    I just received a call from Portfolio Recovery of Oakland, Phone number 510-355-1780 on a debt owed by someone who used to live with us. Has not lived here in over 4 years. My wife and I are both over 70 years old and it is not easy for us to get to the phone to see who is calling. Will a cease and desist letter stop them from calling my number?

    Sure, but I recall hearing "Anything you say may be used against you" about umpteen dozen times in the civil courts I have observed. I'd rather be the one looking closer to squeaky clean if I assert claims of deceptive or hostile behavior from the opposition.

    Bully for you if that works in your neighborhood. One is just as likely to face a corporate-friendly judge who winks at the bank attorneys and gets a little woodie under his robe every time he rules against a consumer. Then it takes more work to wring admissions and testimony from the lender side.

    So debt created from thin air by the worst collections thugs is always owed? Debt created by sloppy billing is still owed by someone? Debt ballooned to an amount not permitted by the original creditor's contract is forever owed by some soul? A dismissal with prejudice and deletion of trade line is still not enough to extinguish the claim?

    Forum participation is not the same as a private discussion, therefore no one is barging in. We are all learning here. If you wish to add to our collective wisdom in a polite manner, without misreading what is said or painting broadstrokes or blowing a gasket every fourth sentence, please proceed.

    If there is one priority takeaway, it's that advanced debt dispute issues rarely have "one size fits many" solutions. Hence I try to qualify my statements when I'm on less sure footing. Bluster and insults in the reverse mirror image of the collectors are I think not helpful.

    They cannot actually try to collect forever as a matter of fact the more they call you becomes harassment and is illegal according to the law.  I refused to pay a debt to sprint because of lies that their customer service people had told me and a year later began receiving collection calls from there collection agency RPM.  I was receiving between 4-8 calls a day from morning to night.  After contacting my lawyer he issued a cease and desist letter to them and filed paper work to sue them.  They immediately settled.  My debt was taken care of it was removed from my credit score and I received a check to pay for my damages.

    If it doesn't stop them, sending a cease communications letter will set them up for a lawsuit for violations of FDCPA if they continue calling.  Send your letter certified, and contact an attorney if they ignore it.

    These companies are so lame. Why take the risk of buying a debt from years ago. Cents on the dollar ? Did Obama settle cents on the dollar with Lehman Brothers, JP Morgan Chase, Wells Fargo, Morgan Stanley, Goldman Sachs Group Inc., U.S. Bankcorp, Capital One financial corp., etc. These are just some of the hundreds of banks that got bailed out and now some company like portfolio shmucks and RPM scavengers just so happen to "Buy" zombie debt. Gee, you know what, everyone here owes me money now and your guilty just cause I said so..hahaha..
    People, don't answer without an attorney. If someone calls and says "are you Mr. Smith" just say no, who is calling, when they identify themselves as a debt collection agency, just say I don't know who your looking for, I never had a "bank name here account" and I never lived in "city" of accused. Then block that number..Contact an attorney for advice. Look up statue of limitations in your state. If you get a letter, write a cease and desist and send it through the post office with a signature required.  Rule #1 NEVER admit to anything, Rule # 2 Don't send any amount of money, Rule #3 Remember the banks that never repaid their debt that they borrowed to lend to you..
    Most statue of limitations is 6 years, give or take a year. Once you verbally admit to owing and make a payment arrangement, you might be liable to renew statue of limitations. Then Bam, credit problems all over again. Seems like Chase has good credit again and it has only been 3 years...hmmmmm...

    Anyone who can claim "not me" can send a cease-comm notice, too. This is really the best option, when sent USPS Certified with return card. The FDCPA covers all non-debtors to an extent. Collectors cannot harass or abuse any person, whether the person allegedly owes or not. Possibly you have a case already if you kept good records.

    Please note they can call from New York, Georgia, Pennsylvania, Nevada…  from which they use the following area codes and prefixes.  Block the area code and prefix.  The last four numbers are continually switched around, so you can only get rid of them using the area code and prefix on your call rejection service provided by your phone company.

    So far they are known to use up to 125 different numbers to call you. Rejecting area code and prefix works.
