- Tammy| 4 repliesMy mother died last summer - a year ago! Since then I have been receiving calls from this agency - calling themselves Ascenscion Point Recovery Agency. Last year they had a man from the agency call me and tell me that my home could be seized and my wages garnished because my MOTHER left some unpaid debts and I am her only heir. Mom did NOT leave any money in the estate - the nursing home took every cent she had. She literally died penniless. In fact, there wasn't even enough money to bury Mom, so I had to take my savings to pay the balance. I can't even get a proper tombstone for Mom because I can't afford it.
I have told these people, over and over again, that I CANNOT pay Mom's debts. They were NOT in MY name. I was NOT a co-signer. But, they keep calling - and they've called me at home, work, and all odd hours - day and night, ever since.
I have written these people a "cease and desist" letter, last summer - yet, they ignored it. I have asked them (verbally) to please stop calling and DON'T call me at work. They call even MORE since then.
I have now spoken to an attorney about filing a lawsuit against them. He told me I can probably collect several thousand dollars from them just based on what I told him over the phone today.- Caller: Ascension Point Recovery Services, LLC.

IF YOU HAVE A LOG OF ALL CALLS RECEIVED from them - you can also sue them under TCPA for $500. PER CALL. as well as their Fair Debt Collection Practices Act Violations.

I pity the relatives you are actually able to scam, because they must be as ignorant as lemurs to fall for your scam-artist bullcrap.
His credit reports have told me who is owed what. So I had a pretty good idea you were a bunch of lying, conniving, worthless vultures when I returned your call, before I checked this website (and others).
The same-voiced woman who had left a message on my answering machine asked ME what my call was in reference to, and whose call I was returning ("HeLLo, 'KEIL': Knock-Knock, Anybody Home There?!"). She then put me on hold to rifle through papers and try and figure out ANOTHER potential creditor to work her scam-magic with, since the creditor she blurted out wasn't even a creditor.
I've given my Mom, who is a feisty old 80-something, permission to cuss your vulturous [***] up one side and down the other. Whatever they're paying you to try and commit fraud on the relatives of dead people will probably seem like chickenfeed by the time she gets through ripping you a new one. You'll doubtless reconsider your decision to take up bogus-debt collection rather than suck dix for $5 a trick, which no doubt your previous job, 'KEIL'...bwahahahaha!!!!- Caller: ASCENSION POINT

- Not an Attorney replies to Tammy| 1 replyI'm not an attorney, and I would recommend you consult one if you want real legal advice, but the law seems pretty clear to me: If you didn't sign anything you are not liable. If you didn't inherit anything you are not liable.
They are harassing you because they think you'll crack and give them money.
* Be firm. Don't give into threats.
* Change you language from "I cannot pay my mother's debts..." to "Stop calling me. I am not liable for my mother's debts." The "I cannot..." makes you sound weak and implies that you would pay a debt you don't owe if you could. Also, don't go into the details about how you had to clear out your savings account to bury her, can't afford a headstone etc. It's not relevant and by sharing such details you are implying that the employees at Ascension Point are capable of empathy. If they were human, they wouldn't be professional vultures.
* Sound like a broken record. Keep repeating "Stop calling me -- I am not liable for my mother's debts" in response to *ANY* question whenever they call.
* Start keeping a log of every call, especially note any time they use threatening language, call you at work, or yell at you;
* Tell them you are logging calls with the intention of sending a copy to your District Attorney
* Periodically send a copy of the log and copies of any correspondence you send to or receive from the collection agency to your local DA with a cover letter noting that you are being harassed about a debt for which you are not liable. Be sure to note that they were notified that you are not liable for any of your mother's debts last summer. The DA might not do much, but you might be surprised if it's an election year and in any case the main reason for doing this is to build a paper trail you can use as evidence in court if you need to.
* The best conversation stopper I've come up with is to ask the "agent" if he/she minds if you record the conversation. Alternatively, I don't ask, I just tell them that I am recording the call when I answer and this is my legally obligated notification to them that the call is being recorded. They usually hang up immediately. (Note: Check your local laws before trying this. It's legal here, but it may not be where you are). - animal lover replies to LAMET| 2 repliesThanks for all the info you put online. I wish everyone could see the info as I know there are many,
many, many families out there being harassed by this business and others. I was simply the
POA--had no relation to the person. He was my mother's companion. Unfortunately, he was
heavily in debt and I am swimming in bills but I KNOW they are not my family's responsbility.
I am now sending copies of the death certificate and a cover letter to all the creditors. The person
did not have an estate so there is nothing that can be done. I just wish all the unsuspecting
people out there struggling to pay debts for someone had access to all the info that protects

us asking for family of the deceased. Well, guess what--my family was not related to him.
I was his POA and my family doesn't have to pay a dime. The person didn't leave an estate
so there's not one thing you can do--ha ha ha!!! Again, we don't owe anything. If you were
halfway legit, your company name would show up on the caller ID but it doesn't. And why
did it take so long for you to contact the family?
You say we need to stop whining, grow up, and pay the bills. Well, duh, not everyone you
contact is responsible for paying them. Now let's see you get the money!!! - HappyinMD replies to BobI too received a call from what I now know is a scaming debt collection agency. Since I knew what debts were owed by my late family member and had been in contact with that company, I erased the message from Acension Point. Acension tried calling other family members, but I've already warned them off and told them not to return any of the calls.

- cjbrooksI just spoke with a Representative from Acension Point who call about my deceased brother's debt. She gave me the debt company name and the amount and asked about the Probate and/or Estate. I advised that there is no Probate and No Estate and that we were already aware that we were not libel for any of his debts. She AGREED that we were not libel and said this remarkable statement:
"I know that you are not personally libel for this debt, but sometimes family members are in a financial position to honor their deceased family by covering their debts."
It was all I could do to keep from laughing and falling on the floor. Hey, I'm a nice guy . . . but not that nice to pay something I don't personally owe.

- Julianne replies to ascension pointAscension Point has been harrassing me since my mother died last August. There is NO money left in my mother's estate. The nursing home agency made sure of THAT. They took her for every cent she had and then some. I am not in a position to be able to pay off her debts...I have a home, mortgage, bills out the wazoo and a child to support - I certainly can't afford to take on a whole bag of bills that I didn't incur. I have explained this to the numb nut collection agents, when they called, but they continue to call...day and night. Especially at work - they got ahold of my work number and they've made complete pests of themselves, even though I have asked them NOT to call me there.
I have spoken to an attorney, and he advised me that I am NOT liable for my mother's debts. If I were a billionaire and had money to burn, then I could easily pay off her debts - mostly medical bills - but i am not. I'm a lower middle class working sap and I got NOTHING left to me when Mom died. There was absolutely NOTHING left to LEAVE to me. Period.
You should HEAR some of these collection agents. The one that called me fifteen minutes ago was apparently very bored and sick of his job. As soon as he said "Ascension Point" I interrupted him - let him know I am NOT taking his call at work, etc. I heard a deep, heavy sigh on the other line - then he asked me to please call him back at the number he left...spoke in a monotone voice, sounded like he was reading a script.

Have started getting calls from 888-420-2510 2 - 3 times daily about a person named Carol Burns, have never heard or known anyone by this name. They identify themselves as Ascension point trying to find relatives regarding this late person's estate. I think they have a wrong number. But, I'm never home when they call and have no intention of calling them. Obviously they have plenty of time to try to squeeze money out of people...sad- Caller: Ascension Point
