The only way they can garnish your wages is if they go to court and receive a judgement, and the judge allows it.  It may not even be possible in your state to garnish wages.  Now here is the information you need as well as the links at the bottom to learn about your rights and to file complaints:
Performant Recovery, Inc. :  California Records:  http://kepler.sos.ca.gov/
They are registered as a Maryland Corporation and have changed their name from Diversified to Performant:  http://sdatcert3.resiusa.org/UCC-Charter/Disp ... c+INC.&TabNum=1
    Bizapedia Page:  http://www.bizapedia.com/md/PERFORMANT-RECOVERY-INC.html
BBB Page with 430 complaints, but with 1400 employees this means that big bucks are going into the BBB tills:  http://www.bbb.org/greater-san-francisco/busi ... ermore-ca-10756
Please read the actual complaints they are extremely enlightening.
Now here is where I have a major problem.  Why would they send you to the IRS.gov site, when student loans are covered by the Department of Education?  Probably because they didn’t want you to know that they have no contract to collect on student loans:
https://studentaid.ed.gov/about/data-center/b ... llection-agency   Note that neither Diversified nor Performant is on this list of authorized collection agencies..
In addition, this is where you should go to learn about consolidating these loans:
    https://studentaid.ed.gov/repay-loans/understand/servicers
    http://www.consumerfinance.gov/
The company claims to follow this law, but from reading these posts, they probably mostly skirt it:
    http://www.law.cornell.edu/uscode/text/20/1095a
In addition, the fact that they are attempting to get you to consolidate the loans with them seems odd and could in fact be a conflict of interest.  Please do your research before moving ahead with this shady company.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site:  http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office and the California AG’s Office:   http://oag.ca.gov/

I have received many calls from the above number.  When I question who they are they hung up on me.  I would like for them to stop harassing me.. These calls cause stress and at my senior age I can't afford any stress.
Please make sure that this number does not call me anymore.

800notes is not a call blocking service. You will have to do this yourself. The next time they call, demand a legitimate, physical mailing address in which to send a cease communication letter VIA certified mail with return receipt requested. If they refuse, let them know you will be seeking legal counsel who will get this information for you and sue them for harassment.

you really need to get a clue as to how these things work. NO ONE SOLD YOUR NUMBER!! the DNC list is not nor will it ever stop these people from calling you as that is NOT WHAT IT IS FOR!! you sound like just another upset, hate filled liberal who thinks the whole world owes you a living. these dialers are software on a computer that takes a number (say 673-555-1111) and after dialing that number, automatically adds 1 to it and then dials 673-555-1112 and after dialing that number automatically adds a one to it and dials 673-555-1113 and so on and so on. so eventually they're gonna dial your "unlisted" number which you seem to think is going to stop them from calling you? seriously, you really need to get a clue.

If you were listed as someone's reference then call 'em back and tell 'em that you heard they'd passed away a few years ago. and if they continue trying to contact you, ask 'em why they're so eager to talk to a dead person?

I agree with you 100%. I don't know what school he went to, but it's quite obvious he never paid any attention to what the teachers were telling him. Definitely a complete waste of taxpayer dollars. He's probably a liberal who insisted on getting that degree by not doing any of the work.

    BigA replies to seriously?
Well we can all seriously tell that you certainly don't have problems with a student loan.  Your obvious lack of education and basic English skills is painful to those of us who went to school and actually paid attention.  But then that is why most of us can read the date on those posts whereas you seem to not be able to comprehend you are replying to a 5 year old post. Guess that is why you are stealing from people instead of cleaning porta potties.  You were way too stupid for the porta potti job.  Probably couldn't figure out how to put the toilet paper on the holder.
