    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Do NOT call these people back and do not answer your phone if you don't know the number!

    Now this collection agency is calling and leaving messages pretending it is " to lower your credit card interest rate" or " you have qualified for a free home security system." I never called them back because I already KNOW that trick.

    This collection agency trick is that they call you and act as if they are offering you something, then they want you to call back and give them your information " to be removed" from the list, supposedly. You then confirm information so you can be supposedly removed from their"list" WRONG.Then they bother you mercilessly if you give them your information. Don't give them anything and don't confirm anything. DO NOT call them back. Ignore the calls if you don't know the number. Do not answer!

    Report them to your State Atty General and the Consumer Financial Protection Bureau.

    Trust me - *even if you are NOT the person they are trying to call*, they will still keep calling you and bothering you because they just want to bother someone. Take action against them.

    They robocall constantly, call and hang up leaving no message, or call and leave stupid messages saying they want to lower the interest rate on my credit card or give me a free home security system. Yeah, sure. Jerks.

    To people being harassed by these collectors - do NOT give any information over the phone. File complaints with the Atty General and BBB.

    People cannot harass you unless you let them. Change your phone number if need be to get some peace. DO not answer.

    Many of us are dealing with serious health issues or family emergencies and the last thing we need is to be harassed by some collector with a high school education who gets paid $8 an hour to upset people.

    People - do NOT answer the phone if you don't know the number calling you. They spoof local numbers all the time to make it appear as if it might be someone locally that you know. Don't answer the phone and do not call them back!

    Once again, do NOT call them back for any reason, even if it is not you or if they have the wrong person, as they will never leave you alone.

    File a complaint with the Attorney General and the Consumer Financial Protection Bureau. Also complain to Dept of Educ.

    If enough people file complaints, these Collectors WILL be taken off the Dept of Ed collector list for their shady business practices!

    I have received numerous calls from these people. They call asking for my wife. I explain that I am not her and to please remove my number from their list. They have not and continue calling. What remedies do I have with these people

    I hope you all know this fms person responding is the scammers helper . Trying to get you to call the number shown if you have default loans go and call them not accept a call there are scams going out everyday and this is one.

    What remedies do you have?  First, verbal requests never work on debt collectors.  The law also specifies that things should be done in writing.  So first off they should have sent a letter to your wife within 5 days of their first contact.  If they failed to do that they violated the law.  So what you need to do is this.  You need to send them a certified, return receipt cease and desist calling letter.  Then you need to file complaints on them at the proper agencies.  Then you need to get a consumer lawyer and sue them for FDCPA and TCPA violations.

    I receive calls from this number staying I owe Huntington bank which I do not called and confirmed with them because I currently have an account with them. They state I have a debt of over $10,000 and it's a felony and they are pressing charges and I will be going to jail. When ask where the company is located they tell me my hometown and I know no such company exists there with this name

    Where do you people come up with these things?? Not sure if ! company is legit? Do the right thing call the right people US DEPT OF EDUCATION and locate your loans. They will route you to FMS if your loan is being serviced by them. So on and so forth. What good is your college education if you cant educate yourself on how to track your OWN loans .... myeddebt.io  you would be surprised at how much you can help yourselves! As for the cases of wrong numbers and unwanted calls to third parties have you guys ever heard of DNC???? ask them to put you on the do.not.call list!!!! Make sure u speak with a manager to do so if you feel the rep hadnt done it! All it takes is a verbal request! Do your research people. Get it together. Good luck this shouldn't be difficult for those with common sense!

    First the law states that the debt collector must prove that the debt is owed and that they have the authority to collect it.  Not the other way around.

"  If only life were that easy.  Again, the request can be verbal to start but must be followed up with a letter, preferably sent certified, return receipt to first prove that they got it and second to start a paper trail in case they ignore it (it has happened many times).

    The dnc doesnt apply to  collectors??? Really GENIUS if your information was as up to date as you like to think it is you'd know FACTS bill collectors are held to the same laws as telemarketers which is under the TCPA telephone consumer's protection act. They in addition follow the FDCPA .. they dont " have their own laws they need to follow" and again if you want to validate your debt the best way to do it is to contact the original creditor such as united states department of education. Odds are if you havent received something in writing they have no updated address from you...its YOUR Job to locate and be responsible of your financial obligations. Theres no arguing that so FYI LEGALLY IF YOU TELL THEM TO REMOVE YOUR NUMBER AND SPECIFICALLY STATE YOU ARE REQUESTING TO BE ON THE DO NOT CALL LIST THEY CANNOT CONTINUE TO CALL THAT NUMBER.     Please post up the relevant DNC page section that say's this. Oh wait, its isn't the DNC, its the TCPA!  They fall under the FDCPA & TCPA laws!

    The DNC is for sales and service and does not include some surveys,political or charity calls! Survey's that try to sell goods or services at the end are not exempt.

    Some Tips:
    *Keep all messages
    *Take a picture of your Caller ID
    *Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
    *Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
    *Check your SOL for your state as well.
    *Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.
