    I don't get statements from them either. Email or snail mail. It's hard to pay a company you don't get a statement from. I rarely use their card & when I do I pay it off by phone. The problem is my due date always seems to change. My payment used to be due on the 17th, then it was the 10th, then the 21st. So now I just call 20 days after I made a purchase (since MOST companies have a 28 day billing cycle) to pay the card off & I'm some how still late?! Apparently Capitol One only has 19 days in their billing cycle. Then it takes 5 days to be presented to my bank no matter what day of the week I call. Then I get these stupid calls telling me to make my payment that I already made. I've had a card with them for close to 20 years, but I think it's time to give them up & stick to my other 2 cards.

    They did not want to give me that either? Instead they gave me
    Human Relations #? WTF

    I'm thinking these ppl are not even Cap One? And why wouldn't they provide you with the information you ask for???!!?!?!?!??!?!

    They not only want payment but confirmation of my bank account info, DOB and SS#. Don't try to convience them of a partial payment, the full amount is to be paid in full.

    These parasites call me no less than 10 times a day, looking for my daughter. I Have asked them to stop calling, as I do not have a "Capital One" account, nor would I ever. In fact, since "Capital One" took over ING, I PLAN TO CLOSE THAT ACCOUNT, and move my funds to PenFed Credit Union.
    I want these calls STOPPED, and I would like to sue these vultures for harassment.

    I actually work at a call center for an utility company. While I totally agree that harassment at this level is ridiculous, I feel that I have to correct you on one item.
    First let me agree with one poster in stating that most collections departments will not call if a payment is on time and the account is not delinquent. Hell, they will usually reward you when you're on time and in good standing for certain lengths of time. This means, however, that you must give your payment enough time to POST to the account when you submit your payment. If it POSTS late, then the payment IS late and they may call.
    Secondly, it does not matter if you receive a bill sent to you from the company either electronically or via hard copy - all that matters to the governmental parties responsible for regulating the way companies do business is that the company generates and attempts to deliver the bill. Therefore: It is the customer's responsibility to know when their bills are due and it is also the customer's responsibility to find out when, and for how much, the bill is due if they have not received one. Just sitting there waiting for a bill is NOT an excuse for not submitting payment. If you have online billing or email billing THAN GO ONLINE AND CHECK IT OUT!

    Ah, but see they "adjust" the due date to reflect some sort of weird [***] they do.  It will be on one day in one month and another day in another month. You have to watch them VERY carefully cause they will [***] you up in a matter of seconds!

    This number is also calling me around 7-10 times a day.  My caller id just says it is a unknown number.  Is it really capital one?  If so why would Capital One be calling me when I don't have a account there?  When I pick up nobody says anything!  Then I decided to stop picking up this number.  So they started calling more and flooding me with voice mails...  were they say NOTHING!  I don't understand why they are calling me and not saying anything...

    I have told them not to call me.  They call anyway.  The best way is to file thousands of complaints with the Gov Do Not Call Registry

    No, that is not "the best way". The federal Do-Not-Call registry exists to help enforce the Telemarketing Sales Rule. Please note the operative term ''marketing''. A debt collector is not a sales person and is therefore not covered. Here are the DNC service terms you were supposed to review at registration time:

    If you want the calls to end you cannot just file complaints and wait for the nothing which will happen. As suggested earlier on this page, send a ''cease communication'' notice via USPS Certified with return card. This is the method promoted by the FTC and many consumer watchdogs, who will explain how you can do some damage if that notice is ignored.

    As an original creditor Cap1 is not covered by the FDCPA unless it presents a false name, and TCPA claims won't get far unless they involve autodialers, mobile phones, and a narrow range of privacy concerns. A Cert Mail notice does signal a serious demand, and it will do so without largely empty lawsuit threats. What you might plan to do in a dispute escalated to the courts is none of their business.

    To examine standing to sue a lender making nuisance calls, see if your state has a collections law which applies to original creditors, or anything which raises the unwanted calls to a criminal offense. Not many states have such options, but don't let that deter the use of Certified Mail, without which you will have no case at all.

    FYI.... telemarketers and debt collectors can legally call you only between 8 a.m. and 9 p.m in your time zone. I've answered the phone and before they have a chance to get on me, I have gotten on them and told them just that!
