- LeighI got a missed call and when I googled the # I read some comments and assume (if valid at all) pertains to my deadbeat sister who I found was on my credit report (fortunately she doesn't have my SS#) when my husband and I were buying our first house. If I hear from these lowlifes again I will bring attention to the appropriate personnel.

- DianeBeen getting calls from this number for a couple months...I have not answered any call I don't know the number too, so therefore they can call until I die....which at my age could be any time now. HA H AH AH HA
- SteveI got a call today from them, and they had my name right. However, they asked if I was the one who lived at X address and born on Y date. I gave them a No and No, then they hung up. Tracing the number online suggests a date collector, but the type of behavior I got from them suggested social engineering.

1780 Nebraska Ave Grants Pass, OR 97527-5700 - Luluz| 4 repliesIf u have no debt especially student debt they might be calling u Bc one of ur neighbors has. They've done it to me. They called my next door neighbor and one across the street whom are no relation to me. The company likely has ur address so they look up address close to where u live and bug ur neighbors. Luckily for me, I am friends w all my neighbors and they give them hell for me!

Can't confirm that it is the same scam because I didn't answer. However, it came in on a number I no longer use and that I now get a bunch of scammer calls on.
- StephenI received a call on my work phone from some woman from this company. She refused to identify herself or the company or even what the company does other than what was on my caller ID. She had my name and asked me to verify someone else's DOB/SSN. She apologized and hung up.

- radiomacThis number left a voice mail on 30JAN2015. Said this was a call of a personal nature and if I was not so-and-so, to hang up and delete the recording, that it was illegal for me to listen to the recording if I was not the intended person. Then it said that if I was that person, that the caller would delay speaking for 6 seconds so I could get to a place where no one could over hear the messagel. BTW, I am NOT the person they were calling but they left the message on my voice mail anyway. After the pause, the female caller addressed a female by name: Laura, you have unpaid debt that is in collection. You need to take care of this now .... and on and on. Call us back immediately.
Heck yes I listened to it. It is not illegal for me to listen to a message on my voice mail. I suspect it may be illegal for a debt collector to leave specifics like name, debt, amount, etc. on a phone number from who knows when. I've had the number for 11 years.- Caller: Performance(?) Recovery

- MARQ SMITH| 1 replyI was called and they told me that their name was Performant Recovery. I have no clue who they are and they are trying to garnish my wages.
- Caller: Performant Recovery
- Call type: Debt collector
- BigA replies to MARQ SMITHThe only way they can garnish your wages is if they go to court and receive a judgement, and the judge allows it. It may not even be possible in your state to garnish wages. Now here is the information you need as well as the links at the bottom to learn about your rights and to file complaints:
Performant Recovery, Inc. : California Records: http://kepler.sos.ca.gov/
They are registered as a Maryland Corporation and have changed their name from Diversified to Performant: http://sdatcert3.resiusa.org/UCC-Charter/Disp ... c+INC.&TabNum=1
Bizapedia Page: http://www.bizapedia.com/md/PERFORMANT-RECOVERY-INC.html
BBB Page with 430 complaints, but with 1400 employees this means that big bucks are going into the BBB tills: http://www.bbb.org/greater-san-francisco/busi ... ermore-ca-10756
Please read the actual complaints they are extremely enlightening.
Now here is where I have a major problem. Why would they send you to the IRS.gov site, when student loans are covered by the Department of Education? Probably because they didn’t want you to know that they have no contract to collect on student loans:
https://studentaid.ed.gov/about/data-center/b ... llection-agency Note that neither Diversified nor Performant is on this list of authorized collection agencies..
In addition, this is where you should go to learn about consolidating these loans:
https://studentaid.ed.gov/repay-loans/understand/servicers
http://www.consumerfinance.gov/
The company claims to follow this law, but from reading these posts, they probably mostly skirt it:
http://www.law.cornell.edu/uscode/text/20/1095a
In addition, the fact that they are attempting to get you to consolidate the loans with them seems odd and could in fact be a conflict of interest. Please do your research before moving ahead with this shady company.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office and the California AG’s Office: http://oag.ca.gov/ - Katrina porter| 1 replyI have received many calls from the above number. When I question who they are they hung up on me. I would like for them to stop harassing me.. These calls cause stress and at my senior age I can't afford any stress.
Please make sure that this number does not call me anymore.- Caller: pure performance
