A contact is defined as leaving a message or talking to a person. This is why they don't leave messages in the morning. If they did, they wouldn't be allowed to call back until the next day. If you simply answer the phone and tell them when you intend to pay, they will stop calling for the day. If you keep ignoring them, they will keep calling.

The National Do Not Call list does not apply to bill collectors. It applies only to solicitation calls. You cannot do a blanket "opt out" for collection calls. You can request, in writing, that the collector only correspond with you in writing. But, the company can require that you submit this request in writing and does not have to comply with verbal requests for no calls. After all, you did borrow money for the car you purchased. They have the right to call you to ask for payment until you make a formal request to not be contacted by phone. This does not fall under the umbrella of "harassment". If you want to get very technical, in legal terms, "harassment" can only be considered a criminal issue and cannot be the grounds for a civil lawsuit. I'm guessing you learned that when you attempted to file your lawsuit against them.
Additionally, the Fair Debt Collection Practices law that I think you're attempting to cite only applies to 3rd party debt collectors. Since the company calling you is essentially "the bank", they are 1st party and therefore do not have to follow this law. Lucky for most debtors, they do follow the law voluntarily because it is good business practice. So, legally, they can call you every 10 minutes if they want to. The only way to make it stop is to pay your bills on time or to submit a written request that they cease telephone communication.
Finally, the Attorney General's office has no interest in this company of their business practices. It is actaully the Federal Trade Commission (FTC) that governs this type of activity. If you want to file a complaint with anyone, I'd suggest them. But, be aware that they don't respond individually to complaints. They simply track trends and action only the largest offenders.

Collectors all use predictive dialers. I used to work for multiple collection agencies (3rd party) and banks (1st party). Both use predictive dialers. They are programmed to pass the call to a collection agent when the call is answered at the other end. This is why you ALWAYS have to say hello twice. The first time you're saying "hello" to the computer, the second time the agent hears you.
Additionally, 1st party collection departments don't have to be registered and licensed. These calls are coming from the holder of the note. They don't have to have any special licensing to call and request that payments are made on time for loans they granted. That only applies to 3rd party collection agencies who are paid by the holder of the note for collection services.

- Tired of it...My loan was bought out by this company and I recently lost my jod which had led to a couple of late payments but I have found out that even if you make arrangements they still keep calling you. Thay have called me from a 480, 888, 214 and 619 numbers. I found it very irritating that they call every day first thing in the morning and up to 10pm. I made a mistake of calling them from my new job number and now they even call that number. Luckily I found this job and hopefully I dont fall behind on my payment because I just hate dealing with them.

I just enter annoying callers like this into my contact list and associate a silent ringtone with them. If anything really important comes up, they'll send me a letter. - bricksalamander - santander - drive - whatever. it is those ding-dong car people.

If they call after they have received your letter (don't forget to get the return receipt requested form, which states when they received it and who signed for it and include your account number!!), you then have legal recourse against them. This falls under federal regulations.You must put it in writing.
I also have an account that they purchased. I do not answer them. Also, if you go online you can find out what the statues of limitations for each type of loans for your state has. For example, in Maryland, if you owe a debt and for what ever reasons (like hardship,layoff,divorce,etc.), and you have NO contact with them for 3 years, you no longer owe the debt (this is for credit cards). Also, do not defer payments with this company. My ex did and ended up owing over $6,000.00 in interest and penalties. He causes me to be 2 weeks late each month, due to paying my alimony late, but I pay the late fee and and other fees. They have my number (which is a wrong number), and I have no idea who any of the people are they are calling about. When you call them to tell them this, they want your account number (which I don't have an account), or your social security number (yeah, right, like I would give that out *morons*) before they will transfer your call. After using up several of my cell minutes waiting to be transferred to have my number removed, they disconnected the call (by the way, I was polite). THIS IS A SCAM. There are too many people here who say they have been hung up on or their number never being removed. - coconut| 1 replyI have an account with Santander. I have always had good experience when I have spoken with one of their associates. When I had fraud on my bank account. I called them and they waived the late fee due to the situation. I have also had to make a payment arrangement and they gave me a call, on the following day to thank me for the arrangement. If you treat that person on the other end with respect, it will be returned.
And if you do have a loan with them, remember, they are a company that gave you the loan to purchase a vehicle, when your credit score is not so great.- Caller: Santander
- lolai am so sick of this number calling we have never been late on our payment. our truck has already been with four (4) different financial comapnies, it is not our fault they have bought out company after comany, our payment was missed because of the proccess of changing companies....we have not missed a payment we feel one month behind because the company was being bought out...we were un aware of the situation. the payment was automatically drafted out of our account. then all the sudden it wasnt..that was because the finacial companies keep buying eachother out!!!!!!!!!!!!! We pay on time everymonth. i understand calling maybe once a week I kid you not theis number calls 5 times a day to all my numbers they have!!! I didnt have a situation, the payment didnt go through because they keep buying eachother out.....THIS IS CRAP AND THEIR FAULT!!!!!!!
