- F. SimsCalled me about a Bally's Total Fitness account in Feb. The guy wanted $200 a month to pay off the bill. I told him that I am on a serious fixed income and that was not going to happen and that I could do $50. He became rude and told me that I was refusing to pay. I said I am not refusing to pay but I can't possibly afford that much a month. Now this month I get a call from this rude a** named "Falan" who states that they are going to sue me for the money if I don't make payment arrangements. I told her to look at her notes what I told the guy and I said "I also told your co-worker two months ago not to call my job. She was like "you don't answer your cell." I said that has nothing to do with it that I have rights as a consumer. She became extremely irate and said I was irresponsible and could not pay my bills. I remained calm and said that she didn't know my situation so I didn't want her assuming and saying stuff she didn't know anything about. She became even more pissed (I think because I was staying calm) and told me that she was through with me and that they would put in the information to sue me and hung up on me. How are debt collectors allowed to be so rude? I am filing a complaint with the BBB with these jerks.

- Mad at continuing callsThis number has been calling us for a YEAR now. They stop for a few weeks and then they start up again saying they are "Debt Collectors". My husband and I are an elderly couple and don't have any unpaid debts. If they were legitimate they would write an official letter. How can I get them to STOP!!

- Sassy replies to lizzardCAUTION! Wait a minute folks. Most states require that collection agencies be licensed and bonded in your state, even if they are calling from another state! Penalties can be stiff. (My state, the fine is $20K). Before firing off a letter, check with your state's Secretary of State website to see if they are registered and licensed. A quick Google search will tell you if licensing is required. Include in your debt validation letter a statement like, "Despite the fact that your company is not licensed or bonded in (state) I am sending this letter to protect my rights. Please cease and desist contact immediately. I have reported you to (state's) Department of Commerce." If enough people are doing this, they will stop and/or follow this portion of the law. I won my lawsuit against this very company, folks! AND, they are being investigated! If you answer the phone by mistake, as for the agent's license number. Each person at the agency MUST also BE LICENSED!!
Hope this helps! - mzhaReceived two calls from 832-476-1739 and 832-476-1740 both said Avante USA on my caller id. Don't know who Tom Jacobs is or why he's calling. I have not been home the times he called. I just got a new phone number, maybe that's why but I am straighted out with all my bills, don't know what this guy wants.

- OI receive calls on my cell from this number looking for a Pamela. I tell them thre isnt anyone here by this name and they say thanks and hang up. I called them back at this same number and they said they will take my name off the list. Though I doubt it will occur. Another collection agency is also calling my cell looking for the same person. As for both of them, I look forward to the day when they want to be rude with me, I can teach them quite well on how someone can truly be rude and crass.

- Disgruntled| 1 replyOk, so I have debt. I'll be the first to admit it. I almost died and was hospitalized for a week. In that week, I accrued over $40,000 of medical bills with absolutely no insurnace. This was almost 5 years ago. I lost my job because of my illness. As a single mom with two kids and no child support, no job, and medical problems, needless to say, I fell behind in all my bills. The whole time, I was racking up even more in continuing medical care. The medical bills were the least of my problems. By the time I was able to work again, everything had been sent to collection agencies. This particular collection agency is the worst I have ever dealt with. They have threatened to call my neighbors and tell them everything about my debts, threatened to sue me, screamed and yelled at me, called me a b****, etc. I've asked for the original bills to try to verify that it's not the same bills other collection agencies are trying to collect on. They are all saying it is for the same company. They refuse to mail me anything. Now, I just hang up the phone. If I know it's them calling, I don't answer. It's not that I don't want to pay my bills. I can't pay them. If I was to pay $5 a month on each bill I owe, I'd still be paying out over $400 a month. They are last on my list to ever pay. I could win a million and I don't think I'd pay them after the way they have treated me. They have harrassed me at work after I have asked them repeatedly not to call me at work. The most unprofessional and hateful collections agents I've ever talked to.

There are also links to attorneys qualified in dealing with DEBT COLLECTION ISSUES - most are not qualified to handle debt collection issues many will work on contingency
The threats to contact your friends and neighbors are illegal - YOU CAN SUE THEM. If the debt they are calling about is over 5 years old - it may be TOO OLD TO COLLECT based on Statute of limitations. SOL is determined by your STATE laws - Which is another FDCPA Violations
Refusing to VALIDATE THE DEBT IS ALSO ILLEGAL.. The burden of proof is on them - NOT YOU - HDHTouchdown replies to goodguy0249AvanteUSA Ltd.

FAX:713.785.4467 - Maria| 1 replyVery rude person stated I owed a debt from 1999, and they received my information from INDEPENDENCE RECEIVABLES CORP, a "debt buyer". Would not release any information to me but hounded me for my new last name and my current mailing address. I phoned the number back to ask information on the company, and the receptionist did not answer questions, rather, transferred my call back to the rude representative. The third call I made to them, conversation got heated as I explained it is against the law to harrass people at work (he had promised to call me every week about this "debt", which does NOT show up on my credit report - - otherwise I would've paid it!) and also collect a debt more than 7 years old and that there was no collection letter sent regarding this "debt". The representative said almost word for word : "so for social security number XXX-XX-XXXX (yes, he read my correct social to me!), debtor is refuting the charges". My answer? Without proof I own this debt, you damn betcha? Can anyone suggest action I can take to block this number from calling my WORK PHONE?????

- ACReceived a call on my cell from a Kay Scott from # 832-476-1739. She left a Message on my voicemail for My husband and demanding that he call her back immediately without saying what for but making it sound like as if he was in some kind of trouble. So when I called the number back to see what it was about they would not answer my questions or tell me who they were or what they wanted. They just kept asking me if so and so was my husband. When I didn't answer them they hung up on me. These people are obviously trying to scare and scam people out of their money making them believe they owe some kind of debt.

- HarrassedHad several calls from these people looking for my partner, they call my business cell phone. Looking for her we are both here on Business working visa's and do not have the facility to get credit from anyone. As we are not US citizens, so do not have any credit cards or any credit in the US. Always pay with UK credit cards or cash, so can not possibly owe anyone anything.

- Bailey RaeWe just started getting calls from this number 832-476-1739 and get a recording that this is a debt collection call.
In the past we had been harassed from another company with a different phone number and when we finally proved we don't have any debt the phone calls stopped.
Now a week later the above phone number starts. We think its the same company that harassed us before using a different number.
They are a scam. They find old debts over 7 to 12 years old and try to collect on the debts.
We have a clear debt record and know that we don't have anything outstanding.
Don't let them get to you.- Caller: Unknown
