Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Now this collection agency is calling and leaving messages pretending it is " to lower your credit card interest rate" or " you have qualified for a free home security system." I never called them back because I already KNOW that trick.
This collection agency trick is that they call you and act as if they are offering you something, then they want you to call back and give them your information " to be removed" from the list, supposedly. You then confirm information so you can be supposedly removed from their"list" WRONG.Then they bother you mercilessly if you give them your information. Don't give them anything and don't confirm anything. DO NOT call them back. Ignore the calls if you don't know the number. Do not answer!
Report them to your State Atty General and the Consumer Financial Protection Bureau.
Trust me - *even if you are NOT the person they are trying to call*, they will still keep calling you and bothering you because they just want to bother someone. Take action against them.

So first off they should have sent a letter to your wife within 5 days of their first contact. If they failed to do that they violated the law. So what you need to do is this. You need to send them a certified, return receipt cease and desist calling letter. Then you need to file complaints on them at the proper agencies. Then you need to get a consumer lawyer and sue them for FDCPA and TCPA violations.

"All it takes is a verbal request! " If only life were that easy. Again, the request can be verbal to start but must be followed up with a letter, preferably sent certified, return receipt to first prove that they got it and second to start a paper trail in case they ignore it (it has happened many times).

Really GENIUS if your information was as up to date as you like to think it is you'd know FACTS bill collectors are held to the same laws as telemarketers which is under the TCPA telephone consumer's protection act. They in addition follow the FDCPA .. they dont " have their own laws they need to follow" and again if you want to validate your debt the best way to do it is to contact the original creditor such as united states department of education. Odds are if you havent received something in writing they have no updated address from you...its YOUR Job to locate and be responsible of your financial obligations.
