    I received a.partial message left in my recorder.  It only gives a name and to disregard if I am not that person.  This is a robocall.  When I check my caller ID to see who this is. The number recorded is the number which appears when my callerdoes not allow their number to show or do not want to be identified.  As far as I'm concerned. If it's a legitimate business, they won't hide their I'd when calling.

    BBB files contain a pattern of complaints from consumers that allege they have requested proof of debt that is being reported by Medical Data Systems on their credit report, but have not received anything. In other cases, several consumers have reported to BBB that they were unaware of a debt that was reported by Medical Data Systems to the credit reporting agencies, or that Medical Data Systems, Inc fails to remove reference to debt from their credit report after a debt has been satisfied.

    On February 13, 2017, BBB sent correspondence to Medical Data Systems, Inc requesting their voluntary cooperation in providing steps it will implement to eliminate the pattern of customer complaints.

    On May 22, 2017 Medical Data Systems, responded to BBB stating the following:

    Medical Data Systems, Inc. d/b/a Medical Revenue Service (debt collector) is fully compliant in all federal and state laws pertaining to debt collection. MDS has conducted a profound research into the present issue and would like to amicably reach a mutual resolution in this matter.

    MDS has a structured standard policy that each employee must adhere to prior to reacting to any dispute(s), complaint(s), and/or request for debt validation(s) on behalf of the company. Moreover, it is our policy that any and all disputes received undergo an equivalent scope of investigation based on its distinctive issue. Below is an example of such response:

    We are in receipt of your dispute and request for verification pursuant to the Fair Debt Collection Practices Act. Please be advised our company does not own the account nor do we own the debt. We are a third-party debt collector on behalf of the original creditor and are bound by contractual parameters regarding the collection of their delinquent debts. We have contacted our client/original creditor,    Medical Center,
    who has confirmed the name and address listed on the account. In accordance with hospital admittance policy the person listed as the guarantor is responsible for the charges incurred, and our client has confirmed the amount owed. Enclosed (is an/are) itemized billing statement(s) provided by our client that confirm the charges. Please be advised we have furnished information on this debt to credit reporting agencies. Please be advised that based upon your dispute, we have requested the credit reporting agencies to update the information furnished to reflect your account disputed.

    It is unfortunate that there's an allegation against MDS that reflects a pattern of miscommunication between the consumer(s) and MDS. With integrity MDS has always attempted to rapidly respond and resolve each consumer's inquiries with respect and in a timely manner.

    Validation Resolution: MDS will respond to each consumer advising/confirming receipt of their dispute(s) and/or request for validation(s). As well as be sure that all debt validations whether (previous or current) are specified within our BBB responses outlining the "on or about date(s)."

    Further within your correspondence it states that in other cases, several consumers have reported to the BBB that "Medical Revenue Service fails to remove reference to debt from their credit report after a debt has been satisfied."

    With reference to said clause please be advised that in accordance with the Fair Debt Collection Practices Act, once on account is paid in full, that status is reported to the major credit reporting agencies. As it was originally an unpaid debt properly sent to a secondary collection agency (MDS), no full deletion request will be sent to the major credit reporting agencies.

    Credit Resolution: If payment(s) are made in full or either settled at a discount, the credit bureau will be updated the same "paid collection account." There will be no special notations or full deletions. It will only UPDATE as paid.

    MDS generally reports to the major credit reporting agencies once (1) per month. Thereafter, it is presumed to appear as updated within thirty (30) days.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated


    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.

    Also contact your local attorney general

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.
    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.

    This is a nationwide scam.  They get your personal information from your hospital even if you don't owe the hospital any money.  My guess they pay off hospital employees for the info.  Need a class action lawsuit started against this scam company and the hospitals that provide them with your personal information.  Any suggestions?  (Please don't identify yourself or, god forbid, give them any more of your personal information.)
