Oh  my GOD!. I received a letter in the mail from  Mortgage Relief Advisory and just spoke with a Gary  last evening who works for New Start and referred me to Danielson Law Group who would help save my home. They had me fill out an electronic signature to deduct $3900 from my checking account starting May 2nd over three payments. He made it sound like everything was going to be alright. What a fool I am. I appreciate your website. I am going to call my bank right away. Please email me back. Has this company done anything good or are they just scam artists? Kate

Who is "They" in "They had me fill out an electronic signature" -- New Start or Danielson? If it's New Start, then New Start may have broken the FTC's MARS rule http://www.ftc.gov/opa/2011/02/mars.shtm that FORBIDS companies from charging up front for any kind of mortgage-related help beginning 02/01/2011. If it's Danielson, there is a narrow exemption for attorneys as long as they follow some stringent rules like opening a trust account for your up-front fees and a detailed accounting of monies spent (as they are spent on the fly and not a giant list of items when it's all done). However, a company with an attorney in tow is *NOT* eligible for the exemption because they are acting in the capacity of a company seeking your business and not in the capacity of an attorney seeking your business (other ethics rules may apply to attorneys seeking your business). You should also read the 3 guidance publications (for business, attorneys and homeowners) on the right side of that MARS webpage for more detailed info on what is allowed/disallowed by law.

BTW, unless Danielson is licensed to practise law in your state, hiring Danielson is just a waste of money because it is ILLEGAL for Danielson to provide legal services to you. Danielson is alleged to have an army of "co-counsel" attorneys in many (all?) states and a "co-counsel" attorney of his in your state can provide legal services to you but then why are you hiring Danielson in the first place because he *CANNOT* do any legal work for you? And you have to pay ADDITIONAL money to his "co-counsel" attorney for any legal work done so the $3,900 fee is just a referral fee. You could have gotten a FREE referral by calling your state bar.

If you're looking for mortgage/modification/foreclosure help, first go here http://www.makinghomeaffordable.gov/Pages/default.aspx and read through the site to find out what sort of help may be available to you. Read through the whole site as you need to fully understand all the types of help out there.
For help on your particular mortgage situation, find and talk to a HUD-approved housing counselor in your local area here  http://www.hud.gov/offices/hsg/sfh/hcc/fc/ that states "Foreclosure prevention counseling services are provided free of charge by nonprofit housing counseling agencies working in partnership with the Federal Government. These agencies are funded, in part, by HUD and NeighborWorks® America. There is no need to pay a private company for these services." I haven't tried it so I can't tell you what it's like.
    Beware of scams http://www.loanscamalert.org/

Google is your best friend on the net. If you're interested in working with XYZ Company, try googling "xyz company scam" and see what comes up. Check out companies with the BBB here http://www.bbb.org/us/Find-Business-Reviews/ -- just the company name and a state will work. Always research a company thoroughly BEFORE spending money. Scammers are more than happy to part you from your money.

Best of luck, Kate, I hope you get your money back  :)

Having the misfortune of spending time in this "industry".
Some people need help to get their paperwork in to the Bank...some people qualify for a Mod, some don't.
The way it works:  Is the guy who sets up the "Call Center" cuts a deal with the "Law Firm".
It is the Call Center that sends out the mailers, NOT the Law Firm.
The Call Center hires a bunch of us to answer the phones, and we "Qualify" you to enter the "Program".
The call center is run like any sales organization, with sales bonuses and the like.
We generally get hired from Craiglist ads found under "Sales". Go ahead and look, you will see the ads.
You pay the Law Firm, the Law Firm cuts back to the Call Center...and there you are.
The call center doesn't qualify you.... "Everyone is Qualified"
The Law Firm...having no Bankers on their staff, doesn't know how to get you a mod...they just submit paperwork, and if it works, it works. If it doesn't...well, you're screwed.
The law firm's paperwork says no guarantees all over it...we at the call center tell you "you're a good candidate", but we also are not Bankers, thus, we have NO IDEA....just give us your money please.
Then...when enough people get angry about not being successful, the Call Center changes the name, the number, the website, and starts all over again.
The law firm is untouchable, as they never guaranteed you anything, so they aren't really doing anything wrong, it's just that they aren't really doing anything at all.

Re. "law firm ... never guaranteed you anything ... aren't really doing anything wrong," the law firm is doing several things wrong IMO.

    1. ""Call Center" cuts a deal with the "Law Firm"" means the law firm agrees to be represented by the call center and will be held responsible by customers for what they're told by the call center. If the law firm does not stand behind call center statements/offers, then the law firm should cancel the deal with the call center but it can't go on blaming the call center for making false statements/offers as a crutch. If the law firm continues on with the deal, it is colluding with the call center to mislead/defraud consumers with false expectations of modification success.

    2. "The Law Firm...having no Bankers on their staff, doesn't know how to get you a mod" means the law firm has *NO* right to offer services in which it is INCOMPETANT. "having no Bankers on their staff" is just another crutch because they can go out and *CONSULT OR HIRE* bankers if that is what's needed to do the job. Not that I believe having bankers on their staff really matters because mortgages are just legal docs and attorneys are trained to read legal docs anyway.

    3. "law firm's paperwork says no guarantees all over it...we at the call center tell you "you're a good candidate"", means the call center and/or the law firm is/are running a SCAM of verbally offering assurances that they *KNOW* will be obviated in the fine print. This means there was no meeting of minds during the sale since customers are relying on FAKE assurances when agreeing to buy the service. Fine print CANNOT be used as a shield when it's so different from what customers have been told. Suppose you tell customers you are selling bricks of gold. In reality, they are really bricks of lead painted with gold paint. The fine print says "Customer agrees he is buying a brick of lead painted with gold paint for entertainment purposes only." Do you think this fine print is going to protect you from prosecution?

I recently fell for the danielson law group advertisement and agreed to pay them the 3 payments of 1300 to modify my mortgage.  I also however call bank of america every week to confirm that something is being done by these attorney's or whoever they claim to be. The representative i spoke with at bank of america said they had received all the required documents from my attorney's and it is under review. I am not taking sides here, i too am skeptical about this whole danielson law group after reading all of these comments. So far someone from danielson has called me every week and stated that no documents are needed and that it is in review by bank of america.  Like i said i have called bank america and confirmed this also. I'm not taking sides here, i have my bank on standby to reverse the 1300 payment that i've made so far just incase this turns out to be a scam.

Will give an update as it progresses.

This is a fee-for-service scam and you say danielson has sent paperwork to your bank, i.e., has demonstrated to the bank it's done work for you, so what justification would your bank have to reverse your payment since the money is for the work it's doing for you? As long as danielson does SOME work for you like mailing your docs to the bank, then danielson is entitled to his fee regardless of how shoddy the work turns out to be in the end and your bank can't help you stiff danielson for services rendered. The only defense against fee-for-service scams is not to participate. You sure sound like a shill trying to suggest banks will protect victims by reversing payments.

Sorry for your loss. If your bank does not give you satisfaction (and it may not given the nature of this scam), please file an online complaint with the Utah Division of Consumer Protection http://www.consumerprotection.utah.gov/ and also with the BBB. You need to file with the BBB because many consumers check out businesses with the BBB and we need to knock down this scammer's BBB rating to F=FAIL so consumers will know *NOT* to deal with this scammer.

I don't think this person knows what they are talking about. I have just received my new terms with my lender and saved $627 a month!!! I am elated!! Too bad it didn't work out for you, maybe your just one of those people that feel when things don't go your way then it must be a scam. Poor thing! It sad that people like you try to convince the rest of the world to be as negative as you!

I don't think Melissa Victors knows what she is talking about. People should contact a local attorney for a mortgage mod, just *NOT* this particular attorney who allegedly charges $3,900 for a useless referral to a "co-counsel" attorney in your state. Why pay $3,900 for a referral (an introduction) when you can get a free referral to a local attorney from your state bar? What could you have done with that $3,900? Fixed that roof leak? Landscaped the yard? Gone on vacation? None of the above, you *THREW IT AWAY* on a *USELESS* referral fee instead. Brilliant!

And how can you afford to throw away $3,900 on a useless referral "when you have not made a house pymnt in the first place , and you are loosing your home to bad money decisions you have made along the way?"

Please believe what you read here. One post is hard to believe but the same exact thing happened to me. Do Not Trust Them. You want to save your home, contact your lender as I did after the D.L.G did nothing, no weekly calls just like these people said. When I did contact my lender, they said they never heard anything from D.L.G. By working with your lender, you can obtain your own modification as I did.
D.L.G. says it will take 5-6 months and charge all this money. Funny thing is I got it done myself in less than 2 weeks. I want them shut down so listen people.

12 complaints and I would be skeptical about any company that wants your credit card info or checking account info even before they confirm that they are taking the case. Ive seen too many bad reviews to take that chance.

I told them that I needed to discuss with my wife. Googled them and see bad reviews over and over. I emailed them back to ask if they were licensed to do law in my state and im still waiting for a response................. crickets chirping. Saw where they have been associated with a law firm called CC Brown Law Group that had a judgement against them by the State of Utah.
