- GeoffreyLol,so i got this same letter and a cashier check today it looks nice and i do have an account with wellsfargo but my check is for 42.16 lol so ill take it to wells fargo and see,,
- Denise| 8 repliesThe cashiers check $75.84 had me rereading the accompanying letter. I believe that in cashing the check you will be reaffirming a past bankruptcy and that WF may have bought out or taken over an account that was included in a BK MANY years past. However I drew a big X through the check to never cash and file. I also remember WF had had a security breach...if this is part of stolen identity we should all file a class action...???? The post mark on envelope 85282...does not match letterhead and is pre.sorted 1st class.
- Caller: Letter with cashier's check received.
- Tygerkat replies to Denise| 5 repliesWhat did the letter say that led you to your conclusion that cashing the check reaffirms a bankruptcy?
- Heather| 1 replyIt was a legitimate check from Wells Fargo for a return of late fees on an auto loan from years & years ago.

- Concerned replies to CaSandra| 3 repliesI took the check into Wells Fargo & they confirmed it was a valid check. I received $44 for a loan that was 10+ years old. It must have something to do with a settlement of sorts. You should definitely not go into business as a detective.
- MikeHuntleton replies to Denise| 1 replyWell, if it was a "past" bankruptcy", then I would assume it is also past the Discharge date and can't be reaffirmed. All you have done was throw away $75.84, unless there is something in that letter (you did not mention the reason for them sending you a check) that would obligate you to something it stated.
- Tygerkat replies to Concerned| 2 repliesI'd be more inclined to believe that person than you because there is no logical reason for you to be here. You already know to whom this number allegedly belongs.
- MikeHuntleton replies to Tygerkat| 1 replyI am in agreement with "concerned" on this one and I too know who the number allegedly belongs to, but that is besides the point. WellsFargo has multiple listings with P.O. Boxes in Sioux Falls, take note none have a street address either. I could not find anything with "Ionex Telecommunications" having the PO Box number mentioned, other than people who claim it is. I did find an old PDF with WellsFargo Alarm Systems and Ionex Telecommunications, no address given, but the alarm system might be using Ionex Telecommunications.
- Tygerkat replies to MikeHuntletonPoint taken. 😸
- Denise replies to Tygerkat| 4 replies1st paragraph..."As a result of at least one bankruptcy case filing that included the impacted account...." In bold letter states.."This is not a bill or a request for payment as to these customer(s)"...and, 3rd paragraph....if the late charges were not already paid the refund may be used to pay them in the future" letter also states ..will remain on the account and may still be outstanding at the end of the loan term if not paid before then. FYI ..I had loaned my truck out and the guy wouldn't return it..flaked on payments..his checks bounced..police got my truck back but it was stripped..he had 1st try to sell /trade for ??..I found paperwork in the truck when at impound yard of what he tried to do. I was thinking it was because of that incident. The guy was put in jail. Nonetheless I wont cash it because a 'red flag' says no don't cash it. And yes..unscrupulous debt collectors still go after people even when BKs have been discharged...they have underhanded ways...no matter how long. They do soft inquiries on your credit report and follow you. ..I do a lot of reading...everyone should request their free credit reports. They can up their own credit score by following the instructions to correct erroneous information..ok am off on a different subject. I apologize to this site. Of course people will have their opinions..do what's in your heart..think and reread your letters before cashing your checks. D.
- Denise replies to MikeHuntletonPlease read my reply to Tygerkat. There is no time limit...debt collectors should not harass one but the account is sold for pennies on the dollar and way down the road an offer...secured credit card or ??? will come ones way and someone will "bite" at the offer...and they have you back in a viscious cycle with high interest rates years later...an interesting book is, "City of Gold" ...theres interesting info about telemarketers and their scams and where they are from and how they live in Dubai. Very eye opening. I checked it out of the library and ended up buying the book. The book has a lot of other info. Back to the letters we're all chatting about...bottom line, I wont cash mine. I have never dealt with WF...unless someone else did so using my name on my trucks registration.

The first sentence is an acknowledgement of your Bankruptcy, so they know about it. Once a Bankruptcy is processed and has been Discharged, it ends the term and that Loan account is closed permanently! A Discharge is a Court Order that they end any attempt to collect on the debt.Quote:"As a result of at least one bankruptcy case filing that included the impacted account...." In bold letter states.."This is not a bill or a request for payment as to these customer(s)"...and, 3rd paragraph....if the late charges were not already paid the refund may be used to pay them in the future" letter also states ..will remain on the account and may still be outstanding at the end of the loan term if not paid before then.
It is illegal for anyone to try collecting on it after a Discharge, so as long as it has, you can safely cash the check. That is up to you if you disagree, I was merely trying to help you from tossing away money. You can ask ANY Bankruptcy Lawyer and they will tell you this too
Yes, they do....however, if you inform them you know they can't collect on it and it is illegal for them to try, they will leave you alone. It is people who believe these criminals that they are looking for and say anything to trick them into paying.Quote:And yes..unscrupulous debt collectors still go after people even when BKs have been discharged...they have underhanded ways...no matter how long. - Denise replies to MikeHuntletonThank you for your response. I have been trying to understand the sentence "....as to these customer(s)" ; and I question the MANY recipients of a refund...are their letters the same? There are many who have inquired about their checks who have left messages using the 2 different phone numbers..on the check..and in the body of the letter...why would so many lean towards a check hoax etc? I still believe that the "customer (s are the 3 who had my truck and the receipt for a vehicle signed by 2 using my address....I just dont feel right about cashing the check and I have distanced myself f the whole nightmare. I thank you again, for your response wherein you are probably correct in your opinion I just don't want to cash a check from WF who had had a security breach awhile back and also I have never dealt with WF. Regards D
- Denise replies to MikeHuntleton| 1 replyHi Mike. My apologies for typos.

First, Wells Fargo is a bank. They are not a third party debt collector. They don't buy other people's bad debts. I am sure that they have enough of their own to deal with.Quote:I believe that in cashing the check you will be reaffirming a past bankruptcy and that WF may have bought out or taken over an account
While this may be true none of them send you a check. You say that you "loaned" your truck to someone? If the loan was in your name then you were responsible for making the payments on time not that person. You cannot legally assign your loan to someone else without the lender's permission. You apparently did not do enough reading to keep yourself from defaulting on the loan. That whole story about he was going to strip the truck and sell it, etc has no bearing on this subject. I guess the only silver lining in this is that money will eventually be turned over to the state and you can collect it from them.Quote:And yes..unscrupulous debt collectors still go after people even when BKs have been discharged.. - TWell Fargo sent me a check for $29.00 stating they owen it to me for an overpayment on a car loan. Except I have not had a car loan from them or anyone in 15 Years. Fraud!! Do not call them. Dedinately don't cash the check!

- Toni replies to Dammitall| 1 replyI received a letter also saying it was refund of late fees for an auto loan through Wells Fargo. I’ve never had an auto loan Thru Wells Fargo. The check was for $67.34.
- Kaninchen replies to ToniI received a check today for the same amount and didn't have to think twice before tearing it up. I have NEVER had ANY type of loan through Wells Fargo.
- CHRIS| 1 replyI too received a cashier's check and thought it to be worth investigating. I went to WFSettlement.com which states that a class action settlement for wrongfully charged fees on Auto and Home Loans was finalized and refund checks were being mailed beginning October 2020 through December 2020.The Auto Loans were between Oct 15, 2005 through Sept. 30, 2016. There are telephone numbers on that site to call with questions and amounts of the checks. However, the phone numbers are different than what is on the letter and the letter numbers show as scams online. I still am uncomfortable with the less than professional business wording of the letter, the logo, the watermark and the address. With the frightening amount of Identity Theft these days, we need to be concerned and yet with the pandemic situation, every dollar counts. I will be checking all of my past car loans on my credit report and past taxes to see if any were from Wells Fargo and calling those phone numbers on the WFSettlement site, as well, before I cash the check. Be Safe, Be Healthy and Be Careful.

- BigA replies to CHRISHow would you not know if you had a car loan with them? When you buy a car you sign a contract to make payments and it tells you who the lender is. Then you make car payments every month for several years. I don't see how anyone would forget something like that.
