Had same thing happen months ago, someone called several
times making threats to put in jail, send bounty hunter, etc...
We ignored the calls and Reported them.

of jail, harassment, etc... We told the Attorney General the
Whole Story, the Attorney General mailed the complaint to the
offenders business office asking them to Explain Themselves,

DENYING I was a customer, they Never heard of me
and they had NO business with me.

I kept them, Thats Great! Since I was NEVER a Customer

- appalled| 1 replyJackie Vargus left voicemail on a neighbors answering machine referencing a legal matter. voicemail scared neighbor because they stated, "it was a time sensitive matter". apparently two separate people called, one name Brad and another named Jackie. phone number left was (866) 485 9708. the interesting thing is that this is something no longer on my credit bureau and the statue of limitations has expired on the debt I was appalled when told I was a thief and judgemnt was filed said sheriff would come to my door

"This is Jackie Vargus from over here at Coleman and Associates, there has been a formal complaint filed against you..." The message certainly got my attention so, I called the number back. Sure, enough, it was Coleman Law Office! I don't recall the name of the man I spoke with but he had my maiden name, SSN AND address! Needless to say, I was in shock. She then proceeded to tell me that I had "better hire an Attorney," in response to my denial that I had received a "Beneficial loan in 1999 that was paid on until May 2004." I told her several times that it wasn't my loan. He all but called me a liar! After 3 or 4 rounds of 'no it isn't/yes,it is, I just laughed at him. She got a little 'pissy' then and, in response to my request that she send me some paperwork as proof, he said, "I'll be happy to" and then she hung up on me!

They will be able to settle your debts for 75 percent, check the local statues in your state. also a credit report is no indication of everyone you owe money to, if a company sells your account they stop reporting on it, it is up to the company that buys the account to put it back on your report if it is whith in 7 years of charge off. be careful of the advice you get on this or any other site, it sounds like a bunch of dead beats that do not pay their bills to me

He said and I quote "Wait it Out." If these people can't send you proof that you owe a valid debt, and I mean more than just case numbers and dollar signs on their letterhead. Verification that the debt is valid, and not past the Statute of Limitations of your state, then there really isn't much that they can do. According the the MASS state bar, Paul J. Coleman and Associates are an active law firm. If they own the debt, or represent a third party, they should be able to present this proof and you should be able to make payments on it, no matter how small. Collection Agencies in general want money, whatever they can squeeze out old debts. They'll take whatever they can get. These "legal representatives" however don't seem interested in collecting small fry monthly payments, but a large lump cash sum. The attorney also let me know that there are several law firms out there that buy old debts for about 10% of the original debt. Whatever they can get over that amount is profit. So to take my attoney's advice, wait it out, and if they call, ask them politely to not call, remind them of the Fair Debt Collections Practices Act (which can be seen here at this address (http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf) and give them an alternate means to contact you.

Coleman law offices purchases out of statute debt, legally, the debtor may not even before responsible for the debt. Sure, they could always "PAY" this debt collector, only to have another seven years worth of derogatory reporting on their credit report, not to mention resetting the state statute of limitiation. My advice to anyone on this forum, if you have received communication from this debt collector, pull your credit reports, check your state statutes for these items and if needed contact a consumer advocate attorney. They can advise you on how best to deal with the situation. You can locate one in your area at naca.net. Remember that YOU are your best advocate, be informed and make sure you know your rights. Don't listen to everything you hear.

They are trying to make money off of accounts they purchased for pennies on the dollar, you cannot go to jail for being in debt. If they state they will file a lawsuit, and they do, make sure you hire an attorney and properly answer the summons. They will get a default judgment if you do not and those are hard to overturn. If the debt is time barred, then you can use that as your affirmative defense, which MUST be raised when you answer the summons. This agency called my stepdad looking for my husband, for an account that he had before he even met me. They pulled MY credit report to find information about my husband and found my stepdad's name on a joint account. The debt my husband owes is time barred. (9 years old) We advised them of that and of course they are determined more than ever to scare us, even asking my husband if he was a "real man". I am smiling now just remembering the conversation. (one letter and 4 phone calls this week) Make sure you pull your credit reports and check the date of last activity on your account. This is the date the states use in determining whether or not a debt is time barred. Most states have a limit of 4 years for credit cards, some have more, some less.. you can find these limits on just about any credit forum.

This is a collection mill tactic that is becoming increasingly popular, because many people are afraid of having to appear in court. DON'T BE! The burden of proof is on them, if you show up you are likely to be able to get the case dismissed. If your state has website where you can check court dockets, do so, that way if they try to serve summons at an outdated or improper address, you will still be able to answer in time.
