    Automated call case JLWxxxx documented attempt to reach you regarding a matter being pursued in our office. Number shows up local in Texas but office is in Florida.  Bradley and Weinstein. Website is one page with no links or reviews. There are ways to determine if you have a legitimate case against you and the people suing do not call you first instead you get served.

    Received the same type of call.  The caller was a recording telling you to call back with case# Joxx?? and that this will be last call. I never got a first call.  I returned call, he stated he was from Bradley & Weinstein law. He knew my last 4 SSN #, but he used an old last name,  also old account that was closed for over 7yrs. When I threaten to report him he said, see you in court and hung up. I think he obtained my info from off the Dark Web?  This is defiantly a scam

    They are asking to call via text message to a 855-705-0264 number now. Say I owe a pay day loan form 2013! Never took a payday loan. If I had a default this would have been on my credit. My credit has been clean for years. I asked for them to send a debt validation. They send they would, and had my address. Will they actually send something? I'm not sure. This makes me so angry. I'm at my wits end with this bs. I've dealt with scams like this for years, and really wish something would get done.

    I doubt they will but I guess you will have to wait.  Since they accepted your verbal request for debt validation (which they did not have to do ) they must now cease all communications with you until they furnish the debt validation.  Do not confuse the debt validation with the dunning letter.  They are two different things.  Also, if they do send anything in the mail please stop back and post their address.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

    This company keeps calling me, giving this account #JMK 19130. The voice message keeps stating that my cooperation is required within my state guidelines. Never received any info in regards to this company until now. The phone # pops up as High Risk Scam. Calling them back & advising them that this is harassment & to stop calling the phone # they have & that only lasts for a couple of weeks.  I have informed them that if they keep calling, I  be contacting my lawyer. I know for a fact that they are not a true collection agency, if they were legit, they would ask for my lawyers info & not just hang up.

    I just got a call from the same Bradley and Weinstein, from a local number, asking for a call back to 844-759-0092. Same 3-letters-then-numbers file/reference number. Same half-legal jargon sounding vaguely threatening. Same thing, talking about a non-existent payday loan when I called them (or, for some folks, one very old, and long since paid off). I've read a lot of concerns from people about how they have your info, how they have the last four of your social, etc. Put simply, they purchased it, on a spreadsheet. This is just the latest on a long line of the same type of scam that has been going around, and for many of you, this is likely not the first call you've gotten of this sort. For those that haven't gone through this before, let me help with some of the info.

    To explain where this is coming from:

    It all goes back to a man named Joel Tucker, and his family, in Kansas City, Missouri, and his company eDataSolutions (among other names). They had the records for millions of applications for payday loans (because his brother was a payday lender at the time, and they got the information from online sources that would send out payday loan applications to many lenders at once) - regardless of whether a loan ever existed or not. Apparently, few, if any, ever actually received a loan. Some, on the other hand, received loans they didn't ask for, and ended up getting charged a ton for the 'help'. (see:

    How does that relate to these calls? Apparently Joel Tucker and his company made up fake loan information to go with the customer database they had, and then sold this fake 'debt portfolio' to unscrupulous collectors. Yes, multiple - they just sold it under different company names, and sometimes apparently changed the lender name on the spreadsheet. Literally, they just made up dollar amounts and put them in a spreadsheet. They did this knowing full well these debts didn't exist, but they could - and did - make a small fortune by selling this debt portfolio to less than reputable collectors.

    Now, as likely happened to you if you're reading this, a "collector" (in the vaguest stretch of the term) tries to collect for a month or two, then they sell it on to the next group. Odds are, you'll get a similar call about ever 3-6 months, from a different company, claiming a debt from some new 'payday lender'. They'll just use whatever lender names they find on the spreadsheet. The typical (not always, but most often I've found) way they go is they claim they are working with a lawyer, or sometimes they claim to be a law firm themselves, and that you're being sued because you never paid on this loan. They'll want a statement, and of course, they want to know if you 'want to settle this matter' - by paying them right now.

    They'll often get belligerent if you disagree, maybe they'll hang up on you. They'll yell at you, call you a deadbeat and a loser. They'll tell you that you'll be arrested within 24 hours if you don't pay. Tell you that police or 'uniformed officers' are waiting to come to your home or office. They'll threaten to get you fired, to ruin your life. Just to make clear - they can't do any of those things. It's all to scare you into paying on the never-was loan. Honestly, I've told them before I wish they would sue me! But they never will - they won't sue me, and they won't sue you. Why? Because if they did, they'd have to actually provide their information, and that would allow you to counter sue. Think about it... these people won't even provide a real business name. You think they're going to let their real info ever get on file with a court? Ha!

    Someone took the time to put a lot of effort into tracking these people down. I've put a link to his story (a rather long article) below. It's quite in depth. Out of the originators of the scam, one is in jail, another is under Federal indictment. One co-conspirator apparently committed suicide. Unfortunately, it doesn't stop the cycle of scam debt collector selling to scam debt collector calls we all receive, because you can't break the cycle. The non-existent debt just keeps getting sold for pennies from one scam collector to the next.

    A 2020 update – Joel Tucker has finally been brought in, and plead guilty and will, it seems, be going to prison for, among other things, the selling of these fake debt portfolios.
