I do not answer and they do not leave a message. - unsilent majorityTruth is most do pay but lose a job or get sick and become over whelmed. I know several people who saved and did things the RIGHT way and lost there job and lost everything. It could happen to anyone..
- Resident47 replies to A.C.I had a similar issue when a family member was dying and I had a simultaneous heavy project load. You have a right to limit or ban all phone calls from a third party collector. That's best done by USPS Certified with return card. You can dispute its claim in the same letter, though by now it's far too late to expect validation.
I would add that an excessive call pattern like the one you describe is enough for you to consider filing a FDCPA lawsuit for intentional annoyance and distress. The potential damage to C-S would easily overwhelm their three figure claim.
You luckily have a very modest debt for someone your age. College kids are like fresh meat to predatory lenders like Cap One. Make no mistake, they *want* you to run up a bill and then default, then get sued for thousands more. Maybe now that you've had a taste of how consumer debt is managed by corporate jackals, you'll avoid their pit traps in your adult life.

Meanwhile, much of this thread concerns fraudulent and illegal conduct from a certain collection agency. None of your chest beating about your "professional" stance is distracting us from the need to assert consumer rights. It also does nothing to explain the epidemic of sloppy skip tracing your industry enjoys creating.
- Resident47 replies to Making Me Crazy...Your federal and state rights have not vanished just because you're on a payment plan. You are entitled to fair treatment and can demand a quieter phone. This should be done by Certified Mail with return card.
You present another example of why cutting payment plan deals with scofflaw debt collectors always ends badly. Sooner or later they get impatient and try to wriggle out while blaming you for being supposedly uncooperative. I would seriously consider closing that bank account once you're done. Heck, I would do it next week and see that they don't get another penny until the phone hassling stops. Giving these creeps the keys to your vault was a bad idea. You see, compliant debtors get punished all the time for "doing the right thing".
Don't rely on what you "think" you owe. Do the homework and raise a dispute if your figures don't match theirs. They would love for you to be too confused to notice that they are sneaking away more than agreed. If you catch them lying or ignoring your written demands or melting down your phone lines, sue them for relief.

- Phantom DebtorCarson Smithfield is still calling ... asking whether I want to pay the money now or go on a payment plan.
Folks, this is how to handle it:
I tell 'em there's a third option: I can laugh at them.
I'm not mean to them, I don't call them bad names or yell. I just let them know that I don't share any information about the hows and whys, I just say no. It keeps the calls short because they know they're not going to get anywhere.
They say they'll call back next week. Well, it's been over a year of this and they haven't done a thing. If they do have the documents they need to go to court, they don't have anyone whose testimony will authenticate those documents. And that means no suits.
Oh, I did have one of them tell me a flat out lie: He said that charge-offs stay on your credit report forever, they don't fall off at seven years. That is absolutely not true, except for the "Full Factual" type credit report that can be pulled for mortgages over $150k, jobs paying over $75k and life insurance. And for mortgages, the "Full Factual" is typically only pulled where the normal tri-merge is so messy that reviewing everything in detail is the only way to *help* the consumer get the loan.
What also *can* happen (although it's not a charge-off staying on your report for longer than 7 years) is that junk debt buyers can pull your credit reports even after the statute of limitations and the 7 years are up. The hard pulls lower your credit score, and there are some creditors who just won't give you credit if you have hard pulls from collectors and junk debt buyers on your report (which are taken as signs of collection activity). You can write cease and desist letters to them, but that's no guarantee they'll stop. The pulls stay on your report for 2 years.- Caller: Carson Smithfield

- AquadudeI gave them a blast from my portable boat air horn. That loud noise turned them off after the second call. Haven't heard from them since. I use this air horn every time I pick up the phone and it is an unwanted call. It works and the air canister refills are cheap at Wal-Mart, Kmart, Target, etc. I LUV using it too.
- Phantom DebtorFrom the last call I received, it appears they're getting pushier. Must be desperation. This is the time when they will start violating the FDCPA folks, so get your tape recorders humming for those moments when they stop over one line or another.

- UDeadBeatMofosIf you people weren't dead beat scumbags it wouldn't be an issue. What would u do if someone borrowed money from u & were like eat me, i'm not paying. I'm not a fan of billionaires getting richer but don't be stupid enough to open a line of credit you know you either A) can't afford or B) know you will end up being late on payments. People do this crap to themselves & then get mad when they get calls about it. Look in the mirror & you'll see who caused the problem.

- ShillKill| 8 repliesI find it ironic that you try to pass moral judgements on others, yet you can't even spell correctly or compose a correct sentence. Many folks who frequent this board pay their bills on time.
In fact, I occasionally have clients who are past due. Should I refer to them as "dead beats" and "scum bags"? Should I act all high and might about it like you are?
You are merely some illiterate who works in a boiler room and has diarrhea of the mouth and constipation of the mind. - UDeadBeatMofos replies to ShillKill| 7 repliesI find it ironic that you talk smack about not composing a correct sentence when you are guilty of it yourself. Or am I being too high & might about it?
- yef replies to UDeadBeatMofosPeople should pay their debts back, to the entity that owns the debt. People should NOT pay money to some shady fool who calls them up saying they owe, but refuses to validate.
Give it up, moron. Find another place to troll. - MJG replies to UDeadBeatMofos| 1 replySince you appear to be an English/grammar teacher or intellectual college student majoring that field, please correct the errors in Shillkill's message. I am sure he would appreciate that favor.

Do you work at CardWorks Servicing? If so, you already have quite a record, according to the PACER record posted by the Agruss Law Firm last December:
See: http://www.agrusslawfirm.com/cardworks-servicing/
"According to the Public Access to Court Electronic Records (PACER), CardWorks Servicing has been sued about 52 times in the last 3 years for debt collection harassment. It does not get any better for CardWorks Servicing on the Better Business Bureau. The Better Business Bureau has processed 10 billing/collection issues, and 14 total complaints, regarding CardWorks Servicing in the last three years."
And that's only up until December, 2012. What have you done since then?
