    I cant believe it, The collection agent Mr. Prez told me that he was calling from a lawyers office and he was a lawyer. WOW! Isn't that against the law to lie about being a lawyer.

    Thanks for finding that website, it was pretty insightful into what they are actually trying to do; "find our hot buttons". If you have a legitimate debt I would definitely reccomend retaining a lawyer. Don't say a word to them, as they will try and use it against you to further harass you.

    This reply sounds like it was written by someone from MB&W. Losing a child and the financial debt that comes with it should be explained to anyone attempting to collect a debt (valid or otherwise) and the successful debt collector should have some compassion for this individual and allow her some time to work this out.

    How would you like it if you just lost a loved one and some a--hole called you and began verbally abusing you? Verbal abuse, along with telephone harrassment, is strictly against the law.

    I agree with digusted.  Jason doesn't give sound advice nor does he seem sympathetic.  He is probably a plant. Please do not pay attention to his answers.  
    AmbernGeorgia, I am so sorry for you loss and yes, you should mention the personal issues you are dealing with when discussing repayment.  I've also read a lot of info on this MB&W and there is something not right.  You may want to visit the BBB website and check them out.  I googled them and there are a lot of complaints, legit or not, there are lots of issues.  Leads me to believe that good companies should not use them.

    These collectors violate the "Fair Debt Collection Act". File a complaint with the Federal Trad Commission online. They cannot tell you they are going to arrest you, sue you or take you to court UNLESS the creditor has authorized that legal action. WHY would a creditor spend $1000 or more to take you to court for a $200 bill.

    These guys are desperate as no one is paying them.

    We have received MANY calls from a woman named Veronica from McCarthy, Burges & Wolfe.  My husband tried to work out a payment plan but she kept calling and amount we actually owed kept growing.  We want to pay our bill, and unfortunately we did fall behind.  She threatened to call our neighbors and "see what we have to hide."  She told us to "prepare to be sued, losers like us don't previal in court."  Her threats were scarey and abusive, they made me feel like our family may be in danger.  We never said we didn't want to pay our debt only that we need to know why the amount keeps growing.

    Someone from another blog had this awesome form letter you should tweak to your situation and send to McCarthy Burgess and Wolff...I will be doing that tomorrow as they are leaving threatening voicemails on a matter that is between my husband's former company and another company (nearly 4 years ago and my husband only worked there and never personally guaranteed anything!).  See below:

    To Whom It May Concern:

    This letter is being sent to you in response to a alleged debt. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

    This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

    What I need you to provide as the debt validation is as follows:
    1. What the money you say I owe is for;
    2. Explain and show me how you calculated what you say I owe;
    3. Provide me with copies of any papers that show I agreed to pay what you say I owe;
    4. Provide a verification or copy of any judgment if applicable;
    5. Identify the original creditor;
    6. Prove the Statute of Limitations has not expired on this account
    7. Show me that you are licensed to collect in my state
    8. Provide me with your license numbers and Registered Agent
    9. Proof that the collection company owns the debt/or has been assigned the debt. (You are legally entitled to collect this particular debt from me.) This is basic contract law.
    10. Complete payment history, starting with the original creditor. (I need to have proof of my payment history with original Creditor, what the amount of the debt was when the creditor assigned the debt to your company, and what fees/interest has been tacked on to this debt and how you/they determined these fees.) This requirement was established by the case Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004..
    11. Copy of the original signed loan agreement or credit card application. (My contract with the original creditor establishing the debt between us.) This is also basic contract law.

    At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau's (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent

    I will not hesitate in bringing legal action against you for the following:
    1. Violation of the Fair Credit Reporting Act
    2. Violation of the Fair Debt Collection Practices Act
    3. Defamation of Character

    If your offices are able to provide the proper documentation as requested in the following declaration, I will require at least 30 days investigating this information and during such time all collection activity must cease and desist.

    Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.

    It would be advisable that you assure that your records are in order before I am forced to take legal action.

    This firm is also contacting me.The caller has advised me on how I should have dealt with the original debtor. That he will not provided a copy of contract,That the equpment I returned may still be in dispute after I pay.And that its not in his interist to verify or arrange a global resolve

    Ithink the caller is a clerk, dispersing legal advice....

    ANYONE ELSE OUT THERE?   I could use a bit of that $500K

    You sir must be a debt collector yourself!  From the crazy advice that you give.  How dare you ask someone to rethink how they went into a phone call from people who are already rude, they do use these very things to bully people into paying things.  And, if what this person says is true that this debt collector said to them,  then the debt collector went against the FDCPA.  I myself was a debt collector and got out of that line of work becuase I could not stand the way people were being treated, these debt collectors now days are very rude and just want the quick buck, because they work off Commission.  My advice to the person that had the debt contact the original creditor and settle with them!

    I received a letter in the mail from this company just a couple of days ago.  The called my place of business today and left at message, Attorney's office Burgess and Wolff, with a court case number and to call back by today to stop this from going to court.  I called the company and spoke to a Ms. McNeal.  I explained to her that I was disputed this action.  She had told me I owed double the amount the was stated in the letter I just received.  She got extremely nasty with me telling me I better watch my accusations.  I told her I was simply disputing this debt and the number of times I contacted this company.  She continued to be rude and yell.  I simply asked her if she always talk to people like this.  (I have always remain calm and called her ma'am throughout the conversation)  They she started to yell at me, talking over me, threatened to sue me for making accusations against her and she will call/report my business to the  Secondary of State of Virginia.  Something of that sort.  I was astonished on how this all came about and we never really got to the point of the issue at hand.  I again asked her why she was so rude when I was just asking her questions.  She kept yelling saying this conversation is over, repeatedly then hung up.

    Now what do u say to that?  How do these people get away with this?  I understand it's a scare tactic but this is insane and going to far.

    I'm receiving calls on my daughters cellphone. I have no business dealings with this company nor am I delinquent on any of my bills.I just paid off my wife's credit card bills. My daughter is only 9 yrs old.Why are they calling my daughters phone.

    I like the Form Letter very good. As most have said you do have rights and you have the right to request information and to have them stop calling. If they continue to call this is a violation of Federal law which you can report the company to. They are NOT allowed to threaten you or contact anyone else to get to you. If they contact a relative,friend, neighbor, or work with out your permission this is a violation of your privacy and is also reportable. If they are taking funds from your account you can contact the Financial institution and request these funds to be STOPPED so they will NOT be able to withdraw more then agreed. As for Jason he is either working for this company, has a finacial stake in debt collections or in a debt collector. I have not seen any practical answers for this miss informed person.

    rec'd call stating all operators were busy but call very important.  as soon as the woman came on the line i asked her to remove my number from all of her calling lists... she was asking for a man who prev had my #... she told me she'd think about it and when i repeated the req for her to remove number b/c we werent getting anywhere with this, she said nope and informed me that she'd talk to me tomorrow!!!! The Nerve!
