Cara... What city are you in? I am in the same boat except luckily I still have my kitchen intact. Cabinets were to be delivered 12/28/09. I have filed my dispute with GE, sent a complaint to the NCDOJ, filed a complaint with BBB and am planning on calling the NC Contractors Board this afternoon. Don't know what else to do at this point besides wait...

Thanks Cara. Best Advice I heard here yet. Contractors complaining about $200, $500, etc. Homeowners are out  $5K, $10K, $20K+ and with no kitchen.  Threatening to put a lien. I appreciate putting that to rest. That's insult upon injury. You had a chance to walk away after not getting paid once and you all had better insight to what KC was doing to homeowners (if you are all experienced as you say you are, then you're all complicit in the deceit that took place.)

How could you rightfully pull someone's kitchen out, if you didn't have all the materials lined up and resources scheduled to replace it ? You didn't care. You made your $200 and were fine with it.

How did you file with GE Money? Did you send a letter? I just started this process yesterday.  My new problem is that today Kitchen Carolina answered the phone and said they're just "delayed".  I don't care, after reading the messages on here, I'm definitely wanting out, even if it means living with a demo'd kitchen till I find a better option.  I'm just concerned GE won't consider their violation of the contract valid.  Have you had any success as yet?

I think some of us homeowners would/should like to know who each other are without spoiling our confidentiality. I am wondering if we can contact each other and use ONE power house lawyer. Class-Action-Like. Without forming together, we remain at the whim of Corporate Lawyers who are paid higher sums than our individual lawyers.

I would love to work with others to clear this up.

the only way a sub contractor can not lien your home is if you can prove that Kitchen Carolina has been paid 100% for your job. If you still owe then the lien is valid and you have to go to court and prove the guy has been paid.If you have paid 100% the guy can still file the lien and you still have to go to court and prove you have paid then his fight is with Kitchen Carolina.You can also have him pay your attorney fee as well.

If you owe anything and work is still not done and you have exhausted all means of trying to get the clowns to come back and finish the job "in a workmanship like manner"( do not allow them to rush through to finish just to get final payment. DO NOT SETTLE FOR CRAPPY WORKMANSHIP AND HOLD THAT LAST BIT OF MONEY UNTIL YOU ARE 100% SATISFIED) then they can fall under one of many "non compliance" statutes and you have every right to hire out and deduct what you owe from the final bill, if it becomes more then what you owe then you can sue Kitchen Carolina for the balance..good luck.
The key to any construction job is documentation, documentation, documentation,pictures of bad work help in all lawsuits even if its a dog hair cut.

Mr. Selfors claimed that there is over 2.4 million in receivables out there in his eyesight's which leads me to believe that lots of stuff has not been paid for 100%. This is about 400 kitchens( his words) so if you do the math each and every kitchen has a budget of 6,000 to be completed.
Some will be more and some will be less but you can bet your bottom dollar that any sub doing any work that screws up in any way to blow that budget so they better take the "A" team wherever they go. To take the chance and start hiring new and cheaper guys will be the ultimate kiss off death.They have to know who the good subs are and who suck.
So if you can prove that you have paid Kitchen Carolina 100% then you are safe from a lien this does not mean that the lien can't be filed it just means that you will still have to go to court and prove you owe nothing. Not fair but that is how it goes.
If you have unfinished work or garbage work in your home and have tried and tried to get it done and done correctly, then hire out but have you ducks in a row with DOCUMENTATION courts love it.
In the end one of two or three things are going to happen.
1. The company goes insolvent and all that are owed wait in line in hopes that some how money will fall from the sky.
2. They get out of this jam and continue putting in kitchens.
3. A new company is formed and a new name goes on doing the same thing.

The Kitchen Carolina website is back up with some changes.... still offering 0% for 48 months.

Just sent letter to GE this week so no news yet. Someone mentioned that even if cabinets had been ordered but not delivered that you should be able to get out of your contract...even if you have to pay a "restocking fee".  This was sugested by a GE rep to someone.

The granite co. where I chose my granite said they are no longer working with KC...not sure about tile people.

I hope the NCDOJ gets involved and then we will see some action hopefully.

I just read that the The Kitchen Carolin website is back up.... amazing.

thanks everyone for all the great advice......I'm up for a group organization of all homeowner and contractors. We need to get the Charlotte bbb taken care of. I was assured by KC that all my $$ would be refunded even though they are having such "financial difficulty right now..... I am so hurt and feel so stupid for trusting this company.

WTF?!?  Their website is back and they're selling kitchens!  I just called pretending to be interested in a kitchen and this tart was ready to schedule to have someone come to my home.  When I told them who I was they said my cabinets have been ordered.  But of course no one knows when (read: if) my work will happen and after reading about the horror stories of unpaid subcontractors and shoddy work, I don't want this at all.  As a NY native Sicilian woman...let me just tell you all...my ability to remain polite is quickly reaching its limits.

The KC Website is obviously a temporary sham everyone. Beware. It is a sham. I have the old website page saved. They're trying to remove themselves of Legal Obligations via False Advertising. You can see their 12 Day Plan is now littered with "its a goal..." ..."things may take longer..."  Pretty sneaky ....

What is the point of having a twelve day plan if we usually take longer?  As Linus used to say, "If you aim at nothing, you hit it every time."  From the earliest dates of your project, we work toward a "Projected Completion Date", which may move, but which gives us a target to shoot for.  Having installed literally hundreds of kitchens, we have found that focusing on a Projected Completion Date moves things forward when the many details of the project work to bog us down.

i wonder if Rob's wife Cana is the one answering the phones...I can't imagine we that they have many employees left.  If you click on the BBB link on their website ( YES they have a BBB reference) it takes you to the BBB site (Raleigh) that says their accreditation has been pulled and gives a link to the NCDOJ website to file complaints. Great advertising!

Who the h**ll is financing them now...I heard GE Money has pulled out.

The contracts stipulate a firm start date and date of substantial completion as outlined in Article 3.1 of the contracts signed by the homeowners.  This is not an estimated date.  This is notice to proceed and is part of the contact they have to adhere to.  I intend to use this as breach of contract regardless of the status of my cabinet order (oh and they're not answering the phones now...it's only 3.30 PM).  I'm just thankful I work in construction management and know enough that they can't push that date back unless I agree to it in writing which I never will.

Your just a dumb---! I have 10 different customers in the same situation that you are in....I am working hard to help them as much as I can.  And We still aren't getting paid for it.  I feel sorry for them....But you.. your just stupid! I have no compassion for you!  We didn't just throw up cabinets, collect 200.00 then leave.  We are owed more than 7000.00, so dont talk your crap about" we knew what was going on."  We are victums ourselves, we will never see a dime of that money.  We worked HARD for that company.  And if YOU were one of my customers,  I would defiantley put a lien on your home.just because your a dumb---.  Now, for the 10 customers that we have that are waiting on parts, we would not DARE put a lein on there house. Your just stupid!

It is only my opinion but they seem to be trying.They have a staff and are sending workers out. I can only assume that they are trying to finish the jobs they can get paid for. I think the cash flow restraints are stopping them from going full force with vendors and subs. and they are crawling along.
If it was a scam of any degree why would they try and why would they make any attempts to continue to work. If there are indeed 400 kitchens out there then the sampling on this message board is small. You would think if it was a scam that everyone would be left without nothing and this board would be on fire. (if there is another place for comments let me know).
The time frame to do the jobs is highly ridiculous. 8 to 12 days!! balony.
They have no idea how it should go and it would have to be at least 21 days if not 30.
The last month or so they had started to close the jobs out faster then ever.
You home owners my find some subs calling you telling you that they have not been paid for the job and are asking you for money or they will be filing a lien.. Don't pay them, let them file the lien. There is a very good chance that no one has ever filed a "notice to owner" this is what opens the door for a lien. I am not sure but a subcontractor has 45 days from the time he stepped foot in your home to do so. I think if you don't get the "notice to owner" the lien rights are waived. Don't pay anyone who threatens you with a lien anything let them take you to court.

I am waiting until after Christmas to see what happens before I do anything.

If my contract stipulates that work shall start on 9/1/09 and be substantially completed by 9/8/09. What does that actually mean legally ? Is that binding in any manner (the 9/8 date) ? Have they breached contract ?  Or is doesn't mean a crap ...and Mr Selfors who brings donuts to the BBB and NC Business Association coffee cloches over-ride all that ?

I am taking the holidays off. After the holidays, I will pay  to rent space for a hotel meeting space (and bring donuts) to organize this team (I will broadcast it far in advance). I will hire a lawyer (at minimal fee) when he's see the bounty that's at stake. (I've spent 3 months of my life project managing this thing at the incompetency of KC.)

I have the money to spare to fight for what's right. I will organize this fight after Christmas. After many long years of life, this is the time of year I shut down and put life on hold. I will offer to spend money for a lawyer to represent us all and also the meeting room for us all to meet: both installers and homeowners.

In the meantime: Contact the DOJ. I believe the KC Website was brought back up (by law) to allow folks to access NCDOJ Website. Follow the BBB link. It takes some work (manual paperwork), but you need to file.

You cannot goto court and point to an internet forum of complaints. They need to be individual complaints. "Heresay" does not work in court.

back at ya: if there are so many customers completed, why can they not offer ONE reference customer ? Every other reputable site provides quotes of satisfied customers. [***], even Controlled Substance sites have references.

Perhaps your average person who works all day doesnt know to search on "Rob Selfors" but rather Kitchen Carolina. That search gets lost due to "Kitchen" and "Carolina" .....

I found this site today and glad I did. If they have so many satsified customers...and THIS SITE is only a sample, WHERE IS ALL THE MONEY FLOW ? I saw there "1000's of homes in NC completed" ...then where is the money ? What gives ?

There are people here NOT getting paid, BUT they offer jobs on their website !?!? Ho nayive is that ?

Follow the Money Trail And like the dude said above, file with the DOJ. They will follow the money trail. Theyll burn em.
