And YES, 800 946 0332 IS LISTED ON CAPITAL ONE AUTO FINANCES PAGE!!!

- LizzyTheLezzyThis is Capital One Auto Finance, and they usually call if you are late on your car note. I fell behind, about 2 months behind, and while they do call a lot if you don't answer the phone, they can be very helpful. One lady explained to me that in the computer system, notations to the account will only stay on there for about 2 weeks. Once the 2 weeks goes by, the calls will start again. They are always really nice to me, and are letting me slowly catch up on my payments I've missed. When they do call, I try to always answer my phone. I explain to them, yes I know I am behind, this is when my next payment will come in, this is how much it will be, and to please note I am paying X amount of dollars every two weeks until I am current. After that, the calls stop until next payday.

I told them that it needed to be noted on my account that if they wanted to talk to me it needed to be someone from the states calling me. Half the time you can't understand those people. And its not just Capital One with this issue.

Went to their website and they won't let you email them without setting up an account - again they want the ssn. Must be a scam.

- Maria| 2 repliesI don't know how they got my unlisted home # but they called for two weeks daily harassing me that I owe money, which I do not. They then proceeded to call my work # and leaving same information, which is against the law, at work. They stopped for two weeks calling home and work and now started today calling at work and harassing my co-workers to talk to me. I tried to talk to them to make them stop and they hung up. I called back and the system said I cannot call them from my phone. This is against the law to harass me at work especially. Next time they call, if they do, I will advise I am reporting them to the D.A. as well as the FCC for violating the Fair Credit Reporting Act, etc. Our cars have been paid for years and we have no outstanding loan from no one. How annoying!

- UsedToBeInCollections replies to Maria| 1 replySorry to say it Maria but the FDCPA actually does allow calls to your work so long as they do not disclose exactly what the call is about. They can state what company they are calling from and the RP, if asked. They can leave generalized messages. It is entirely legal. If they do not speak to you direct then they are allowed to call again, generally to a confirmed work # they don't call as often but will still follow up if they think it is possibly a good number for you. The only way to get the calls to stop at work is to confirm you are the correct party contact and that you do not wish to have *insert phone numbers* called EVER again and to remove your from their list or system. Sometimes there are new people working the lines and by just saying "I can't believe you called me at work" or "I wish you wouldn't call my work" maybe even "Stop calling"...those people may not remove your number. You have to treat it a little like you are speaking to someone in law, be exact with your words and just flat say "Do not call *number* again". These people are just doing their job and if they don't go by company policy they actually can get flagged by quality assurance of their company and lose pay as well as their job if it happens enough.

So there is no reason for them to be calling her. Second, as soon as she tells them to stop calling her at work, they are obligated to stop. Also, since they contacted her, they are obligated to do this, and failure makes them criminals:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
