student loan call
- andrew| 24 repliesmy wife have been contacted from debt collecting agency about the student loan and started talking about the garnishment starting tomorrow and that they are going to contact nursing state board to suspend her nursing license. Problem is that she never had any student loan. She only purchased materials from College Network and they use credit union to borrow money. we never paid this and it was included in the chapter 7 bankruptcy 2 years ago.
The company was Williams, Rush and Assos.

Do not communicate with them via phone. No garnishment will start tomorrow.
Request a debt validation via a certified mail (The right to dispute the debt and receive validation are part of the consumer's rights under the United States Federal Fair Debt Collection Practices Act).

Stated I need to go turn myself in to the court if I don't settle.

We just need to keep up with them and communicate to the people who are unaware of these scams and get them the info they need to protect themselves and also take the fear out the calls.
Andrew.. one question.. what was the phone # they called from? - ConsumerThere seems to be a lot of this 'student loan debt collection' going on now, commiserate (what a surprise!) with the many msn homepage articles theorizing that the next financial bomb is, wait for it, STUDENT LOAN DEBT.
I have been receiving some, not many since I don't answer the phone and in this way do not 'feed the monster,' calls for people that I have never heard of and some that don't ask for any at all, they just leave robocall-type recorded messages that don't ask for anyone, they just instruct the listener to puch 1 for a CSA.
I get calls from Univ. of Phoenix assignees that call looking for someone that I've never heard of, and then, several moments later, call again (caller ID - I check it) claiming to be a doctor's office looking for the very same individual that the debt collector called for just a few moments previous. t comes in spurts. I don't get as many as most do, but enough to take notice. IAnd, as I found out on another website for looking up strange phone numbers, I'm not the only that this happens to.
Yes, this does seem like another version of the Payday/checkfraud scam. How else is someone like me to figure that these calls come in like this?

I will be calling my credit card company in the morning and cancelling my card to prevent any further transactions. I became afraid when the lady said that she was going to report this against my LVN liscense. I am so happy I decided to google this tonight. Thanks for the information.

- orangefrognurse| 9 repliesI received the same call is morning. I was not home so my dad answered. They told him it was regarding a legal action in our county courts. I call them back a Ms. Bakasa told me it was a debt with the college network. She gave me 3 repayment options and told me I had to make decision by 1pm or it was going to continue in the court today at 1pm. Mind you I haven't been served or any other prior notification. After a lengthy conversation with the rude woman I finally told her I would turn this over to my attorney. After speaking to my attorney on his advice I called them back and requested the document that they claimed I signed allowing them to check my credit and for a copy of the legal document they had filled to the county court. I requested she fax it to me, which was actually my attorney, she refused to provide me a copy of the signed document saying it was my responsibility to keep up with it. She also refused to fax the legal document I requested say she wasn't faxing me anything. She did however finally give me her fax number after putting me on hold and getting approval from someone else. I typed up a letter at the advice of my attorney and faxed it to them stating all correspondence to go thru my attorney. They also threatened my nursing license. This is ridiculous. Not sure if this helps anyone.

- Sir Bedevere replies to richard| 2 repliesWhat company? Did they name the company? Say why you were obliged to pay them? Sounds like fraud. I've never heard of any law that would allow a creditor to revoke a *driver's license* over a debt. Utter nonsense!
I'm guessing they insist you pay via Western Union wire transfer of some kine of purchased "money card" If so this is outright fraud. If they call again tell them you're recording the call to send to the police. Bet they hang up immediately.
