    Philadog replies to I pay my bills
    I pay my bills, You don't know someones situation so you should not even comment. On my case the hospital only had to submit the charges to the insurance company the right way and chose not to. My health insurance company and myself contacted them about their errors but they did nothing. That was five years ago now. I haven't had that insurance now for three years. So this new company AVANTE USA bought the debt. I have washed my hands of this debt cause I went above and beyond to settle this. So #IPAYMYBILLS you just need to shut your pie hole.

    Wrong... replies to common sense
    ...Per the FDCPA, a debt collector bears ALL the responsibility of proving the alleged debtor owes them money - the alleged debtor doesn't have to prove anything!

    http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors

    Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

       is seeking payment on a debt for a loan you do not recognize;
       refuses to give you a mailing address or phone number;
       asks you for personal financial or sensitive information; or
       exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

       Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

       If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
       Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
       Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
       Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
       Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

    It is not the government's job to do anything but take your money in taxes in the USA. Go back to the communist country you came from so you will not be bothered since you couldn't afford a phone in the first place.

    http://forums.debtcc.com/creditors-information/know-address.html

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
    Read up on your rights here, get template letters to send and also make a complaint at this government site:  http://www.consumerfinance.gov/

    This Avante calls from a different number every time they call.  I have blocked 14 of them now.  Of course if they are indeed a bill collector - they will eventually find the person - they have access to a lot of information.  They will keep calling that number (even if it's wrong - until system gives them another number to call).  It's frustrating and hopefully the system the government has put in place will come up with better ways to protect is.  If they are criminals they don't have the time to constantly call a number that they know is a wrong number that will just hang up on them.  They are smarter than that.

    This company is trying to collect on a debt that you regardless of the date of service , you do owe. The fact that it is 14 years old just means that they can not sue you. They have every right to collect on services that were rendered. You left out of your statement that it was a valid debt that you just chose not to pay.

    They collect on all varieties of accounts not just credit cards. Medical, internet loans, home alarm etc. If they are calling and you know you do not owe anything then verify and find out what they are calling for it could possibly be a wrong number.

    Definitely not a scam, and the ones who tend to think that are the ones that owe the debt. If you don't owe anyone then give your proof of payment, receipt, or an e.o.b proving that you do not owe. 90% of people find that they do owe

    Bull schiesse.  It is up to YOU, the debt collector to validate the debt, in writing, according to the FDCPA.  It is not up to the alleged debtor to provide any proof or any other information.  Don't like it?  Boo hoo for you.  That's the law.

    Gunnar replies to Debt Collector
    Sorry pal,  it doesn't work that way.  It's never the supposed debtors job to prove a debt isn't owed. It's the collectors job to prove that it is. In writing. By mail in the form of a complete notice of validation within 5 business days after initial contact with that supposed debtor. As per federal regulation under the FDCPA.
    The collectors that tend to ignore those technicalities are the ones that are admitting that they're trying to collect invalid, time barred or bogus debt. So, which one of those types of debt is your outfit trying to work? Let me guess. What ever type is on sale at the moment right?
    Skeff Ett Liv!
