    We just got a home phone installed and this 877 number keeps calling us but its not a person calling its an automated service so I called it back and told them we just got this number and the lady was so polite and said she was going to remove us from their call list.

    You have the legal right to ask them to stop calling you. You have to request that they "cease and desist." Ask for their mailing address and send them a "cease and desist" letter. You can get the basic template off the web. Send it certified mail and keep the return card handy. If thet cal again, be polite, and tell them you sent them a c&d letter that they received on xx-xx-xx10 date. By law they may then only contact you ONCE more by mail and not by phone. If they call you again, you have the right to file legal action. Keep records of all dates and contact types.

    I did this because a former roomate of mine had issues. One letter and one phone call later all contact stopped.

    This # came on my cell phone a couple of days ago I didn't answer it they didn't leave a message. I called it back and got a message.

    Fed Up
    These scumbags call my home number asking for someone who had my number before 1998. With a  little research around town, I found out that the previous owner of my number was another scumbag who skipped town with his clients' money, was finally caught, and is now in the federal pen. I tried to explain this to them, but get nowhere. Now these Portfolio Recovery Associates scumbags call every day. I just don't answer.

    This is an incredibly misguided response.

    There is NO "Statute of Limitations" for debts. Even twenty years later...  they can still come after you.

    "... don't respond ... "  That's ridiculous. They assume the debt is legitimate, unless you prove otherwise. Once an item is in the collector's hands, it's considered legit, and you have to satisfy it or prove otherwise. It doesn't matter what you say. You can say it's not yours, don't remember, it's wrong, ... whatever... it doesn't matter.

    And... "they will eventually get tired"? That's just stupid. This is going to follow you forever - your credit will be bad. And they can still come after you years later.

    There are three ways to end this: 1- Pay it  /  2-Bankruptcy discharge  /  3- Prove that it's incorrectly attached to your name (paid, not yours, ... ).

    The statue of limitation only applies to pursuing you in court, not the debt itself.

    It is a crime to record any conversation, whether oral or wire, without the consent of all parties, in most states. The penalty for violating the law is a fine of up to $10,000 and a jail sentence of up to five years in the commonwelth of Massachusetts.

    Please remember also, if this is your first conversation with a bill collector, act like a mature adult and most times you will be treated like one.

    Got 2 calls in the last 30 minutes from "Portfolio Recovery Associates."  I've learned to google anything or anyone I don't recognize cause there are so many scams out there... finding these blogs defintely helped cause now I know what I'm dealing with.... good thing I have a whistle!

    You are twisting the law to meet your needs

    It IS NOT A CRIME to record conversations.  Most states are considered 1 party states - meaning only 1 person involved in the conversation needs to be aware of it.

    In fewer states - you must tell the other parties that the call is being recorded.  
    These are called 2 party states

    Here is the law for MA no where does it state YOU CANNOT record - it states clearly that all parties must consent to being recorded.  

    Massachusetts

    It is a crime to record any conversation, whether oral or wire, without the consent of all parties in Massachusetts. The penalty for violating the law is a fine of up to $10,000 and a jail sentence of up to five years. Mass. Ann. Laws ch. 272 , § 99.

    Disclosure of the contents of an illegally recorded conversation, when accompanied by the knowledge that it was obtained illegally, is a misdemeanor that can be punished with a fine of up to $5,000 and imprisonment for up to two years. Civil damages are expressly authorized for the greater of actual damages, $100 for each day of violation or $1,000. Punitive damages and attorney fees also are recoverable.

    For example, in Com. v. Hanedanian, 742 N.E.2d 1113 (Mass. App. Ct. 2001), the appellate court held that a defendant’s conduct of intentionally making a secret tape recording of oral communications between himself and his attorneys, without consent, violated the statute, even though the defendant was a party to the conversation.

    However, the First Circuit, applying the holding in Bartnicki v. Vopper, 532 U.S. 514 (2001), held in 2007 that a woman who accepted from a source a recorded tape, that she had reason to know was recorded illegally by the source, could not be punished for publishing the tape on her website. The court held that the woman had a First Amendment right to publish the tape she received. Jean v. Massachusetts State Police, 492 F.3d 24 (1st Cir. 2007).

    An appellate court has also held that the recorded conversation or communication does not need to be intelligible in order for the interception to violate the wiretapping statute. Com. v. Wright, 814 N.E.2d 741 (Mass. App. Ct. 2004).

    This is a junk debt buyer by the name of Portfolio Recovery Associates. They attempt to collect on debts that many times are time barred by state and federal law. Also, they frequently violate the federal debt collection laws and have been sued in many states. If you want to quickly stop their calls, send a cease communications letter, certified mail with return receipt. If they continue to contact you, sue them and collect $1000 per violation.     I constantly gets calls at all hours from these people. Numerous times per day and it has been going on for months.   I ignore them.  They sometimes leave a short message to call back and other times nothing.  TODAY, I called them back.  Some type of collection agency looking for a person I have never heard of.  I have lived here over 11 years with the same telephone #.   Gave them some of my personal feelings and told them I would take them to court if the harassment does not cease immediately!  They said they would remove my phone number.  Time will tell.  Enough of this crap!

    I had a few run ins with this company. It was horrible, 6,7, 8 calls a day. I couldn't get anyone on the line to talk to.It was frustrating to say the least. I found a service called Prepaid Legal, it has been a god-sent. I made one phone call and the attorney wrote a letter for me; problem all gone, but that wasn't the end PRS sold the debt to another company. Once again I called the service, they wrote another very strong letter to this company and have never heard anything since. It has been a couple of yrs now.
