    3 WNY debt collectors agree to reform after $245,000 fine

    Three Western New York debt collection agencies have agreed to “substantially reform their business practices” and pay $245,000 to the state in settlements with state Attorney General Andrew M. Cuomo.

    In a press release Tuesday, Cuomo accused the firms — Creditors Interchange Receivable Management LLC, Capital Management Services LP and Tri-Financial LLC — of failing to “adequately supervise employees who engaged in deceptive and fraudulent methods.”

    Chris Morrow, director of operations at North Tonawanda- based Tri-Financial, said “the ownership group has no comment,” and then hung up.

    According to the state press release, the three companies were the subject of numerous complaints received by Cuomo’s office, alleging fraudulent tactics in attempts to collect debts. The complaints accused the companies of:

    • Contacting alleged debtors “without a lawful justification for doing so” and even after being asked in writing to stop.

    • Contacting consumers at work even though collectors knew consumers’ employers prohibited such contact.

    • Discussing consumer debts with employers, neighbors and other third parties, even after being told to stop.

    • Falsely claiming they were acting on behalf of an attorney and that the company or creditor would start legal action.

    • Failing to respond to requests to verify the debt.

    Under separate agreements, the three firms will enhance compliance and make it easier for consumers to file complaints against individual collectors. All three must create direct links on their Web sites to consumer complaint forms.

    Here we go again…another slimy, illegal bottom feeder operation has popped up in Buffalo, NY trying to collect on old, worthless, out of statute debts. Owner Jamie P. Belstadt, a retread of the collection business is trying to collect on debts that are 8+ years old. The documents we saw appear to have been produced by a second grader.

    John D. Yim, 36, of North Tonawanda, NY, Vice President of another junk debt buyer called CNE Associates; LLC is churning out the phony documents. Vision Credit Solutions, LLC and CNE Associates, LLC show NOT to have any debt collection license or Surety Bond in any state we checked.

    In his phony paperwork, collector Yim refers to the consumer as a ‘defendant’ which appears to violate federal law. His ridiculous form would be better suited as toilet paper than anything worthy of validity. It is pure garbage, nothing he states is true, he makes statements that false, misleading and appear to violate federal law, the Fair Debt Collection Practices Act.

    All of these bogus organizations are nothing more than smoke and mirrors to intimidate, harass, lie and mislead consumers into thinking they owe money on worthless accounts. This is typical ‘Buffalo Style’ debt collections that we’ve seen dozens of times.

    These organizations are operating illegally, the accounts have no validity, and the statements they make are false, misleading and ripe with lies. John D. Yim has no idea of what he is doing; Vision Credit (started April 2008) and owner Jamie P. Belstadt are as illegal as all the other affiliated organizations collectively known as the Mackinnon group out of Buffalo. See www.giovelawofficeexposed.com.  

    Save your money, these creeps are new players at the old con game; expect the usual threats of pending litigation, posing as lawyers, police and court officials. No one should fall for this scam. If Vision Credit Solutions, CNE Associates or Tri-Financial contacts you, contact us for assistance and referral to a local consumer law professional.

    CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you feel they are reporting on your credit bureau files in error or need assistance in dealing with them, email  the details w/your location.  Assistance and referral to a consumer legal specialist may be available.

    bud hibbs is the worst debtor to ever disgrace this planet with his presence. the only knowledge he has is first-hand experience due to being sued so many times and constant calls from agencies for overdue debts he never pays. so there's a bit of brilliance for you... take your advice from the biggest scumbag in texas.. and we know there's plenty of those.. so that's saying something about how truly grimey and worthless bud hibbs really is. but that's ok.. you keep listening to him.. see how far that gets you.

    They hate it whenever anyone refers the posters to his site for assistance.  

    Collectors don't want you to go to his website because they do not want you to know that YOU HAVE RIGHTS AND THE COLLECTOR IS VIOLATING THEM!

    They did this to me and the debt they are trying to collect on isn't even mine. It just so happens that the person they are trying to collect on has the same name as my minor son. I found out what company they bought the debt from and I called that company. I talked to customer service who transfered me to the accounts dept. That company told me that my minor son nor I are associated with the account in question. Will Tri Financial leave me alone.....I hope so, but I doubt it.

    Got a call on my cell asking me to call them.  I did, gave my name and they hung up on me.  Then I looked up the phone # on google and landed here.  I just re-financed my home and had a credit score of 790.  So there's no bad debt out there.  Sounds like phishing to me and I won't be calling back.

On top of that if it wasnt for the scumbags that hide behind there called ids and avoid paying there bills the economy would not be as bad as it is.
