Im actually scared to call. Im more than willing to pay my debt and work out a payment plan. We have fallen on hard times and Ive been in the hospital twice in two months. But the reputation from this firm makes them sound mean. Last thing I need it to be threatened or have them yelling at me because im late paying my bill. It will just make me more sick

they called 5 times a day for several days. I finally called back and when I requested to be taken off their call list they hung up on me. Called back and asked to speak with a sup who then told me it would take up to 3 days to be taken off their list...

regardless if this was a "legit" call or not, they were VERY unprofessional.

Watch "Money Masters" and "Money As Debt" videos on youtube. Knowledge is power.  When these people call, demand they provide the documents that show where you EVER contracted with them for any reason. They would have sued you long ago if they could prove anything.  Mail them a registered letter to cease and desist. After that if they continue to contact you, document the event and sue them.

Received a call from them on June 30, 2011. She didn't even ask me my name, just phone number. She said that I owed Bank of America $13,xxx. We paid MBNA whom our origianl credit card was with back in 2006 in full. Bank of America bought out MBNA in 2005. So, I think they are trying to collect on a debt that has been paid off. Is this possible? She also said that I should of received a letter, but I haven't. They call everyday.

Would any of you let me know if you ever received any documentation from the original creditors proving that you still owe this debt that Richard J. Boudreau said that you owed? Also are they just reading this information from a credit report? Is it legal for them to look at your entire credit report? Has anyone have ever been sued by this company?

Called again today, did not answer.  This debt is about a month from going over the statute of limitations.  Has anyone had a lawsuit filed by this firm?  Many debt collectors talk a big game about what they are going to do but never do it because of the additional expenses incurred and the likelyhood that they won't see any money on the debt.

A law firm should know better than to try to collect debts covered by the Statute of Limitations. Reputable? I think not. And by the way, debt collecting lawyers are regarded as scum by other lawyers, including bail bondsmen and personal injury.

    Helpful Mother
I co-signed on several work related vehicles for one of my sons because he did not have any credit at the time and the interest would have been outrageous IF they approved him. I also had the mortgage in my name for the same reason...lower interest for him. I also invested a large amount of money in the property as the down payment. In 2005 that was still a good investment!

Then Obama was elected, the market crashed, property values diminished, etc. etc. My son had a very successful business that serviced wealthy clients...their money was in the market so they quickly became broke, unable to pay their bills including him, then he couldn't replace those clients because no one had money or was spending it. He tried many side businesses to make payments but in the end he couldn't make enough and the farm was foreclosed. I told him it didn't matter, to walk away. Everyone was in the same situation. Then his vehicles were repossessed...so his income earning potential became less and less. He kept trying but in the end he felt he let me and his family down.

He had such guilt from losing everything and ruining my credit, loosing my retirement money....18 months ago he took his life. A huge loss to this family. Devastating! But alas the scum bill collectors don't care who died or why he died or the young children he left behind. All they care about is getting their money and making my life as miserable as they possibly can. The things they tell me to do are unbelievable! The crude, unfeeling things they say are disgusting and shouldn't be repeated. The bottom feeders have made me a different person. I no longer care that my credit is in the toilet or that my name in on a foreclosure and repossessions or that there are liens against me with the County. None of that matters when I am struggling with the death of my son. The phone calls make me smile because there is NOTHING they can do to me that is worse than what I am living through. They are wasting their time and money because I will never give them a dime EVER!   Those of you struggling with these rude calls, don't get upset. Do the best you can and look to the future. :-)
    • Caller: Don't know. I don't answer ever!

So, how reputable are they, when I get calls on my phone, every few weeks. Each time they call, the person on the other end asks for a completely different person, whom I neither know nor am I related to in any way.  And every time I advise them of this, tell them they have the wrong number, and ask them to remove my number from their list.  They say they will remove my number, but a few weeks later I get another call, from the same group, asking for another person, whom I do not know.

    To Whom It May Concern:

This letter is being sent to you in response to a notice received on moth day, 201x. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. We respectfully request that your offices provide our firm with competent evidence that we have any legal obligation to pay you.

You are hereby requested to provide us with ALL of the following:

    * What the money you say our firm owes is for
    * Explain and show us how you calculated what you say is owed
    * Provide copies of all papers that show our firm signed for and agreed to pay what you say we owe for each individual invoice claimed that we owe.
    * Provide a verification or copy of any judgment to substantiate proof
    * Identify the original creditor name, address and contact name
    * Prove the Statute of Limitations has not expired on this account
    * Show proof that you are licensed to collect in the State of New York
    * Provide us with your license numbers and Registered Agent

At this time we will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) and Dunn & Bradstreet this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of our credit and/or DNB reports by your company or the company that you represent we will not hesitate in bringing legal action against you for the following:

    * Violation of the Fair Credit Reporting Act
    * Violation of the Fair Debt Collection Practices Act
    * Defamation of Character

Your offices are required to provide the proper documentation as requested in the following Declaration, we will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.

Also during this validation period, if any action is taken which could be considered detrimental to any of our credit reports, our firm will consult with legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from our credit file and a copy of such deletion request shall be sent to us immediately.

    ***CEASE & DESIST***

We would also like to request, in writing, that no telephone contact be made by your offices or associated firms to our homes, offices, suppliers, contractors, officers/principles personal homes, families, friends, neighbors or any other related and/or unrelated contacts.  If your offices attempt telephone communication with any of the above listed locations and/or parties, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and we will have no choice but to file suit. All future communications with our firm MUST be done in writing and sent to the address noted in this letter by USPS Certified Mail or other method of Certified and/or Tracking# mail to show proof of mailings.

It would be advisable that you assure that your records are in order before we are forced to take legal action. This is an attempt to correct your records, any information obtained shall be used for that purpose.

Now if they respond, they MUST give you original credit account, name, address.   They must show you proof of your signed contract and obligation with the original creditor.   If this is a charge off, then they MUST show you a proof of transfer of ownership of the debt to them, if they can't show you your signed obligation to pay and if its a charge off, and they can't prove they legally own the debt and its transferred to them, then you send a response back:

    NOTICE OF INSUFFICIENT VALIDATION

    Date: Month day, year

    From: John Doe
    To: Law Offices of XYZ

I have sent you a notice requiring you to validate this debt in accordance with 15 USC §
1692g. I have included a copy of the original dispute, which lists in detail the type of
    validation requested.

In response you have only sent a computer generated print-out of the total amount you
claim is due, which may not be accurate. Furthermore, you have failed to provide an
executed credit contract proving liability of this debtor on the amount claimed.

This is unsatisfactory as proof that I owe the debt (please see Fields v. Wilber Law Firm,
Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004.),
and is hereby rejected as a validation of the debt. You have not complied with my right to
have the debt validated according to the standards of the FDCPA, and your response is
hereby rejected as a validation of the debt.

You must now remove the collection listing from my credit report, or I will file a lawsuit
for violation of FDCPA, § 809(b).

Thank you for your assistance as I assert my right to have a proper validation of the
    referenced account according to law.

    Sincerely,
    John Doe

Again send this CERTIFIED MAIL to them.    Once the 30 day period from their receipt of your Validation request has expired, now print everything out, including the tracking of each of your Certified Receipts from usps.com    Wait 2 weeks after the 30 days is over, check your 3 credit reports, if the collection has not been removed - you can file free disputes with all 3 credit reporting agencies, do it over the phone and get their fax #'s and your Dispute #, then fax them all of the correspondence you sent them along with the printout of the certified tracking info and request the debt be removed.   The Credit services will do the same thing - they will demand validation from the collector and when it fails to provide the proper validation, they remove it from your credit.   You have just defanged the collector completely - they can't call you, they can't hurt your credit.   They'll most likely sell your debt in 6-12 months and you'll just repeat the process, and for the cost of the $2.00 each time for the certified letter, it is so worth it because you'll keep shutting down each collection agency and before you know it, the SOL - Statute of Limitations, or for the collection agency the Sh*t Outta Luck period will expire and the debt is done and can't be collected on.

Best of luck keeping these sc*mbags off your backs !

PS - Spread this info around to ever message board, knowledge is power, don't let debt collectors ruin your life, fight back and shut them down !
