    I just received my first call from these animals, and it did not go well. They called me at 9:00pm last night. I asked if they could 'give me a call back another time because I am watching reruns of "The Love Boat" and that my personal time is valuable to me, and that she is violating HIPPA regulations. The woman said "Not an option", and then told me that I owe a bunch of money to Merrick Bank. She said that if I did not pay up within a week, she was going to have someone from the company come over and "inspect my anus", and then started making donkey sounds!!! It frightened me so badly that I actually soiled myself, and had to hang up so I could clean myself up. She called right back and as soon as I picked up the phone, all I heard was donkey sounds again. After that she started singing "Cruel Summer" by Bananorama, and told me that this is what it's going to be like for me if I dont pay up! I am so scared that I started boxing all of my things up and am getting ready to move to another location, because I think they are following me. As soon as I am able to calm myself down, I will be contacting PETA to let them know of this incident.

    They do not identify, hang up.

    Similar situation here.  I have been paying $37.11 (1% of what they claim I owe) for about 10 months now.  Think I am going to stop. They already collected far more than I ever realized in goods and services, interest, etc.  Their jump to 35 or 37% interest was ridiculous, not to mention late penalties, over limit penalties, and so on.  They have already done every thing they can to ruin my credit, so no further worries there.  Screw them!

    "Sue Them!" sounds great, but just how do I do that?  I have had some experience defending myself successfully "in Pro Per." against a spurious lawsuit, but do not know where to start with this.  Could someone with some legal knowledge gige me some advice on where to start?

    One thing puzzles me... when they call my cell phone at 9 a.m., it only rings once and then hangs up.  If I had my phone in my hand expecting the call, I would be hard pressed to answer in time.. What can be the point of these hang-up calls??

    My debt was from Advanta like everyone else.  CARSON SMITHFIELD has called me occasionally. After reading this forum yesterday I decided called them back last night for a little entertainment.  I actually got a human being.  She denied being a junk debt collector.  I really just wanted to irritate them. After tormenting the person that answered the phone for a while, she gave up on me and put a supervisor on the phone.  The supervisor agreed to send me a settlement for around 2K which is far less than what Advanta said I owed (after the 35% interest hike).  I'm probably not going to pay these crooks anything unless I find it will restore my credit.  Honestly, I don't trust anyone associated with Advanta, even loosely.  BTW, I recorded the whole conversation.

    I have been receiving recorded messages from this number and finally called back today.  They were trying to collect on a Merrick Bank VISA that I paid off on 02-10-2012 and had received a zero balance letter on.  When I informed them that the account had been paid off and closed four months ago, he agreed to mark that on his records and report it appropriately to the credit bureaus.  If you are receiving calls, call them back.  They are trying to collect things that are already paid.

    I ' ve recieved over 50 calls from this number. I spoke to the the caller once and told her to stop calling. She started demanding information from me. I told her she has not been given this number and to stop calling it. She again started asking questions and demanding infor.  I told her to stop calling the number at least 10 times.  I still get calls from the number, as many as four or five a day.  The person refused to identify herself or business.  I got the company name off the internet.

    But I answered it once and told then that person that ask for doesn't live here
    But that won't stop calling .... And today twice it came up with my granddaughter s picture

    Advanta debts are being administered by the fdic. You won't be sued, but the records ARE available.

    As always, READ CONTRACTS BEFORE YOU SIGN THEM AND MAKE SURE YOU UNDERSTAND EVERYTHING.  

    Of particular concern should be contractual items like default interest rates, In other words, a higher interest rate can be applied if you miss one or two payments within a 12month time period., for example.

    Also there is a time limit on promotional rates like %3.  Foe example, the contract may say that if the balance is not paid within 6 months or so, the interest is increased to, say %29.

    Much of this can be avoided by jut READING AND UNDERSTAING THE CONTRACT BEFORE YOU USE THE CARDand create the debt.  Some of the cupability lies with the consumer.

    Call rhe company and offer a dollar amount to settle  the account.  

    Be prepared for them to say no to your first offer.  

    I work for a debt collectio co.  I will offer you a settlement for %60 of the balance, but that does not mean I will not negotiate lower.  That's my fist offer.  Work with me, talk to  me, don't come across as being unreasonable, and don't let your emotions get in the way.  I understand financial difficulties happen.

    Wrong.  

    When a cust fills out an application, they sign a contract which contains a clause that advises that all information can be used to contact cust by creditor or thier assignees, in this case a debt collector.  AGAIN, READ CONTRACTS BEFORE YOU SIGN THEM AND CREATE A DEBT.

    I'm getting calls, too. Advanta got themselves into this boat by not doing what every legitimate credit card company has done for years: work with the customer. After my business ceased to exist I was left with just a pittance of the income that was allowing me to keep up with my debt. When I asked for a restructuring of the payment schedule, I was flatly denied. No one who called ever had the appropriate information (that I had supplied in writing) to be able to do the right thing. Now Carson-Smithfield is in the same boat. Who knows how long we'll all be hearing from them?!? I suspect it will just be long enough for them to sell off the debts to some other company.

    These people have been blowing up my sons cell phone non-stop. Today I was lucky enough to catch the call. I ask the woman caller who she was she stated what difference does it make since I told them it was a wrong number. I said it makes all the difference in the world because the cell phone you have been calling is my 8 y.o sons phone and it is for eergency only and the calls have been using up all his minutes. Finally got the name out of her Smith and Larson. I said fine good bye didnt hang up and for 3 minutes she sat on the phone. ..fianlly she tells me okay you can hang up. I pressed her for more info finally gave up rude [***]....."she just said do what you got to do" So yeah I will be filling a complaint and looking for money. 2 can play at that game. I hate these scums and from what I have been reading the are the bottom feeders. Sad thing is that the law does nothing to protect us....Sorry they just got under my skin and pissed me off.

    check  the time out of dedit  in your state, after a time period ,controled by your state ,they can not collect money.
    IN ny i think it is 7 years . If no payment is made  to the account in 7 years the account is
    void.  all states have differant times set for time out.
