Their is no statute of limitations on debt as long as they do take the proper steps to keep the debt viable.  I am not sure where this myth came from, but it is incorrect - I have asked a number of attornies about this.

Some one keeps calling me from this number. This is an irritating annoyance.
Even though I do not answer calls that hide the Caller ID, or shows up as "unavailable", this number was revealed by an automatic detection device on a dedicated fax line, showing that the calling party is just fishing for unsuspecting suckers who answer the phone whwn they call random numbers.

Acctually it depends which state you are in ...They can only report it on your credit report for seven years that goes from the day the debt was made in arrears. yes there are agencys who change that date but you can contact the credit reporting agency and have it changed back or removed that is your right by the federal trade act.

Received 2 calls to my cell phone. A voicemail was left by an automated recording on the second call which said (Please hold for next available representative. It is important that we talk to you). My cell then disconnected due to silence.  I have no debt and I don't give out my cell number for public use. I added the # to my 'Block' list and assigned a MUTE ringtone. They can waste their time all they want.

Sorry, but that's not 100% true. Each state has a statute of limitations for debt. A valid debt will remain a valid debt until the end of time. A collector or a collections agency may attempt to collect on that debt until the end of time. However, each state has a specific # of years that a lawsuit may be filed based on the default of a debt. At issue is where the last known activity occurs within a debt & is usually the date of default if not further payments have been made. A revalidation of the debt, including the acceptance of a new payment plan or an agreement to pay a lesser percentage than the original amount, resets the clock for the statue of limitations in most cases & is usually through a third party debt collector & not the original debt holder. The statute of limitations for debt varies widely by state & differs depending on the type of debt (oral, written, promissory, & open) with the lowest being 3 years & the highest 15 years.

Well, this number just called me.  However I don't answer the phone unless I know who is calling.
So, thank you for telling me it is ER Solutions.  They try to use several different numbers to call me from just like Port Folio Recovery.  Yes, I have some old debts 5 and 6 years old.  So, they are still trying to collect from me.  However, I am on disability now, and do not have the money.  When my Izuzu Rodeo got repossessed in Sept. 2007, they sold it at auction for $2,000.00 or so.  But, it had almost 95,000 miles and was breaking down.  I am not answering the phone just to get in a heated argument with all these people who are calling.  I live by myself so there is no one else here who
can answer my phone.  These agencies also try to call me from out of town, out of area, unknown name and number, and private number.  Like I am going to get up and jump on that phone!  LOL.  I don't know anyone out of area or with a private number.  So, as long as I don't talk to them and agree to a payment plan, then they can't re set the old debt.  At least I hope they can't.  I don't know all the laws on this but I do know they cannot garnish my social security check.  The only 3 reasons my social security check can be garnished is for child support (and I am a female and my son is 26), for student loans, and back taxes owed the IRS.
    Well, take care everyone.

Over three years ago I removed a person from my life. Won't get into the details but he lied to me and anyone else. He has outstanding debts with a number of places and loans.  Yes we were together and yes we lived together but these are in his name.  I had no idea until after that he was not paying anything.  i worked 3 jobs to hand over money for bills.  i now have debt collectors calling me asking for him.  i tell them he isn't around and told them where he has since moved in Philly.  i also have given them his family members names and contact numbers.  this has been going on for almost 2 years.  i want it to stop.  how can i do this?

Simple economics ... don't give them any cash flow, they'll eventually go out of business.  Pickup the receiver and then hang up ... has to cost them something so eventually if you don't pay them anything they have to go out of business.  Problem is with those that do pay.

No disrespect but I do not necesarily agree with your comment.  Every state has a statue of limitations on debt collecting- for an individual to be sued.  It is illegal to for a creditor to "re-age" an old debt on someone's credit report. An old debt can be "re-aged" when someone make a payment to for an old debt (7 1/2 years and older) and the statue can restart all over again.  I would suggest not paying those old debts.
Also, eventhough a debt is older than 7 1/2 years and has been long since removed off your credit report, companies may still send letters and call;  in means of trying to collect- in which they buy these for pennies on the dollar.  Even if you pay them, it would not reflect on your credit report, as they have already been removed- I suggest only to pay old debts if you have a moral obligation to do so.

I am not sure what proper steps you mean that could be taken to void a statue of limitations.  Please explain further.
    ps- I am an attorney.

    DONOTCALL
This number has recently began calling my cell phone alone with several other numbers all registered to an ERS Solutions Company who is a registered Debt Collector Outsourcing company. I do not have any outstanding debt and have had this phone number for the past 8 years. If you are lucky enough to get a live person they will not tell you who they are calling on behalf of or provide any information. They are rude and demanding.

Here is their claim to business: Convergent provides inbound and outbound receivables management across all stages of the consumer and commercial life cycle on both a first and third party basis.

If you google search these people their are thousands of complaints filed against them for this type of activity. I guess in today's economy they figurer random calls to random numbers may generate some form of revenue to stop the harassment, sort of like playing the lottery.

I too was being harassed by this company, even after calling to remove my name 5 times. I do not owe anyone anything - they were looking for the previous owner of my phone number and I explained that each time I asked them to remove my name. Fear not, though: I found the CEO's name and phone number: Michael A. Micek, 402-496-2332, 13617 Nicholas St, Omaha, NE, 68154. I called him and he agreed to remove my number.

You are wrong.  I am an attorney and every state has a statue of limitations for debts.  If they don't sue within the time allowed, they lose their right to sue.  Some states say that if the debtor admits that they owe the money and say that they will pay, that extends the statute of limitations.

If a creditor sues you and gets a judgment, they can keep that alive forever, provided they renew the judgment, usually like every ten years.
