- Some guy replies to almost a victim of fraudAHAHAHA! You can't settle a debt anymore by writing "paid in full" on the memo line of your check. That may have worked 40 years ago but no court would uphold that now when companies have to process 100's of checks a day. [removed:lang]

But I was ready for them and I refused to confirm or deny anything and I basically just blew them off like I've been doing for years. I got this book on Amazon called "Debt Hope: Down and Dirty Survival Strategies" and it basically lays it all out in terms of how to tell whether you're dealing with a dangerous collector or a toothless one, and how to know whether your old debt is inside or outside the statute of limitations time period that gives you a solid defense once it has expired. I'm not sweating a thing.

It simply means that you can no longer be sued for it and the credit bureaus will no longer report on it. However, collectors are still permitted to attempt collections on any debt regardless of its age as long as they do so within the confines of consumer protection laws. Granted, they usually have little success collecting on old debt and anyone that pays will restart the debt clock or have it reported again on their credit file. Fact remains, the age of a debt does not preclude collection attempts.

- down on my luck replies to ?got in a serious medical situation a few years back & I owed big $$ to advanta, and as I was raised to pay my debts, I called the FDIC as I knew they were in receivership, the FDIC told me that C/S was hired to collect and they kept a small fee the rest went back to the FDIC. I called C/S and their first offer was 30%, good enough for me.... the rep at C/S was very professional & courteous . unlike those a&& holes at midland credit who are the biggest lying scum on this earth..

- Making Me Crazy...| 2 repliesMy husband lost his job almost 5 years ago... scraping along like many Americans. I did get behind on this bill. However, I set up a payment plan with them and I pay them bi-weekly. It auto-pays out of my bank account, so it is ALWAYS on time. I have made 17 payments since we started the arrangement. I WANT to pay them what I owe them and I AM paying them. However. they continue to call me at work and at home, regardless of the fact that I am sticking to the arrangements we BOTH agreed to.
Not sure what more I can do about it. I think I only owe them about $140 and I'm done. I'm guessing they are trying to get that small lump sum. I pick up the phone and there is never anyone there. I would be happy to talk to them to find out why they call me several times a day and never have anyone on the other line.- Caller: Advanta Card

P.S. for the folks who have skipped to the end ... there is a post in the middle where someone apparently with Cardworks/Carson Smithfield admits openly that YOU WILL NOT BE SUED.
