    "Adam Blund" at MCM (Midlands Credit Management) called for the umpteenth time so I finally answered. I played along as "Brian" who owes $587.00. When I said I'd send a check after getting their letter (ooh, yes, sir, we'll send a letter to.....wrong address!), he gave me their address as 8875 Aero Blvd, Suite 200, San Diego, CA., tele 800-265-8825, his ext. 54917.
    He told me I could pay "only $387.00" if I wanted to get a pre-paid card from WalMart.
    Me:  "ok, Buddy, hold your breath until I can get it to you!"
    Him, in Oriental.....huh?
    Me: No, really, just wait.....

    The DNC is for telemarketers only, it does not cover debt collection which is under its own set of rules the FDCPA!

    Called for someone who hasn't worked with my company in six years (I actually took their position). Gentlemen questioned me (very rudely) and when I told him I took her job, he finally got annoyed and hung up. Number that called was 1-800-265-8825.

    My wife received call  from this number this morning May-3, 14 by a female voice. She said she called from Chase bank in regards of credit debt..  and need personal info..   My wife ask for the contact enable to talk to her later. and she gave phone. no. 1-800-265-8825  and ext.  53382.  
    I did not call them back as i knew many people got the same scam call

    I just received $1000 credit towards any debts that are supposedly owed by me that Midland purchased.  There was a class action lawsuit against them.  If you want to know the details go to http://www.recordingclassaction.com/ - if you have had problems with Midland you may want to check it out and see if you can file a claim.  It may be worth it!

    I used to york for them and believe me, we hate to work on sundays, we hate people telling us all the time- today is sunday -dah we know that but that's our job and believe me, the company allows us to make the calls because is not ilegal. And you know what? We understand this is annoying but MCM is really cool with customers and with us.  We are people too - and trying to collect a debt on a sunday - come on! I do not work there because I live in a different place now since 1 week ago but . . . U guys already know a little more about the number that calls you on sundays. Bye :)

    Its no wonder they have been sued... FDCPA Violations run rampant-- So one has to question the "nice guy's" comment. Or rather laugh at that comment!  There is *no* sympathy for a company that frequently flaunts and violates the FDCPA laws, let alone a employee who does so knowingly.  

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    A Collector Says I Will Be Arrested if I Do Not Pay

      This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt.     Called my number trying to reach a family member.  Called them back and left a message that the person they were trying to reach does not live her and advised them not to call or send mail again.  Blocked the first number they called from and will block this one too if they keep calling.

    I have received calls from them and I tell them i don't know who it is, they always respectful. never complained about them. Until recently, they call me directly to my voicemail and leave breathing 3 minute messages. Really…REALLY????!!!! That's the most ridiculous thing. Now they're going to be ignored, blocked what ever.

    Demand a legitimate, physical mailing address in which to send a cease communication letter VIA certified mail with return receipt requested. If they refuse, let them know you will be seeking legal counsel who will get it for you and will be filing a harassment lawsuit.

    Apparently they hire shills that have a hard time forming a coherent sentence with proper spelling, grammar, and construction also.

    No one should pay any bill unless and until it is proven that the debt is authentic, the amount is accurate, and most importantly that the debt collector has the authorization to actually collect that debt.  More than likely something that you as an employee of this company would not be able to prove.

    By the way, hope you got paid in cash for this little post because if the gave you a check it will be a while before the bounce it takes returns it from the moon.  They did also tell you that it is a crime to write a glowing report of a company under false pretenses and I am sure they will pay for your lawyer to defend you from those charges.  Yeah, right, and the moon is made of bleu cheese also.
