    Best thing to do with a collection agent is to not empower them with any info! Most of the time their info is incorrect and the amount owed is wrong. If you do owe get a lawyer that is experienced in defaulted loans and go from there. If they ask for your lawyer's name DO NOT GIVE IT, inform your lawyer of them and there collection effort and be done with it. Oh and by the way the discounted offer they offer is not real and you can do better obtaining a discount if you go through legal channels. Most of time the amount owed has been signed off and the originator of the loan would be more than happy to accept a half or in some cases less than 30% of the original loan.

    Wait...you went to school, signed a promisory note to repay your loans, and you want a collector to come to your house to discuss how you plan on taking care of your defaulted loans? WTF?  Much easier for that collector to garnish your wages and call it a day.  Oh...you don't have a job?  Or you'll quit your job?...good thinking.  Meanwhile, your defaulted student loan balance sky rockets.  Eventually you grow up, perhaps get married, and get a good job.  Guess what...still getting garnished.  Oh you wanted to purchase a house or car or boat...good luck with a FEDERAL DEFAULT on your credit report.  The government will get their money....and its MUCH better for you to give it to them voluntarily, then have them take it ;)

    Got a message left on my voicemail from the people looking for my husband's ex wife. Have no idea how the tied my cell phone number with her...the phone is in my MAIDEN name and they have been divorced for awhile now. We get alot of calls from collectors trying to clean up her mess.

    Okay, here goes!  First keep in mind that the DOE and the Student Loan people do NOT enlist collection agencies. It is true that they have all the information about you including your current place of residence.domicile and workplace info.   They just garnish your Federal and State Tax returns until the debt is satisfied in full.  Even when you don't owe the debt!  Years ago I went to school and in less than one full semester was hospitalized and had to drop out.  I signed all kinds of things that proved this and the debt was reversed.  The sad part is, that the school themselves continued to accept the funds and processed them as if I were still enrolled.  Anyway, after 10 years of not receiving my very small tax refunds, I called the IRS to find out why.  That is when I learned about the student loan Tax refund garnishment.  No call, no letters just non-receipt of small (less then $50 refunds) tax refunds.  So I contacted the DOE Loan division, and after submitting a lot of paperwork with a written letter, I received a refund of all previously held tax refunds and all is good!

    I borrowed money form Boatmen's bank 20 years ago to attend a technical college in jackson Mississippi. About a month into the module, I had an ear infection in both ears. Went through the process or protocol to take days off for treatment and to recover. My advisor signed, another person signed and I signed a paper a formality that I would be on medical. 3 days went by, a friend informed me that the school filed for chapter 11. I went straight to the school and found that I had been dropped from enrollment. About the money, I was informed that they would write me a check for the unused amount and told me to pick up a check next friday. Friday comes no check. They told me next friday. I show up no check. They said, "Next friday!" I show up next friday and they tell me that they have instead sent the money back to Boatmen's bank. I thought it was okay. 3 years later I get a letter that said I owed over 2000 dollars. They have been taking my tax returns for a few years now. Just got a call today.

    If it is a all knowing company, why do I keep getting calls for someone that no longer lives at my house?  Stepson moved on but I still get calls for him weekly.  I tell them he is not at this number only to have them repeat a call over and over.......  Maybe this is why the Government should not be in the Education or Finance fields.

    Do NOT listen to anyone on here claiming to that this company or any other debt collector is going to offer you anything remotely reasonable...

    These bottom feeding clowns literally could not care less about you, the money you owe, the feasibility of their so called plans, etc.  All they care about is locking you into some b/s "program" that ensures them the highest commission.  Basically, for them to get the most money from an originator they typically need payments that are at least 1% of the total balance of the loan.  This IS NOT a legally required amount.

    The law is clear --- payments, in the case of default or otherwise, are to be REASONABLE and AFFORDABLE.  These two words do them what sunlight does to any other creature of the night --- it horrifies them and sends them scurrying into the nearest filth receptacle while spitting out one or more of the following lies ---

    1.)  The DoE has a mnimum amount it will accept.  LIE --- there is no minimum payment.

    2.)  Reasonable and Affordable is based on how much you owe.  LIE, reasonable is partially based on the amount you owe, but affordability is based entirely on circumstance such as your income, obligations, etc...

    3.) Government program waives the fees etc...LIE the fees are simply tacked on by the Agency, DoE has no role in their supposed forgiveness.

    4.)  There is a "time limit" on these programs. LIE --- there is no time limit on when you can use your guaranteed statutory rights to rehabilitate a defaulted loan.

    More Lies ---

    1.)  The "plan" requires 10 consecutive months of full payment.  LIE --- the statute requires 9 months of payments in a 10 month period.  They will never tell you this.

    2.)  Consolidating or Reconsolidating is a bad idea because it will have to roll in their fees.  LIE --- this is the biggest load of crap out there.  Their worst fear is that you consolidate your way out of default.  Then they don't get their commissions...boohoo

    Bottom Line ---

    These people are bottom feeding liars that will play on your fear, whatever fear they can bring about, to get you to commit to unconscionable, ridiculous "plans".  They will relentlessly harass you and your family without regard to any sense of decency.  They will call you at work, even if you tell them not to, which is both unethical and illegal.  They will call at times of the day you have specified as unavailable, (also illegal and unethical).  They will try their damndest to get you to commit to a plan that is at least 1% or more of your entire balance (including their tacked on fees) per month, which in many cases, maybe more than one's monthly income after taxes.

    Do NOT ever agree to this.  Demand all of their "offers" be in writing.  Stress that you know the relevant laws and you are not afraid of them.  No Court in the world would find something that is any more than 10-25% of your DISPOSABLE INCOME to be an Affordable plan.  Remember that.  If they throw you some deadline, then say they'll try other means, its just a scare tactic.  They will come back to you because the bottom line is, they don't get paid unless you pay.  Even if they go for garnishment, the garnishment will be between 15 - 25% of your disposable income...well below what their supposed plan demands.

    Never accept any offer in anything other than writing.
    Never accept an offer that is more than 25% of your disposable income (income - all legitimate obligation living expenses/utilities/medical/car/house/child support/etc) as this is more than a garnishment will cost you

    Please have them stop calling.  If they want to go to court, let them.  NC courts allows counterclaims up to 3X the amount they are fraudantly trying to collect.

    The ignorance of some of these posts is mind boggling. Do some damn research and actually make an educated post. Out of every single post i read on here, NOT ONE had correct information. Doing about 5 minutes of research, and actually making a phone call would likely show you that. On second thought paying your bill instead of trying to find 1000 ways to get out of it would probably be better.

    Legitimate debt collector.  CONSERVE (http://www.conserve-arm.com/).  I owed student loans and was in default.  They got me on a rehabilitation program and now I'm current with the Department of Education and they got the default off my credit report.  If they call you, you or someone you know owes money to the government.  Ignoring it will only make things worse.
