I urge all of you to file a complaint with the attorney generals office for violation of the FDCPA. Here are a couple reasons why we have a good case
1.It is against the law for a debt collector to leave any information besides name and number on an answering machine. It violates disclosure laws. The ONLY way they can say anything else is by saying the mini miranda which states "this is an attempt to collect a debt, any information obtained will be used for that purpose." and even then they can NOT say they are sending a summons, they are not allowed to say anything else but company name basically
2. Secondly, kind of related to the first one, they do not say the mini miranda when they talk to us. MAJOR violation
3.Most likely they are a 3rd party collection agency who buys debt. The people calling are not investigators, they are debt collectors, they misrepresent themselves which is also an fdcpa violation.
4. They are not allowed to contact a 3rd party, i.e family, friends ect, once they establish contact with you
5. They are not allowed to tell a 3rd party anything other than their name and their phone number. Saying they are investigators and telling family why they want to talk to us is a violation.
If you can, record their phone calls. KEEP THE MESSAGES they leave. They are proof.

- Donnaa lady by the name of Dianna Reese called me and said she was from the county I was from, and that someone would be delivering a summons to me by 9am at my home. She even left a case # for me. The oddest thing was she knew my maiden name which I havent used in 17 years. How is that possible? What made me think after a short panic of oh my god, what did I do? was she called my brother's house phone and asked for me, (she got thier answering machine) and two, the number was not a local one, let alone a New Jersey phone number (1-866-891-9725)I naturally then googled it to find where it was and came across this page. I did try to call it back but got an animated answering service. This is scarey the level people will go to scam money from others. Its horrible.

He also mentioned that it was a fraud investigation, left a docket number and said that she must have her own attornry contact him back. He also mentioned that he is sending a summins for a court appearance to her home and job, so I am interested in finding out if he really sends her something. I am so glad that I decided to research him before I gave my mom the number. I cannot believe what people would do to others for money. I guess some people really do not want have REAL jobs to pay their own bills.

- ec replies to February 8, 2008With that one phone call, your mother has grounds to sue this shyster for multiple violations of the Federal Debt Collection Practices Act (FDCPA). First, it's illegal for a debt collector to disclose anything about a consumer to a third party -- even if that third party is her son. Secondly, it is illegal for a debt collector to threaten to sue when he has no intention of suing. (By the way, debt collectors don't issue a summons; courts do.)

If Corbett contacts her more than once after receiving your letter, then he's in violation of the law (again) and you can lower the boom on him in court for fun and profit.

Just yesterday, 02/07/2008, Southern Tier Agency Inc pulled my wife's credit report without authorization. We do keep strict accordance to our credit files, as in to keep good records, etc....
Their current phone number is 716.681.6450 and is located at 2265 George Urban Blvd, Depew NY, 14043-1921. I am a licensed investigator for law and government. I was shocked to see that this illegitimate organization was able to get my wife's experian credit report without written authorization.

I ran the dispute section in Experian to determine who pulled this credit report and for what. It says for "collection purposes". I immediately initiated the fraud alert option on my wife's credit file because they have pulled someone's credit file without legitimate authorization.

Clearly enough, this is in violation of several federal laws including the privacy act on credit reports. I am not a lawyer but I know enough that is a fact. For their action, I am going to go after these guys for internet related fraud crimes. In 1998, OCL obtained the conviction of an individual in Colorado who had fraudulently obtained a credit report to use in a political campaign. **Criminal charges also lie where a consumer reporting agency knowingly and willfully provides information concerning an individual to a person not authorized to receive that information. 15 U.S.C. § 1681r.** The criminal provisions of the FCRA are only enforced by the Department of Justice.

Jenbone74 - D. GrantReceived a call from Erin Smith at the law offices of Patrick Corbett regarding a claim against me that needed to be resolved immediately. The social sec no. he left on my voicemail was not mine - someone with a simliar name though. I am in South Carolina and this "case" was filed in Herdon County, OH. I spoke with Erin and notified him that he has the wrong person, that I'm an accountant in SC, and I'm certainly not incarerated as the message also indicated. I searched for Patrick Corbett online and now I see this. Although he had the wrong guy, I wonder if I still have some recourse. Regardless, I will certainly be filing a complaint and monitoring my credit closely. Ironically, I just registered with freecreditreport.com last week for the first time and I still haven't received my access code to view the report. Who knows.

- jules34I received a call from Partick Corbett Law office on Thursday, stating that they were going to issue me a summons the following day, if I did not provide them with my bank account information to withdrawl funds from my acccount. I gave them my account info, and set up to take out the monies on Wednesday of the following week, because ther was not going to be any money in my account until that day. The only thing, was that I requested that they send me some information on the case prior to taking the money out of my account. Monday rolls around, I go to the bank, and they tried to take the money out, now I am pissed..... I call them and they said they would issue a check for the inconvience of taking it early. Now it is Wednesday and I am getting calls again that the monies were not transfererd, and they want my debit card information, I said ABSOLUTELY NOT!!! He kept pushing me, and said he would drop the price of my settlement if he could make the trasaction today (this was Thursday - 14th). On top of all this, I received a numerous amount of harrasing phone calls and my mother received calls as well. They called my mother and gave her inforamtion about me and my case, what happened to confidentiallty????
I called my lawyer, he said that if they call again, tell them to send the summons and he will take care of the rest.

- Tired of this scam already| 1 replyI received 2 calls one this morning (2/21/08 @ 7:53am) mistake #1 from some character with Patrick Corbett's Law Offices at 866-891-9725, he left me a voicemail this 2nd time on my work vcml machine to return his call with in 48hrs (mistake #2) it is againt the FDCPA to give a specified time for a return collection call. his voicemail also stated that if not returned in 48hrs there would be a summons issued for a court appearance (mistake #3)debt collectors can not threaten court unless they have already filed papers in the courts. the kicker to all of this I am not the person who has the debt and my answering machine here at work has my full name on it so why he illegally left me this vcml regarding someone elses detailed debt problem is beyond me now granted my last name is the same as the person he is looking for he just assumed that I was a spouse (mistake #4) although I am I could have very well been an aunt, niece, grandmother, mother etc. this is disgusting and they shouldnt be able to get away with these illegal practices to collect a debt. The first time he actually contacted my husbands employers HR Dept. and let them know a summons will be delivered to them for my husband soon if he doesnt call them back within 24hrs (Mistake #5) so of course my husband was upset so we decided to call this character when we got home that evening we called put him on speaker phone and ripped him a new one for calling my husbands place of employment and asked him officially not to contact his employer from this moment forward under any circumstances I explained if my husband looses his job he cant pay you anything and we'll be suing you and paying the debt back from the money we collect from our lawsuit against you the caller was unusually quite I went on to ask him who the original company was that says my husband owes them money he had no real answers just gave me a generic answer stated it was a payday loan company (well what the heck is that!!!!) so then I asked him the specific debt amount he gave me some off the wall amount and I knew then I had a live one here he had generic facts but nothing really specific so if you do return this characters call be sure to get specifics about the debt he is eligidly collecting on and to end all ends he asked us what type of payment plan we could arrange with him and I played along and said 5 monthly payments on a debt he claimed was $700.00 (so totally bogus and made up) he quickly said that wouldnt work and if I could pay it in two installmets and they can only except electronic checks, debit or credit cards I told him I dont know him from a can of paint and he would never get any direct access to our account information and if this is a true debt you would have excepted not only the payment arrangment I offered but made a debt settlement amount to get this paid in full which i also offered during the conversation again remember I'm just playing along to see how far he'll go he told me I sounded like I knew a little about collections and I let him know that I'm a collection call center manager for a check recovery agency and I train new personnel on the FDCPA before they hit the call center floor so the company doesnt get sued for illegal collection practices he fell silent again hahahahah and for the last 16 years have done nothing but collections and asked him to try another tactic on the next person bacause this one used on me was whack and to end it all this man never once verified any of our personal information (ie: SSN, DOB, current mailing address to verify against the one he has on file (amateures) any collection agency has this information in order to obatin any type of credit you must supply this information on the application which is also turned over to the collection agency from the company trying to collect there bad revenue) he should have done this first to assure he was talking to the correct person before he let out all of our business to what could have been our babysitter and her boyfriend calling him back in our place hahahahahah (mistake #6) gotta laugh this bunch is a real joke and a lawsuit just waiting to happen if anyone decides to go after them let me know count me in on this one, I'll be checking this site regularly be aware of these scammers they clearly bought some old collection accounts and dont have any facts to back them up.
