- Hot New Growing Industry Debt Scavenger replies to brad fullerHere is the deal Brad didn’t tell you: there is Hot New Growing Industry in American started from debt collector attorney’s and associates who are known as third part debt collectors for example Law Offices of Paul J Coleman. They are preying on red ink America. This 3rd party debt collectors/Scavenger tries to collect on debt that is past the statue of limitation. The 3rd party debt collector buys ancient debt for pennies on the dollar and tries to squeezes money illegally from uninformed consumers all over the country. If the Original Creditor or Creditor bank has charged off your account the 3rd party debt collector can not collect on the debt. The reason is the Original Creditor took the bad debt as a loss and received a credit from the IRS. Fair Dept Collection Act protects Consumers’ from illegal debt collections practices.
Another common scenario is sometimes people have fallen victim to identity theft, fraud on their cards others fall on hard times. People fall on hard times many contact their Creditor for help and to find a solution. The credit report will shows late payments until they are able to come to a payment solution or brings their account current or negotiate a settlement. The Original Creditor usually drops interest and penalties and they sometimes even work further to lower a full paid settlement. The arranged amount agreed on by both is accepted as payment in full. The original creditor writes off the portion he deducted from the account settlement as loss and the IRS gives creditor a credit for the portion written off. Everybody’s happy, its over, stress is relieved. Well its suppose to be however, Five or more years down the road here comes Dudley the Scavenger collector trying to rail road the uniformed consumers into paying them illegally for what they define as “bad debt” that has been written off. They are not intitled to this money, it is illegal for them to collect on it. When the original arragments were made i.e. back in 1998 or 2001 or 2002 your original arrangement stands and your account was and remains paid in full forever! The 3rd Party collector hopes he can cast doubt in your mind and use harassment, threats, tell you he represents the Original Creditor (false), they continue using demeaning comments, inappropriate language, they call MANY times a day, everyday leaving long messages, hanging up, purposely calling to annoy, which is illegal (FTC regulations). They cause more and more stress in hopes you will pay them to get rid of them. However, all of the above is illegal and you should call the DA, Attorney General, FTC, and the Bar Association and file formal complaints. Keep all recorded messages; if it is legal in your state you can record your conversations with them. There are attorney’s that specialize in this type of situation and they are good at turning the tables on these 3rd party collectors. You can sue these third party collectors for damages and require they pay all attorney fees. See FTC as it lists what you can sue for such as punitive damages, violations and please take a look at the court case wherein NCO lost 1.5 million dollars to consumers as they used unfair collection practices.
The fact is they don't care if you’ve paid the debt off with the original creditor they will hound you, threaten you, misrepresent the situation and themselves so they can scare you into paying them money. Offer them proof you don’t owe the debt and they will not accept it and go around and around with you, argue with you, taunt you, threaten you, demean you and break many of the FTC rules. They often misrepresent their authority. Not only log onto the FTC but take a look at http://www.educationcenter2000.com/, with the way our economy is going its time to stop the bottom feeders and if they can’t get a legitimate job and be part of the solution instead of the problem just hang up the phone. They appear to be people who hate other people; they are thieves without consciousness or compassion. Hope they don’t expect compassion when the legal tables turn. We need to take our country back and stop people from making a living hurting others and breaking the laws that are meant to protect us. File complaints, exercise your legal RIGHTS! - Boy just another violation replies to tx debt attrorneyWhat right do you have to call them when you are not related to the case. If you were truly a tax attorney you would not act so inappropriately. It is not legal for them to be giving just anyone an individual's private details. And just because they say he owes them money does not mean he owes them money. He has the right to request full disclosure and demand all documentation in their possession and all receipts with his signature on them. Tax attorney, right, more like Dairy Queen Manager. That is about how professional your action was (illegal). You just gave him more for his position against the creeps.
- Dr. Jeff replies to pissedLook, don't talk to them anymore. Send them a cease and desist letter, telling them not to contact you by phone again. Demand all their documentation and proof that you legally owe a debt. be mailed to you. If they do not have your mailing address get a post office box and have it sent there or get an attorney. Let Paul J Coleman and Associates be responsible for attorney fees. They are already in legal trouble for putting your health at risk and their attack could have put so much stress on you, you could have ended up in the hospital. Check your state for statue of limitation in California its 4 years. I'm not sure what state you are in but there is a list. To ease your mind call the FTC and explain the situation to them, they will have you file a complaint as calling you at work is illegal, causing you harm and distress is illegal as you are pregnant and they had no business ganging up on you at work, its all illegal. You will end up suing them and winning. And if they send you a silly little piece of paper with something that looks like a signature saying from someone you owe the debt, it will not stand up in court of law. They need to provided you will a complete record of your spending, signature and receipt, its called complete disclosure and they owe it to you. Just so you know Paul J Coleman is not licensed to practice law in California and I would call the bar association and 1. find out if he is licensed in your state, file a formal complaint with them if he is and explain their behavior. The Attorney General fined Paul J Coleman for unfair collection practice and its easy to look up the details just type in his name and Attorney General and it will come up. This company has been sued by many who on the same grounds who have won. I think and hope this next round with the Attorney General will be his last and hopefully with all the complaints he can be disbarred and civil action can be brought against he and his employees for their part in unfair practices. When you one of these 3rd party collection companies harass you, use illegal means, misrepresent and give false implications they are in legal trouble and will be responsible for payment of damages, court costs, fines etc. People like this only have as much power over you as you allow them to. The law is on your side. Just follow up with FTC and table of statue of limitation in your state. All my best to you and your little baby, may you have health and strength....
- another informed consumer replies to tx debt attorneyI find someone who spends as much time as you do on the internet insulting people questionable, questionable that you are an attorney at all. That you actually have much education at all. Questionable that you know the law or could carry on an intellectual conversation without calling someone a name or giving an order. If you want to order people around, order a pizza. Do you have a job? Do the 3rd Party collection agencies pay you to sit and type nasty reply's to people? I think you'd make more money cleaning toilets and you'd be providing a higher level of service to our country then is present in this blog. Go get a real job you fake. Do you even know how to file a tax return? Maybe try turbo tax and turbo law? You are a insult to the legal profession.
- Fisherman replies to jackieIf he does not have your SS number what does that tell you? The Original Creditor would have all your information and if they assigned it to collection your records would follow. Needless to say The Law Office of Paul J Coleman are scavenger collectors and obviously were not given authority to represent the Original Creditor; in fact it seems as though this is a scam. If you gave him you SS# he’d come back at you and say well I have your SS# so that means the debt is yours. They probably pulled your credit report and looked for any old debt that didn’t appear resolved. They are known for their unfair collection practices and the resort to abuse, harassment as they try to intimidate and terrorize their victims to collect a debt they have no authority to collect. The debt has usually been resolved either between Creditor and Debtor or by writing off the loss as “bad debt” and the Creditor receives credit from the IRS. When this happens the debt is no longer legally collectable. Do not admit to Paul J Coleman or his employees you think you owe any debt. Do not talk to him or anyone from that company. Do not give them any personal information, even if it’s something as simple as “there are clouds outside my window or its raining”. They have a reputation for working outside the statue of limitation, as well as the laws the FTC and others have put in place to protect the consumer. The Attorney General fined The Law Offices of Paul J. Colman a $5,000.00 for unfair collection practices. Paul J Coleman has been sued by those he has tried to collect from for unfair practices, he lost. It is best to send in writing a cease and disist order in including demand for absolute disclosure of all documents. The result in legal penalties if it is later discovered that Paul J. Coleman knowingly lied about or concealed significant facts or withheld any information and was not completely forthcoming. In the letter I would require the phone number and individual to whom they claim is their contact from your Original Creditor. This is your legal right. Get in touch with an attorney right away hopefully your attorney. NCOs’ consumers were awarded $1.5 million dollars for unfair credit practices. The Law Firm of Paul J. Coleman purposely tried to cause embarrassment they called you at work, falsely implied through their action that they had legal authority to request and gather your personal information from your employer. The act in itself is defaming. They falsely represented their realm of authority with implication they were the Original Creditor. Their actions where highly and grossly negligent. They broached employer, employee confidentiality with deceptive action. Their actions were an attack on your privacy and a third party collector does not have the same rights as an Original Creditor. If you have told them you dispute the debt they need to supply you with that information within 5 days. Contact you original creditor like you suggested, talked to them about paying any remaining debt. If they have already written it off as "bad debt" you are not required to pay the money to any collection agency. When the Original Creditor writes off the loss "bad debt" they receive credit from the IRS and the debt is no longer collectable. If someone collects the debt then the IRS would need to be contacted and the loss written off and credited reversed with interest. I think the Original Creditor would be too happy and would have something to say to Paul J. Coleman and his elves.
IN THE MATTER OF PAUL J. COLEMAN d/b/a COLEMAN & ASSOCIATES, P.C.
On May 15, 2007, the Attorney General entered into an Assurance of Discontinuance with Paul J. Coleman d/b/a Coleman & Associates, P.C. (Coleman) of Revere, Massachusetts. The Attorney General opened an investigation of Coleman after receiving a complaint alleging that Coleman engaged in unlawful debt collection practices. The Attorney General also determined that Coleman, a lawyer licensed in Massachusetts, was not licensed to collect debts in West Virginia. In the Assurance, Coleman agreed to comply with state and federal consumer protection laws in his future debt collection practices. Coleman also paid $5,000.00 for
consumer education. - LOL replies to DinkyThey have no brains; thats a good one, they are going to call the IRS for unreported income. If its an old debt its already been filed as a loss and you've already paid taxes on it if you were suppose to because the original creditor files. Tell Paul J Coleman to come up with something better then that. Actually why don't you call the IRS and let them know that Paul J Coleman is collected on debt that has already been written off as bad debt. The Original Creditor has already received the loss and has been credited by the IRS. Therefore Paul J Coleman will be brought before the IRS court and ask if he'd pull his head out of his Azz. You can't collect twice on a debt that has been written off as bad credit then to top of the IRS gives the Original Creditor credit. The Original Credit isn't going to want to give up his credit with the IRS therefore, Coleman is guilty of collecting on debt that is not legally collectable.
- Check your state statue of limitations replies to sick and tiredit maybe past the statue of limitations and if it is you are not legally liable to pay, also if the original creditor has written off the debt as bad debt, loss then received a IRS tax credit. you are not liable to pay. call an attorney file charges you will get punitive damages I bet Jackie Vargas will be fined for using unfair debt collection practices. Paul J Coleman are scammers its most likely you don't owe the debt. They lie and use scare tactics, scream yell and try and intimidate. Tell her to go take some tumms or pepto-bismo, maybe gas-X and take a long walk and just keep walking. I bet if someone got on the phone and attacked her the same way she attacks others she would burst into tears and crumble. They just love to demean and shame, attacking personally. If someone told her she was ugly, smelly, fat and discussing and her breath smelled like a cat box I'd bet she'd be a bit upset. Of course when your absent a brain, it might just go right over her head.
- Troll Tracer replies to kmTrolls are ugly, they smell, they lie and they cheat, they live under bridges deep in the forrest with fungus on their teeth, Go Home KM; fat ugly 3rd rate collector trolls aren't allowed on the A list. Go back to school get your GED then go back again and add a few brain cells, then learn a trade, you can be the french fry cook at McDonalds. Looky there you have already moved up in the world. At least until McDonalds smells you and finds you scarfing down all the fries, picking your nose and .... then if they can pry you out the door; you have to head. no roll back under the bridge again, but at least you'll have your GED.
- to the fake TX debt attorney replies to tx debt attorneyLook why don't you just put a cork in it. If he said he doesn't owe it; if he said its not his bill; he doesn't owe it. If you want someone to pay the bill you pay it; its probably yours to begin with. You suck up enough of the earth resources already, do you think sitting on your big butt all day is free? It costs us all money. If you want to criticize someone, if you want to spread your sick hate around, pull out the mirror and stand in front of it, there is the person you really resent, there is the person you can't stand, the person you are really yelling at. the person you are mad at; the person you are ashamed of, the one you hate. GO TO THERAPY, start working on yourself, learn to tell the truth you aren't smart enough to be a tax attorney. First learn how to read and write better.

- suneReceived a call from someone who identified himself as John Reddin. He was callong about someone I know and wants me to pass a message to that person. Gave this number to call back 866-493-5029. After I pushed a bit he said he was with Coleman and Associates. Caller ID number was 978-993-9222. Obnoxious, vague, kept repeating that it is about a legal matter.

- Fry40I received a call from John Redden first identifying himself as being with the Attorney Generals Office demanding I pay a settlement of $8,000 on a supposidly $14,000 debt from 1999. He demanded a credit card number to pay this $8,000 settlement then asked for my parents credit card information if i did not have one. He said if this was not paid by the end of the day today then he would take action against my home.

- BebopMy elderly mother received a call from this number. The caller (identified himself as 'Mark')left a message in very harsh terms indicating this was not a sales call - it was a legal matter that needed her attention immediately. It scared the heck out of her. She attempted to call the number but wasn't able to get through and asked me to help. I listened to the message and was immediately leary - when I called, I wasn't able to get a live body either but did get the office name - the law office of Paul J. Coleman. I googled the name to see where the office was and imagine my surprise when I came across multiple sites warning consumers about this predator. Turns my stomach! My 81-year-old mother said she was so worried she couldn't sleep all night.

- DeeSomeone named Mark Smith left me a recoded message stating in very harsh terms that their call was not a sales call and to return their call immediately. I will not return their call. I had another strange call yesterday very much like this. I think my phone number has been added to some scam list or sold to a number of unsavory and dishonest phone scammers. I will not return their calls. Beware of these numbers.

- Mrs. R replies to keOh my goodness, just two weeks ago these rude individuals called my brother and sister-in-law in whom live in a totally different state than I do, stating that I owed a debt that was cleared off my credit. Also stating that it was a time sensitive matter. They told me I couldn't negotiate and only had 24 hours to come up with the money. I gave in and even called the next day to set up the arrangement, but when I asked if I could send a money order, they told me no, with the reason of,"Just because." From there the man who claimed to be the owner proceeded to argue with me and hang up on me. My husband called back who is a deputy and the man proceeded to cuss him out and told him that he owned me. Eventually telling my husband, f**k you! My husband hung up. We asked for written documentation stating why we couldn't send a money order and that is when he went crazy! It was horrible experience and I am glad we did fall for this scam! The worse part is that they obviously have my social security #
- Lew Hugenbottom replies to SandraI've had my cell phone number for 7 years, and for the last 18 months I keep getting calls from different collection agencies asking for a "Pedro Garcia". At the beginning I answered and explained to them that I have no idea who Pedro was, that I've had this number for 7 years, etc. The collectors were either very rude (assuming I was Pedro giving them the run around) or were very stupid. From one of them I gathered that someone may have transposed the last two digits (say 213-999-2568 for 213-999-2586). Also, the (213) 999-xxxx exchange is a CELL PHONE exchange, which means that any deadbeat could easily discontinue cell phone service to get rid of collectors.
This is my new strategy: whenever I suspect a phone call is from them, I simply ingore it.
