Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

It's a collection agency. They called my work number. The number must have belonged to another company previously. The 866 company rep was very short and rube, but agreed to remove my work number from the calling queue.

I called them back to tell them to get me off their list and was basically told by another recording that all operators were too busy to take my call and I should leave a name and phone number.

I looked at my caller ID and the name TRIANGLE appeared. They have continued to call my home for the last 2 years!

- JaneI receive calls from this number periodically usually between 5p - 9p CST on my home phone which has an unlisted number. We never give it out. It's always a recorded message that says, "Hi, this is _______ with an important message for you. Call me back at 866-212-7408. Bye." I called them from another phone number and asked for the person. I held for 6 minutes, but they never came to the phone. I called them back and the women who answered the phone said the woman I was asking for was "just the receptionist." I told her I kept getting this message at my unlisted number and wanted them to stop. I asked her what company this was and she said she couldn't give me any information until I told her who I was and what number the company was calling. She was extremely rude and I got nowhere.

- wrong guymy parents received a call from this number asking for me. I know I have never had an outstanding debt so I called back the number to confirm. The woman I spoke to was very nice, she mentioned I had an outstanding debt with a check into cash payday loan. I have never had one of these loans so I asked her to verify social. The social was incorrect and she kindly removed my phone numbers from their call lists. At the end of the call she asked that I state outloud that they have the wrong number so they could record it.

- Your GodsendI'm currently dealing with RPM, they reported to the cpa's that I had a "joint" responcibility cell phone account with T-Mobile, I spoke to T-Mobile and they said that there was only one person primary responcible for the account. Also, they are also re-aging the deliquancy of the debt to make it appear as it's currently past due as of March 2010, instead of Nov 2009 when it was first reported! What they did is against the fair debt collections practices act. I filed a complaint against them with their ag and the ftc, I'm also seeking councel.
