- MacI just got a phone call from a recording asking for someone I have never heard of and giving a reference number. I only just got the phone number (1 month ago) and I am on the do not call registry. What should I do, ignore them? I don't want these calls all the time.

- DeederMy son was caught shoplifting and we went to court and faced the judge- paid the fine. I recieved a letter and serveral, maybe 50+ calls since the incident 3 months ago. I have never answered and they do not know my name. I am grateful for the preceding information and am relieved. I am a single mother and on a limited income, there was no way I could come up with the nearly 300.00 they said I owed.
The bigger issue is where are these scammers getting this information, because at least in my case the shoplifting had occured. I thought minor cases were not a matter of public record. Is there anything that can be done? - triI actually just got a call form them about 30 miutes ago.The inceident happened back in september where i got caught stealing in jcpenny.they arrested me,let me go and i had to go to court and pay fines. i did.later i started recieving letters saying i had to pay a civil fine of $250 in the first letter.Since this being my first time i was scared and said ok. i called and set up a payment plan of i thini about 55 a month plus the extras fees which came out to be about 80 a month. I decided to research the law firm and saw a lot of complaints about them. So i said what the hell, im not going to pay.I continued tp receive letters and the amount going up asking me to pay even more money when the value of stuff stolen was less than $100 i believe.nothing was damaged,still had tags,everything. They keep leaving these automated messages on my voicemail and i have them saved in my phone as DONT ANSWER!! LOL sad to say they are continuing to call after i told them i wasnt going to pay and some lady said she would put it in the system.
When i went to court for the charge i pleaded guilty and when i left out the court room i was told when applying for a job not to mark the box where it says have you commited a crime or something of that nature.
However i do want to know what should i do as far as from a legal standpoint.Again i havent paid them and dont plan on it.- Call type: Debt collector

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

My boyfriend was also with me when I got caught and both of us had to sign a contract.When I got the first letter we called an attourney and he told us to ignore it and not pay. We now got a second letter doubling the amount to 525. Im 18 and hes 17, we cannot get this kind of money fast and our parents wont pay. We called another attourney today and he told us that we should pay it. I really dont know what to do. Im really scared that they might sue me or my boyfriend. SOMEONE HELP ME!
- MouseyThey are also Lawyers for Wal-Mart. I get calls from them constantly. I worked for wal-mart and was fired due to a set up. They are trying to get restitution from me that I do not owe to them. I have also recieved mailings from them. They have also called from other numbers that I have since deleted.

- alanfine replies to sverdinccruzThey also represent sears - They are trying to extort money from me for catching my 13 year old shoplifting at sears. the merchandise was retained by the security gurads in perfrectly good resaleable condition with the tags and package still good. So a lawyer and police friend told me not to pay these extortionists. For a law firm to go to local court they have to prove damages to the store in order to collect a civil judgement. If you shoplifted, have no priors and the merchandise was returned in good sellable condition, then you have nothing to fear.

- JessicaMy boyfriend was caught stealing in Macy's. Because I was with him, they thought I am the co-stealer, or whatever you call it. I plea not guilty, wet to court. Judge did not believe me (couldn't blame him. It was a stupid situation, but I learn my lesson to not trust people around you. If it does look suspicious, ask them right there are they stealing, do not believe their stories!!) Anyways, I paid my $500 fine and took the theft-class. Now I am getting calls from this company. I told them to send me a written notice, or I'll not going to pay. So I am waiting for one. After that I am taking it to lawyers. I found it suspicious that woman took forever to agree to send me a notice, she was telling me - you can easily do it right now, or setup payments. I am mad cause I am paying for something I did not do, but I know my story was unrealistic. At least, I know I said the truth...

Still I was so mad and embarrased i donated the $147 worth of groceries I just paid for to their store food bank drive. and walked out. $ months later I have 3 threats - saying I owe them $650 , and it was a damn ball point pen. My plight is that I am a licensed professional and I had a charge a year ago for a misdemeanor that will take me three 1/2 yrs to clear as it is. I am 49 and could lose my entire career from their crap and I've spent my whole life helping people. I've recovered from Alcoholism and have over 21 years of sobriety and went to night school for 4 years working full time to make something of myself. I feel so vulnerable, scared and cannot talk to anyone. These Palmer people are totally terrorizing me and I cannot say a word. I don't have the money and do not know what to do. Why is no one answering all the good questions above. All we have is our own fearful questions. Who is able to answer us folks??
