§ 804. Acquisition of location information
Any debt collector communicating with any person other
than the consumer for the purpose of acquiring location information
about the consumer shall—
(1) identify himself, state that he is confirming or correcting
location information concerning the consumer, and,
only if expressly requested, identify his employer;
(2) not state that such consumer owes any debt;
(3) not communicate with any such person more than once
unless requested to do so by such person or unless
the debt collector reasonably believes that the earlier
response of such person is erroneous or incomplete and
that such person now has correct or complete location
information;
(4) not communicate by post card;
(5) not use any language or symbol on any envelope or
in the contents of any communication effected by the
mails or telegram that indicates that the debt collector
is in the debt collection business or that the communication
relates to the collection of a debt; and
(6) after the debt collector knows the consumer is represented
by an attorney with regard to the subject debt
and has knowledge of, or can readily ascertain, such
attorney’s name and address, not communicate with
any person other than that attorney, unless the attorney
fails to respond within a reasonable period of time to
the communication from the debt collector.
(c) CEASING COMMUNICATION. If a consumer notifies a
debt collector in writing that the consumer refuses to pay a
debt or that the consumer wishes the debt collector to cease
further communication with the consumer, the debt collector
shall not communicate further with the consumer with
respect to such debt, except—
(1) to advise the consumer that the debt collector’s further
efforts are being terminated;
(2) to notify the consumer that the debt collector or creditor
may invoke specified remedies which are ordinarily
invoked by such debt collector or creditor; or
(3) where applicable, to notify the consumer that the debt
collector or creditor intends to invoke a specified remedy.
If such notice from the consumer is made by mail, notification
shall be complete upon receipt.
(d) For the purpose of this section, the term “consumer” includes
the consumer’s spouse, parent (if the consumer is a
minor), guardian, executor, or administrator.
§ 806. Harassment or abuse
A debt collector may not engage in any conduct the natural
consequence of which is to harass, oppress, or abuse any
person in connection with the collection of a debt. Without
limiting the general application of the foregoing, the following
conduct is a violation of this section:
(1) The use or threat of use of violence or other criminal
means to harm the physical person, reputation, or property
of any person.
(2) The use of obscene or profane language or language
the natural consequence of which is to abuse the hearer
or reader.
(3) The publication of a list of consumers who allegedly
refuse to pay debts, except to a consumer reporting
agency or to persons meeting the requirements of section
603(f) or 604(3) of this Act.
(4) The advertisement for sale of any debt to coerce payment
of the debt.
(5) Causing a telephone to ring or engaging any person
in telephone conversation repeatedly or continuously
with intent to annoy, abuse, or harass any person at the
called number.
(6) Except as provided in section 804, the placement of
telephone calls without meaningful disclosure of the
caller’s identity.
And my personal favorite, pretending to be a law office..aka
§ 807. False or misleading representations
A debt collector may not use any false, deceptive, or misleading
representation or means in connection with the collection
of any debt. Without limiting the general application
of the foregoing, the following conduct is a violation of this
section:
(1) The false representation or implication that the debt
collector is vouched for, bonded by, or affiliated with
the United States or any State, including the use of any
badge, uniform, or facsimile thereof.
(2) The false representation of—
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may
be lawfully received by any debt collector for the
collection of a debt.
(3) The false representation or implication that any individual
is an attorney or that any communication is from
an attorney.
(4) The representation or implication that nonpayment of
any debt will result in the arrest or imprisonment of
any person or the seizure, garnishment, attachment,
or sale of any property or wages of any person unless
such action is lawful and the debt collector or creditor
intends to take such action.
(5) The threat to take any action that cannot legally be
taken or that is not intended to be taken.
(6) The false representation or implication that a sale,
referral, or other transfer of any interest in a debt shall
cause the consumer to—
(A) lose any claim or defense to payment of the debt;
or
(B) become subject to any practice prohibited by this
title.
(7) The false representation or implication that the consumer
committed any crime or other conduct in order
to disgrace the consumer.

I have an attorney on call if they pursue the last NSF payment for check fraud. While I do owe the debt, I cannot pay it at this time. If they want to harass me with threatening law suits, then I will remind them of laws they neglected of their own.- Caller: Patrick Corbett Law Southern Tier

I myself used cash net in order to get a loan of $250.00 to fix my car, which $175.00 IS in fact still due, His office now tells me it is $700.00. I was told this is fraudulent activity, and they cannot under any circumstance do anything to you them or us. You must do one thing, answer the phone when they call, initiate the contact, then ignore all calls afterwards, they cannot call anyone else for this matter. It is against the law. I WILL be proceeding with charges against this company...Stay tuned. papers are being filed tomorrow...

- kaithank you for these posts...I just listened to a voicemail and it was someone from "Patrick Corbetts" law office regarding my case...and they gave me a case #...they said they expected a call within the business day from me or my representing attorney. So, I called back and as they put me on hold to transfer me to the "associate" working my case I pull this thread up (because I googled the law office) and hung up immediately...needless to say, they called right back like a "hot lead" and left no message...hmmm

- biggiesMr Corbetts representative contacted me to collect a debt that resulted from Identity theft. I know who the theif was. They informed me that since I knew whom it was, that I had to pay them and collect the money from the ID thief. Also said that the Supreme Court already had a ruling on this very subject. Contacted my state Attorney General who will assist me in handling this idot. I traced the transaction myself (not a lawyer) and found that the money was borrowed in my name and deposited in an accout with the ID thiefs name on it. I let Mr. Corbetts representative know that I was contacting an attorney. They said if they recieved a "cease and disist" they would take me immediately to court. I think that is illeagal too. The messed with the wrong guy over 320.00-they need to do thier homework like I did

I've been receiving many calls from a Lloyd Leon with Patrick Corbett's office in regards to a payday advance loan that was opened (illegally) via the internet as a result of my identity being stolen. Having family and friends as police officers, I filed the police reports and spoke to the issuing payday loan agency and they were very pleasant and had the debt removed from my credit report. However, now this schmuck has his goons hasseling me at work, on my cell, and at home to collect on a debt that is no longer in existence and has been verified to be as a result of ID theft. After reading all of the blogs here, I demanded proof of debt in writing, which they begrudgingly sent, and it says exactly what everyone has been saying on here - absolutely nothing legitimate. When I called their offices, I demanded to speak to Mr. Corbett himself, and the so-called "legal assistant" became irate and said, "what, are you reading stuff on the internet or something - because none of it is true." I demanded that Mr. Corbett himself call me back so we can discuss this case...we'll see if he has the balls to call me, as I work with a group of lawyers at my office.

- robert holmesi got a call on feb.13 2008 regarding a fastcash payday load saying i owe $675.00 and if i didnt pay it it would go up to $2200+ and it would then turn into a felony and i would go to jail.Well i fell for it and today on june 6 2008 they took my whole check off my debit card.well i went to the police and my lawyers and they both said that it was a scam.SO THANKS ALOT PATRICK CORBETT FOR TAKING MY MONEY

When I called back, there was no one available to spk to me. They gave me a case#, but I really don't know what this is in reference to. The ph#800-841-7793. How did they get my phone number when it is unlisted? Why are the calling me as "private" all the time?
