They cannot report to the IRS unless: (1) they first prove it's a legitimate debt (which they never can); (2) unless they've forgiven the debt.  If they send a 1099C to the IRS they must first give up all rights from now until the end of time to collect the debt themselves.  Only then can they report the debt they've forgiven as unreported income.  How likely do you think it is a collector would ever voluntarily give up all rights in future to collect an alleged debt?  That's right: NEVER.  Ignore this, it's one of the oldest and most useless ploys in the collectors bag of tricks.

BUYER BEWARE sounds like an individual who knows their rights under the law.  KM sounds like a collector troll who wishes everyone were as ignorant as the average collector.

That was a very interesting link, thanks for posting it.  It seems like the state of West Virginia really looks after consumers and penalizes business that don't follow the law.  A fine example that the rest of the country should use as a model.

Well, Mr. Pay-up-regardless, I invite you to lose your job of 30 years, become disabled, and live on $700 a month for a family of three. Maybe you wouldn't be so smug about people becoming aware of their consumer's rights.

my husband was also threatened with this today from this agency.  The creditor has inflated a debt of $6000 to nearly $30K and since they know it's beyond SOL, they told my husband they were sending him a 1099,  If i am correct, this is illegal for two reasons.. the first being it has to be the original creditor reporting the loss, and it has to be reported in the year the loss was sustained, ie, when it was charged off.. I am thinking of hiring a tax attorney for my husband due to the large sum.  I have also seen on several message boards that a lot of collection agencies are now sending out 1099's.

Stay tuned. I just got a call from my attorney who will be filing suit against Paul J Coleman & Associates PC for their violation of my rights. I wrote them a cease and desist letter via certified mail at the post office but they continued to harass me at home and my mom on her home phone.  Even though they got my letter they kept on calling me using a recorded message threatening legal action and called my moms house. I will share with you everything you need to know to take down PJC, well collect $500-$1000 if they've violated your rights, including the website where I found my free attorney.

It sounds to me that km is angry because of her job, upbring, or something.  We all know that she works for this company, is screwing the boss, or got screwed by her father as a child and is still holding on to vivid memories of how much she enjoyed it.  Its funny to me that she has mentioned several times over that people who are on here must owe the company money or they wouldnt be here, but when asked that same question herself, jumps to another subject.  She has also called people fat, loser, as*holes, etc, but obviousally she doesnt have a mirror in her house.  She has laughed at someone in nearly all her posts, yet doesnt realize that every time she writes in, the laugh is on her.  And lets discuss that education she so gladly brags about, yet cant seem to get one entry in without misspelling something....whatever km...go back to screwing your daddy!!!

Good going, George!   Way to show these scumbuckets that you're not afraid of their threats.  I'm glad that there are people out there with the guts to stand up to debt "collectors" like PJC and Assoc.  Now, all we need is for everyone who is being unlawfully harassed by groups like PJC and Assoc. to stand up to them and fight back.

Talk about dead beat! The vice President of wilson consolidation services owes 3600.00 plus 900.00 in interest for child support. and the owner of the company refuses to deduct his wages from his paycheck. The vice President has 2 beautiful girls who are getting tired of his crap of letting them down. He wouldnt even pay for a pair of shoes for her beautiful dress. For her 8th grade graduation. its too bad, but he will probabley get put away. And the President of WCS will have to bail him out!!!!!!!

wow.. some good info i got from here..  my lawyer is happy that i found a name from these collectors, jackie vargas and brad fuller.. i was able to google these names and phone numbers they called from and got where they actually work at.. i mean actually work at !!.. so they should be receiving something from a lovely constable. i'm sure they will loved that. they harassed me long enough, its time to get money from them now..

These people called a relative of mine saying they were searching for me, but got the wrong number. My relative did not give me up, but forwarded this toll free number. I know my credit report, I don't know this company. Sounds sloppy and suspicious to me that they called a number that was not in my name. Whatever you do get something in writing and don't supply them with any additional info on yourself!

Another FYI, these people have been sued for FDCA violations (and lost on a default judgement).

well kn you sound like a person who has never had money problems hope you never loose your job or your husband never looses his job and you can't pay a credit card bill so you can feed your kids instead. You should not judge untill you have walked a mile in someone elses shoes. Now these people are insane they go way beond what is legal and right to collect a debt. The sol in my state is 3 years the debt they are trying to collect from me is 4 years past that. And I am sure they don't care they try to bully people with sacre methods and there are alot of people out there that don't know about their rights. Like the SOL. so take heart and use the net to find the answers or talk to someone you know you can trust if you don't have internet maybe they do. They are calling my x daughter in law and won't stop. She has told them that its not my number but they just keep hounding her anway. And she has not been with my son in 4 years.

The President of the Company (Brandon Wiloson)pays his employees under the table. He wont garnish their wages to pay childsupport. I wouldnt trust this company. Besides what they are doing is illegal. They buy very very old debt which is past 7 years. people dont have to pay it back. its not even on their credit report. So, I would just get a lawyer and sue their ass. The vice President of the Company owes 4000.00 in childsupport. and refuses to pay 160.00 a week. go figure! laughing. I dont get it. I dont understand why they are in collections when they OWE on their own bills.

They called my dad and brother trying to fnd me, scaring them with the questions they were asking.  Both called me at work wanting to know if I was alright.  I discontinued my land line a month ago,  but I had never previously received any correspondence from them.

I am sorry for what you are going through.  I am walking in your shoes.  But I have faith that my God is bigger than all of this.  I pay my bills late most of the time, but I work very hard as a nurse and do the best I can.  I try to be the best person I can be to my son, husband, family and friends.  Sometime I don't make the best decisions, but oh well.  I am rooting for you and empathize with what you are going through.
