- MD LallyNo idea who they are and why they are calling me. Checked credit reports just in case and nothing negative after reading these posts. So annoying because I don't have a connected phone to answer so when it pops up on tv screen it freaks me out
- GGot a call from this number tonight. The caller ID came up as Portfolio Recovery Associates, a debt collector. This is the third number they have called me from. I don't know why their calling me. They always have an automated message whenever I answer saying to call such and such number back.
Really what their doing is illegal. Under the FDCPA, they have 5 days from the first time they call to send something in writing; telling you how much the debt is, the original creditor, and the information you would need if you wanted to dispute the debt their trying to collect. I never received any such letter, they just started calling.
Since I don't have an account number to reference, I will use my phone number and send a cease and desist letter. They picked on the wrong person to try and scam.- Caller: Portfolio Recovery Associates

2. take a picture of your caller id or cell phone that shows their #
3. ask them to send you something in writing mail fax or email
4. keep a record of each call and the date (picture of caller id)
for each violation they can be sued for $1000.00 pr violation
and by the way i dont care who buys the old account if it is more than ten years old you do not have to pay it it is against the law to re-age an account and they can be sued for that nco just got sued for thousands of dollars for re-aging the accounts and you can dispute this with the credit breau if they do put it on your credit federal trade commission says after ten years they can not report it but if you dont dispute it they get away with it. 22yrs as a collector and not all collectors are scum bags a consumer attorney will not charge you anything the collection agency pasy them and you FIGHT BACK CONSUMERS but remember if it is a legitimate debt you should try to resolve it.- Caller: portfolio recovery

Most people will not take or answer any call they do not know. End of discussion folks!!!!
If it is a good call, callers will leave a message on your machine or voice mail.
Just don't take their calls and let them wear out their machines calling people...When they finally realize people will not take their calls folks, it will no longer be productive for them to call and bug people. Just ignore them.
If you don't want to be bothered with the phone ringing from all these scum bags and OTHER callers that the no call list DOES NOT not stop, get yourself a call blocking device people.
Remember they have to make this worth their time to be making all the calls.

The law firm of Turner Law Offices, LLC has filed a Class Action lawsuit against Defendant Portfolio Recovery Associates, Inc. ("PRA") in the United States District Court for the Northern District of Georgia on behalf of all persons in the State of Georgia who, since October 28, 2010, received a non-emergency telephone call from PRA to a cellular telephone through the use of an automatic telephone dialing system or an artificial or prerecorded voice and who did not provide prior express consent for such calls during the transaction that resulted in the debt owed.

Portfolio Recovery Associates operates illegally, and they can't be forced to stop if your attorney general doesn't get reports from abused people like you. Even if you do actually owe the money they are trying to collect, there are laws they have to follow, and this outfit does NOT follow them.

You can go ahead and file a complaint with your state's AG, but all they are going to do is enter it into a database (Like the FTC does), in order to establish a pattern of abusive behavior.
In our experience in dealing with PRA, our state's AG office was essentially useless. All they did was acknowledge our complaint and turn it over to the FTC---who did nothing, either.
What we had to do was to dispute the debt---and continue to do so---right up the food chain and to the IRS, who received a 1099-C and held PRA in default when they failed to respond to their request for documentation to support an out-of-statute debt that had been disputed years before.
First things first: Stay OFF the phone! PRA has no other interest in this whole, hairy world other than to manipulate you into making a token payment on a time-barred debt so they can reage it and put it back on your credit report. Though this is not illegal for them to do, it is how they enjoy sixteen percent net profits on old debts they paid pennies on the dollar for. But, if they threaten to garnish your wages and seize your assets, that IS illegal and you can take them to court.

In a nutshell, the letter states:
The statute of limitations has expired on this debt;
You do NOT owe this debt, AND:
They are to cease calling you and you intend to use whatever legal remedies which are at your disposal if they ignore your request or take you to court.

One of the best tricks they use is refusal to disclose who they are and their physical address. If you request the firm ceases the calling (or) as that they provide the alleged debt in writing, they do not have to comply unless YOU send them a letter stating your wishes. The above is the information you need for many of the calls you get. Send the letters Certified Mail, Return Receipt and make sure you TYPE the requests professionally, with proper grammar and spelling. The more they can make you look ignorant (or) incompetent the better chance they have to get a quick 'default judgment' and begin garnishing your wages. So I don't have to add all of those silly numbers in my call block app on my android phone. I never get bothered. Sometimes I check my log and giggle my ass off seeing Portfolio called 50 times on autodial. Whatever.... Soon you guys will need a new line of work. - Agent replies to Mr. SmartPlease forgive us. The owner of this company is very greedy and makes us collect on these bad and old debts. We don't like to do it but we are just trying to make a living like everyone else. We know we can't collect on 95% of these debts. But we get paid for being here regardless. - LeahI just got a call from them again, even though I have been paying on that debt for over a year now. They auto call me at least four times a week, so I guess $20 a month isn't enough for them. I'm sending them a C&D letter to stop the calls, I mean hell I'm paying my debt, they just won't leave me alone.
