You seem to be very confused. If they file it and it goes into "default" as you put it, that means that you don't show up and they win by default and get a default judgement. At that point it would be very hard for you to then fight them in court after the judgement was issued because the question would be asked, "Why did you not show up in the first place if you wanted to fight them?"

Called my mother about a civil case that was filed against her and that she would need to be available to accept paper work on a certain day. Total B.S!!!!

I also received calls from this "office" as did my parents. I decided to call back to see what it was about. These people said I had a breach of contract with Bank Of America for not paying a credit card in the amount of 4,000+ from 2002. First of all, I have never had a card from BoA second of all, that was 17 years ago. I told the person on the phone that that was BS *edited for language* he then lost it and proceeded to scream at me. The screaming escalated when I told him I was going to call the FTC and that trying to collect any kind of interest  accrued from the "account" was illegal. He then told me to "blow it out my ass" to which I told him that he wasn't very professional and that he and his company needed to cease and desist. Hopefully they wont call back. Then again, it was fun.getting the best of them.
