    These people are CROOKS!!!

I was told I had borrowed $400.00 and didn't pay it back - So, I ask the representative to email me validation and I was told that they didn't have anything to share with me – however, they did send me a document to sign to start a payment plan!?!

This DJR group has been connected with the Hydra Fund scam where Hydra Fund or its associates or employees would harvest data from on-line loan applications and then deposit funds into a person's bank account (without their consent) and then charge them fees to remove  or "service" the deposit.  History of DJR on 800notes shows that   SSM LLC/Hydra Fund/ACS are connected.

    See:  http://www.consumerfinance.gov/newsroom/cfpb- ... cash-grab-scam/

This "Bayside Capital" claims to "service" accounts for DJR.  Which to me means that they are one in the same.

    According to BBB:

Total scam.  Ignore them and block their number.

This Hydra Fund also seems to be connected to  Delaware or something called Delaware Asset Management LLC.   Also United Collections.
Several entries in 800notes, indicate that persons calling on behalf of "Midwest" state that they are handling accounts for something called DJR.

DJR is one of the DBAs of SSM Group LLC.

    Government Actions

    FTC vs. Mosely
    Date of Action: 9/18/2014
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

On Sept 18, 2014, the Consumer Financial Protection Bureau filed suit against Richard F. Mosely Jr. and Sr., Hydra Fund, as well as many of their companies and DBAs. Charges filed allege the business violated the Consumer Financial Protection Act, the Truth in Lending Act and the Electronic Funds Transfer Act. The lawsuit alleges that companies owned or operated by Richard F. Moseley made unauthorized deposits into consumer bank accounts and then withdrew bi-weekly recurring finance charges of up to $90 without any of the payments going toward reducing the loan's principal. The company issued false disclosures or none at all, provided bogus documentation and performed illegitimate debt collection.

They have nothing.  No legitimate process server calls you in advance and tells you he or she is coming by.   This most likely a debt collection scam of some sort or another.

If they allege a debt against you demand a debt validation letter be sent to you by US mail. E-mail no good.  They won't do this so simply block their calls and ignore them.

Received a voicemail last week stating charges would be filed in my county for financial fraud. When I called back the representative stated I was being sued for intent to commit financial fraud, that I owed $993 but that she could help me settle out of court, I (mistakenly) stated that I wanted to pay it back thinking if I had a delinquent account somewhere with a doctors office or something I needed to get it paid off.  When she told me it was a loan from the DJR group I told her I'd never had such a loan, I've never taken out any loans other than student loans and a recent car loan and I've had credit cards. When she started asking for my information, I got uncomfortable, I checked my credit report and nothing shows up as current or delinquent with this organization, just as I thought.
I disconnected the call while on hold so the representative could speak with the arbitration group.
She called me back again today stating I had agreed to pay it back, to which I responded yes if I owe the money I'll pay it back but I've never taken out this loan the organization is claiming I did. She asked if I had paperwork to prove that (which I don't, that doesn't make any sense) and I told her that, asking her if she has copies of the original loan agreement to prove I do to which she stated no, but that the company had sent them to me in the past. I told her that I have never received them and that I gave her my current address during our last conversation and that she or the "lending company" could forward them to me. She said they would proceed with going to court, to which I thanked her and she hung up.
This is 100% a scam, right?
Also, the first time she called was from a Georgia telephone number, and today it was from a 502 Louisville number.

Yes, getting phone calls, always calling from a different place. Threating arrests, and large amounts of money. Called police and said, to just hang up. If s person had a loan and didn't pay, the most they can do is civil, and possibility get a garnishment. I'm getting tired of these calls. BBB said tell them to send you a hard copy of the paperwork. Not email, because anybody can send an email. If they send a hard copy and they are not legal, they can be tracked, and sued.

Ok People pay attention. This is a scam. This is how it works. You will get one person to call saying they are a process server that wants to meet to serve you papers. They will even call your job but they will never show. They will sound inportant and make it all sound legit. They are not. They are there to scam you. Even if you pay DJR off they will put you on a SUCKA list. This is how you get rid of them.

    1. Ask them their business tax ID every legit business has one.

    2. Tell them it was an illegal loan most likely it is.

    3. Tell them you are going to file a complaint with your state attorney under the Fair Credit Reporting Act.

    4. you will never go to jail or be arrested this is a 100% CIVIL matter this is not criminal. It is a scare tactic used to scare you into to paying. Do not fall for it.
That tends to make them go away at least for a little bit. Now go and file with the number they called you from.  A "processing server" today wanted to serve me papers I told her about number 3 and before I could finish State Attorney under the Fair Credit Reporting Act she stuttered her words and hung up. They hate this as it shows you are smart and they cant get a dime from you. Be smart and be safe.
