Help with Weltman,Weinberg and Reis
- bob| 39 repliesHi,
I recently returned a summons and was ordered a court date for October 15. The debt is for $4800 and is through Weltman Weinberg and Reis (Discover). I called them to propose a $100 a month settlement and asked them to mail me the forms agreeing to this premise. I received the papers today but the wording includes the words "Order of Consent Judgement" along with the agreed notion of $100 a month until paid in full. Will this wording now make it legal for it to show up as a judgement on my credit report? Is there anything I can do at this point to minimize more credit damage?
Will bankruptcy dismiss a judgement if I end up in that situation?
Also, how should I send payments to Weltman? Personal check I know can be traced, but I dont like them having my account info? Are cashiers checks traceable?
Thanks very much for any help, - LAMET replies to bob| 7 repliesWhat information did they provide that this was a legitimate debt?
Debt collectors that buy up old worthless debts will sue even if they are NOT LEGITIMATE debts
(see below for information on these collectors)
You need to consult with an attorney at this point
These links are to attorneys for those being scammed www.naca.net or http://www.consumerjustice.com/consumer/searchattorneys.aspx
These are attorney's that KNOW debt collection laws and many will work on contingency or at the very least a free or low cost consultation to assist you. Your local legal aid office can assist as well
Most importantly - MAKE SURE YOU SHOW UP for court. No- shows mean they automatically WIN even if they do not have a legitimate case.

Web Address: www.weltman.com - CJ replies to LAMET| 1 replyLamet, the original poster did not suggest that this was an illegitimate debt or a scam attempt. They were asking about how to pay on an assumedly legit debt while minimizing damage to their credit rating.
- LAMET replies to CJIt is still a valid question to ask as a lot people do not understand that at a certain point in the debt is no longer valid for any number of reasons. Statute of Limitations and Chain of Title (proof they have the LEGAL RIGHT to collect) are just 2 reasons they debt may no longer be valid.
I did refer him to attorney's that specialize in debt collection laws.. - lone stranger replies to bobBob,
I want to be very clear here that this is just a "best guess" on a document I have never seen. I assume money is tight for you at the moment, but it still might be worth buying half an hour from a lawyer. It should not be too expensive, call around. That said, i suspect they want a consent decree that would place you under a court order to compliy with your agreement. They may intend to garnish you in tha amount.
My usual advice is to get together as much cash as you can and offer them a one time payment as settlement in full. They will settle for less than you owe.
As for your credit, you have already crossed that bridge in my opinion. It is damaged, and there is no dodging that bullet. However, that is not the end of the world' in spite of what the credit pimps would like you to believe. Let me give you some advice that will totally change your life for the better, and put you back in control of what is happening. Go to www.daveramsey.com . Listen to his radio show. Buy his book. I have no relationship to Mr. Ramsey, but he does a great job of explaining things I had to figure out for myself and did the hard way. Try it. - Anonym replies to bobYou can redline a contract marking out things you do not agree to have them re-write it and send it back because those are not the terms you agreed to on the phone. Bank checks are traceable.
- Kriss replies to bob| 1 replyHi Bob! I am in the same situation with the same people. Bankruptcy will dismiss a judgment and it is the best way to go cuz u end up paying taxes on whatever portion of your debt you don't pay. For example; out of that $4800 u mite agree to pay half but then u have to pay taxes on $2400 cuz it is considered a form of income. Believe me, when ur done paying what u agreed to pay, the company will send u a 1099. No matter how u slice it, it all goes on ur credit report so I decided to file bankruptcy.
- Lone stranger| 3 repliesBob,
Please weigh your actions carefully before taking them. You are getting some potentially disastrous advice. Again, i suggest a brief consultation with an attorney. Preferably NOT one who advertises on television. Some very good attorneys will talk to you about this for a very modest fee, or perhaps even pro bono (free). - toby replies to bobYou are asking a number of very specific legal questions but, understandably, you have not really supplied enough detail to make a competent response. I STRONGLY suggest you talk to a good attorney about this, especially since the court is going to be involved one way or another. A good lawyer will have the right answers and knows the right questions to ask. Initial consultations aren't that expensive, sometimes free.
- Big jim| 2 repliesThese Mo!her Fu@kers froze my bank account and got a couple thousand from me and they do not even have a judgement against me. These people are crooks!
- BB@Tif you do not pay BB@T, this is where your account will go to if u own them over $6,000.00.

Our History
Over Eighty Years Of Protecting Creditors' Rights
Weltman, Weinberg and Reis Co., LPA was founded in 1930 as Gardner and Spilka, a practice that focused on assisting local banks and retailers recover debt. In the mid 50’s, when Maurice Weltman became a partner with the Firm, the name changed to Gardner, Spilka and Weltman. With the addition of Maurice’s son, Robert, the firm continued to grow as a creditors' rights centered practice.
In 1979, the firm became Weltman, Weinberg and Associates Co., LPA, recognizing the contributions made by Alan Weinberg. Alan was primarily responsible for the legal side of the firm, and Robert “Bob” was responsible for the collections side of the firm, setting up the successful combination of a law firm and integrated collection operation.
In 1994, the firm became Weltman, Weinberg and Reis Co., LPA, to acknowledge the efforts of Allen Reis in developing the Columbus, Ohio office.
Throughout the years, WWR grew with the rapid changes in the banking industry, expanding its office network to include additional locations in Cincinnati, Grove City & Brooklyn Heights OH, Ft. Lauderdale, FL, Pittsburgh & Philadelphia PA, Detroit MI and Chicago IL. The steady growth allows Collections and Credit Risk magazine to recognize WWR as the nation’s largest creditors’ rights law firm, based on revenues and placements.
Today, WWR operates ten offices directly servicing eight states, in what we call our “footprint” region of the country, along with multiple nationwide attorney network support services. - Unknown Opinion| 2 repliesI like the crap they put on this page......but guess what they are want-to-be lawyers that cannot make it in the real world, so they form these collection agencies. Then they buy old debt and try to collect on it. How can there be 10 collectors- collecting on the same debt....someone needs to contact the Attorney Generals Office and have an internal investigation done on this company..I like the company reputation crap they provided above.
First Party Collectors, Second Party Collectors, Third Party Collectors, Fourth Party Collectors (all trying to collect the same bill) Noted already paid years ago......I guess they do not do enough research. Most people pay it..which they should just ignore it and tell this where the sun does not shine. You know it takes it alot to hit people that are down and out......I cannot believe they can go out and sleep at night. Oh yeah I like the fake names and for peat sake can anyone speak English in this country......they even hire illegal aliens.
