- almost a victim of fraud| 1 replyThis is Carson Smithfiled LLC, they sent me a letter a couple of times regarding an Advanta account.
In June 2010, I sent a payment to Advanta for 10% of the balance with a letter of dispute. The check was clearly marked "Full and Final Payment" in multiple places. in accourdance with article 6 of the uniform commercial code. The check cleared my bank on 6/30/2010
SOOOO- When I received letterd from the SCUMBAGS at Carson Smithfield, I sent them a copy of the letter and check to Advanta - this was a one page photocopy.and I wrote on their payment stub "This account has already been settled- see attached"
Next thing I know- that same check is showing as a pending transaction on my account.
I went to the bank to try to resolve the issue. They put a 24 hour block on the account so that the check would not post, then they put a stop payment on the check.
The photocopy of the check was bounced back to the bank they deposited it at-
The stop payment order states clearly- DUPLICATE original check was submitted and paid on acct 6/30/10- this is fraud.
Still trying to figure out who to complain to about this so they xan be prosecuted.
Filed a complaint with FTC, contacted Attorney General's Office, consumer protection unit- who referred me to the OCC. The OCC only deals with bad banks though.- Caller: Carson Smithfield LLC

- LauraThese people keep calling my parents asking for me under a previous married name. They would not leave a phone number for the longest time. Finally they left a call back number. When they left their name they said it was Carson and Palmer. When I called to speak to them, the woman said they were Carson and Smithfield. She looked me up by my old cell phone number, and my parents phone number and could not find any record of my information. She asked unless you would like me to do a search by your social security number. I said no I prefer not to give that information out over the phone. She said that is fine. I asked her to verify the phone number I called, and she said that was their number, but they were Carson and Smithfield, not Carson and Palmer. I said thank you and hung up.

collect any money. - Why won't you validate this?| 1 replyThis was Cardwork Services and for the past year or so has been operating under the name Carson Smithfield. Three years ago I sent a Certified Return Request letter to Cardwork Services requesting validation with no response. When they started calling and mailing under their new name, same address and number I again sent a certified letter and received a return of service requesting validation again with no response but continuing daily calls multiple times a day.
I have talkd to these people on several occasions and told them I had sent the validation request and am not fimilar with who they are or what they are talking about. They become very rude and demanding at this and tell me they do not have to do anything or reply to anything.
I really seriously would love to find out why they are calling me but cannot get anything out of them other than it was for a merrick bank credit card which I never had and have no knowledge of. I have never even heard of Merrick Bank or don't know where they are from. If this is a legitimate debt they have the wrong person and to be rude and ugly on the phone demanding my banking information makes me think they are probably theives and not at all legitimate. If they had a legitimate debt it would seem they would talk to you or validate it so they stood a chance of collecting what is owed to them.
I know there are federal laws prohibiting this type of activity but it seems rampant and for a maiximum $1000 fine that they would probably appeal and I would never see it is not worth the attorney cost to me or both and they know this so they persist.

Your callers cannot magically determine which numbers should not be called based on anonymous comments. You will not get compliance with your orders until, if possible, you deliver them *directly* to your caller. In the case of a debt collector, a Certified Mail notice is the best route, as suggested by a commentor two weeks prior.
Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. You might want to actually read that federal law. A winning FDCPA plaintiff taxes the loser for all legal fees.

A pretty neat provision called "cost shifting" was written to encourage people like you to enforce the law by lowering your risk. Assuming you're alleged to owe something, decent consumer attorneys will take a case like yours with clear violations on contingency. When you go lawyer shopping, tell 'em you got "continued collection activity" ... twice! It's very naughty to keep calling and writing you before your dispute letter is answered with validation. Hope you kept good records of collection contact.
You correctly quote the 1970s-era maximum statutory award, but also missed that FDCPA is a strict liability statute. This makes it hard to shrug off your civil complaint if it's done right, and you'd have to do a really poor job to even invite appeal. It's half likely, in fact, you'll be offered a settlement before the first hearing. Lawbreaker collectors hate publicly taking black marks more than they hate paying damage awards.

- AnonAdvanta. I had a business card with them and then my husband lost his job and has been out of work for 5 years.... I made an arrangement to make payments to them and have been making them for a couple of years. I have not missed a payment. They are still calling me... I just blocked them. They're cashing my checks so I don't understand the problem. I'm betting they want to "settle" with me for a big dollar amount I don't have. I'm just going to continue to pay them as agreed and ignore their calls.

I live with my parents while attending school and as far as I know they don't owe anything but they've only ever banked with Chevy Chase and Capital One. BUT this number has LITERALLY called my home 13 time today alone. It comes up as "Unavailable" on the ID but the number is the same. It's getting ridiculous and I finally looked the number up. I'm getting unbelievably annoyed by them. They don't leave a message and I REALLY don't want to pick up the call only to be put on hold and deal with some douche trying to fraud me. In fact, while typing this, they've called twice, one right after the other, so now they've called fifteen times. I'm ready to throw my phone against the wall. I can't silence it because a family member's in the hospital and I'm afraid I'll miss the call, but I have finals coming up, so I'm studying AND working on final projects. THEY ARE DRIVING ME INSANE.
