Here is my step by step guide to get these parasites off your back.
1. DONT PAY
2. DONT WORRY
3. The ploy they use is that your acceptance recorded conversation forms a legal binding contract. Whilst there is a grey area of law over this it is a very hard battle for them to fight as they have to prove in a court of law the call was not edited to suit their purposes
4. They will never have a recorded conversation of what they "offered" you at the outset, you are always passed to someone else and thats when the call is recorded, they are not going to record themselves making false statements!
5. If you have fallen victim, do not answer the phone to them, it will simply get your blood pressure up
6. instead reply by email and send a copy of the email by fax
7. Immediately report them to the canadain competitions bureau the candian fraud office does not cover directory scams. Also report them to the BBB
8. Use the exacellent letter found on this forum (I think its page 3) and edit it to your own case. Make sure you state that phone contracts have no wait.
9. In the letter state the following
"For the best outcome we feel it is best you now move forward immediatly to take legal action against us as you feel your case is so compelling, sending more threats and invoices will amount to no conclusion so it is best to let the courts decide from here on. Please note we are aware you have no recording of the original sales call where you missrepresented yourselves"
You are then putting it in their hands to take you to court. Do you honestly think they will?
To take you to court they have to first go through a smalls claims court then if not in the same province they then have to file a suit in your province. A lot of money for $500!

Today they faxed me a new invoice.... from two years ago....played back the recording of me saying yes yes yes yes yes yes yes yes.........Its plain as daylight to see that these guys are pulling a scam.

I do think for both parties we should now move forward to settle this matter legally as you feel your verbal contract is binding, therefore instead of phoning or sending more invoices please make arrangements to settle this matter in court.
In regards to this memory stick Please be on notice that we are hereby revoking our acceptance of the delivered goods for the following reasons.
1. Misrepresentation of original sale.
2. Inferior quality of delivered goods.
3. Quality of delivered goods does not conform to the telephone conversation.
4 .The goods were never ordered.
5. Inflated price of merchandise.
6. No terms and conditions ever received

- the worm that turned replies to Almost ScamedThis is simple - If they record the first call then they are implicating themselves, This is where the whole BS about a recorded contract falls apart and would not stand up in any court.
You can not have a recording of you saying yes to something without the recording stating what the offer was for. Even then it wont stand up as who is to say the recording was not edited.
These guys play on peoples fears and nerves, its human nature to pay to get rid of a problem.
Phone up the competitions bureau and the first thing will tell you is "DONT PAY" The second thing they will tell you is "YOU ARE WITHIN YOUR CONSUMER RIGHT TO REJECT THE GOODS OR SERVICE AS NOT AS ADVERTISED"

You will receive a one time reply only stating your complaint has been registered and they will follow up with you if they need more info. - FunnyTo say the least Gloria from Dataclick doesn't like me much! She sent a fax to my boss twisting everything I said after I refused to pay them and telling her it was a Scam. Lol, funny that I'm the one that receives the faxes and throws out all the scams and soliciations that come through! Too bad that didn't work out for her! Three clear red flags that this is a scam...
1. They now are not giving out their last names. On all the faxes and in all the phone calls she never gives her last name. Anyone out of the 100's of vendors I deal with on a daily basis provides full names and contact info when legit.
2. They are extremely pushy calling, faxing, e-mailing every few days sometimes multiple times in a day. Nobody who wants your business crosses the line of harassment.
3. One the phone Gloria was extremely rude and evasive. Anybody that want's your business treats you respectfully and gives you the answers that you need so they can continue to receive your business.
Although what do I know? I'm not as smart as I think I am... Or at least that's what Gloria said to me!

- the worm that turned| 1 replyWelcome to the world of Gloria, I do often think what kind of social life these people lead, job satisfaction must be very low, or they are just twisted.
What to do next is simple follow my above advise and it is imperative you report them to the competitios bureau, I was told a few twice by the bureau that the more complain the more chance of a presecution. One such case is already going through the courts, so the bureau dont sit back and do nothing.
I can only urge everyone to report them, then we may finally see the back of these twisted people.

- Scam Flip replies to the worm that turnedForget about reporting these people. They are like worms; cut off their head and they'll grow another one. What you need to do is have a little fun with them. First confirm that they have put your company name into their bogus directory. Then ask for their billing address or better yet ask the person who is calling for their credit card number. Of course they'll ask why, this is when you tell them that you charge $576.00/year for the privilege of using your company name on their web site. Be creative, tell them the call is being recorded and demand immediate payment or you will report them to the credit bureau.

- cdpm0711I have been dealing with these people and tried all the tactics listed before to get them to stop (including lodging a complaint with the bureaus) and I was told by "Marlene" that she would put a note on my file but she couldn't cancel my invoice. Does this mean they will still harrass me? How do I get it to stop once and for all?

Alternaitvely write to them and state
"As you feel your invoice is binding and we can reach no agreement on this I suggest you now start legal action against us and let the courts decide.
From now on we will only communicate via a bona Fidi legal representative"

- The worm that turnedI should of added. They WILL NOT take you to court, remember they are well aware that what they are doing is fraudulant so they are not going to draw legal attention to themselves.

Gordy called stating we owe them. This invoice is over a year old and we had a notice not to pay. He threatened collection action and said they have a voice recording agreeing to service. We will definitely not be paying them.
