found that even some paralegals working at law offices try to play games with you. When they try, I let them know I'll call the Attorney General's office of the state they are located in and have their license up for review and that usually gets their attention!- Caller: Total Recovery Solutions
