I am suing them for harassment as well - I am getting those stupid recorded calls from 'peter stanton' - but only after they were calling my office on a daily basis and pretending to be a service doing a 'background check' on me, wanting to speak to our office manager.  Well my office knows that Tri-Financial is pretty much an extortion scam so they have no interest in speaking with any of them (particularly 'jeremy' who tried on various occasions to get past our lovely receptionist but to no avail. my attorney file the complaint last week so they should be served soon...  they are horrible people.

what an idiot you are, jose - or should i say 'Jeremy' or 'Peter Stanton'. I think most people WOULD pay their 'original' debt, but not the 1200.00 over a 255 dollar original debt..  guess what Jeremy (or Jose, or whoever), you are being sued. Yes that's right, you are being sued AND I've contacted the original company that i borrowed from and they said that they NEVER sold my account to Tri-Financial - how about that? Anyway, they were willing to work with me and pay back my $255.00 loan, for the low, low price of $300.00 bucks. Far cry from the 1200.00 that you were harassing me for, now isn't it? go ahead and try to harass my co-works or my family... they know all about you, and will not give you the time of day. so much for your 'background checks' huh?

you and tri-financial are pigs.  have a nice day!

Yes that's right, you are being sued AND I've contacted the original company that i owe my debt to and they said that they NEVER sold my account to Tri-Financial - how about that? They have their own collection department and Never contact out to bottom feeders such as yourselves. Anyway, they were willing to work with me and I've since paid back my $255.00 loan, for the low, low price of $300.00 bucks. I get these calls all the time - caller ID shows either No Name/No Number or Private Name/Private Number. I don't answer calls I don't recognize, so they go to the answering machine - the message they leave is just to call this 877 number to resolve "this issue" and that they have tried several times to contact me. No mention of what "This Issue" is, just a threatening male voice.
I will NOT answer those stupid calls! If they can't show me on caller ID who they are and what number they are calling from then they can forget it, or sue if they think they can get away with something stupid like that!

Some tips that were on the news in my area (due to phone scams going on like mad here):

    1. Don't give out personal info if you did not initiate the call.
    2. Never give personal information, such as your Social Security number or bank account number, to anyone you don’t know
    3. Guard your credit-card number. Unless you are certain that you are dealing with a reputable organization and you initiated the call yourself, do not give your credit-card number over the phone.
    4. Take your time. If someone tells you to “act now” or to keep the transaction a secret, be skeptical. Don’t be pressured into making a rash decision. Talk to trusted family members and friends for advice.
    5. Get information in writing. Demand that callers send you written information before you send any money. If they refuse, don’t trust them. Under Ohio’s Telephone Solicitation Sales Act, a purchase is not valid until the telemarketer receives written confirmation from the consumer. Once you get written information, review it carefully and make sure the company has a physical address—not just a P.O. Box. Verify that the address is real.
    6. Do your research. Check a company’s reputation by contacting the Attorney General’s office and the Better Business Bureau before doing business with them. Before doing business with any company verify that they are registered with the Secretary of State to do business.
    7. When in doubt, hang up the phone. If something seems fishy, it probably is.

This is on my states attorney general website:

The FDCPA requires debt collectors to send you an initial letter within five days of contacting you to tell you the amount of the debt you owe, the name of the creditor to whom you owe the debt, your rights to dispute the debt and how to request verification of the debt.

Under the FDCPA, debt collectors may not:

       * Use false names or statements, such as falsely implying that they are attorneys.
       * Threaten you or your family with harm.
       * Contact you before 8:00 a.m. or after 9:00 p.m.
       * Contact you without identifying themselves.
       * Tell others about your debt.
       * Falsely represent that you have committed a crime.
       * Misrepresent the amount you owe on your debt.

Several idiots from this company keep calling a number assigned to the TN Bureau of Investigation (TBI) in Nashville, TN (an agency of Tennessee state government), and asking for a person who formerly worked as a temporary employee for the Bureau.  The person that Tri-Financial has continued to ask for and leave semi-threatening, harassing messages for, has not worked for the TN Bureau of Investigation since prior to April 1, 2001.  Employees of the TBI have explained to the callers (always different ones) on several occasions that the person they are seeking never has been a full-time employee of the TBI or the State of Tennessee and hasn't worked at the location where the telephone is located for several years.  Tri-Financial employees are still insistent and apparently either don't care or don't have the intelligence to understand.  They are generally very rude.  I'd suggest that persons getting continual harassing calls from this company seek a cease and desist order from a court or get a warrant for telephone harassment.

Perhaps the TBI could launch its own investigation of these bottom feeders.

yep everyone is right they are scammers.  I have my attorney looking into them too.  They are illegal.  trying to act like they have some authority over the debt they don't in fact if they did the debt would already be in the courts etc.  Just remember if you actually owe the debt they have to validate it in writing they can't just tell you to send money.  If you don't get it in writing it doesn't exist.  :)
